Domestic Violence and Contact

Domestic Violence and Contact

What counts as domestic violence?

Domestic abuse covers a wide range of behaviour between people who are or have been intimate partners or family members. It includes physical violence, but also emotional abuse, controlling behaviour, financial abuse, sexual abuse, and threats. The abuse does not need to be physical to be taken seriously by the courts.

The legal definition applies regardless of gender or sexuality. It also covers young people aged 16 and 17, recognising that teenagers can be victims of abuse in relationships.

Domestic abuse often involves a pattern of behaviour rather than isolated incidents. Courts and support services look for these patterns when assessing risk. Coercive control, where one person uses tactics to dominate and restrict another, became a specific criminal offence in England and Wales under the Serious Crime Act 2015.

How domestic abuse affects child contact arrangements

When parents separate, the family court often considers that children benefit from having a relationship with both parents. However, this is not automatic. The court must consider any risk of harm to the child or the other parent.

If there are allegations of domestic abuse, the court will apply Practice Direction 12J. This sets out how judges should handle cases involving abuse. The court will consider whether the abuse happened, what impact it has had, and what risk it poses going forward.

Contact may still be ordered in cases involving domestic abuse, but with conditions. These might include:

  • Supervised contact at a contact centre
  • Indirect contact only, such as letters or video calls
  • Handovers in public places or through a third party
  • Conditions that the abusive parent complete a behaviour change programme

In serious cases, the court may decide that direct contact is not in the child's best interests. Each case is assessed individually, taking specific circumstances into account.

Your situation may be slightly different. ask a question below ↓ and our editorial team will reply with our advice.

Evidence the court may consider

If you are raising domestic abuse in a contact dispute, the court will want to see supporting evidence where possible. This might include police reports, criminal convictions, medical records, text messages, emails, photographs of injuries, or statements from witnesses.

Physical evidence is not always required. The court can consider your account and decide whether it is credible. A fact finding hearing may be held to determine whether the alleged abuse occurred before the court makes decisions about contact.

If you have a non-molestation order or occupation order in place, this will be relevant. The court will also take into account any findings made in previous family proceedings.

Legal aid may be available if you are applying for a protective order or if you can provide evidence of domestic abuse. The evidence requirements include medical reports, letters from domestic violence support services, evidence of a protective injunction, police reports, or confirmation from a multi-agency risk assessment conference. Full details of acceptable evidence are set out on GOV.UK.

Getting help and support

If you are experiencing domestic abuse, or have experienced it in the past, there are organisations that can help.

The National Domestic Abuse Helpline, run by Refuge, offers free and confidential support 24/7 on 0808 2000 247. They can provide advice, safety planning, and help you find refuge accommodation if needed.

Citizens Advice can help you understand your options regarding housing, benefits, and legal matters. Many local areas also have specialist domestic abuse services that can support you through court proceedings.

If you are going to court and are worried about seeing the other parent, you can ask for special measures. These might include separate waiting areas, screens in the courtroom, or giving evidence by video link. You can make this request through the court or ask your solicitor to do so.

For men experiencing domestic abuse, the Men's Advice Line provides support on 0808 8010 327. The Galop helpline supports LGBT people on 0800 999 5428.

If you are in immediate danger, call 999. If you cannot speak safely, stay on the line after dialling and press 55 when prompted. This is part of the Silent Solutions system and lets the operator know you need emergency help.

Family court proceedings involving domestic abuse can be difficult. Getting legal advice early, even if only an initial consultation, can help you understand what to expect and how to present your case. Many solicitors offer a free or fixed fee first appointment.

My son has contact and shared parenting for his 5 yr old daughter.
There has been extreme violence between his ex-partner and her boyfriend.
The boyfriend has been arrested and despite his behaviour they are still together.
My son wants to ensure the safety of his daughter and wants to know if he can issue a court order against this man which will protect her from being around him.

Hi,

I'm trying to find legal information regarding my children witnessing a physical fight between my ex and his new girlfriend. There was smashing up of possessions, kicks and slaps. I am drafting an email to him today but was looking for credible legal based links to highlight how this behaviour must desist or I will take further action. I have, fruitlessly, been trawling the

I don’t know what to do. I left my family home 2 years ago because my wife was getting progressively worse in terms of mental and physical abuse. The lies and manipulation she has carried out has caused so many people issues. Because I am am man initially people didn’t believe me. She now has a mother partner for around 2 years and is now doing the same to him. My kids are witnessing it every day! Last night she cut his leg with a broken glass, he spent Christmas Eve in his car. I think he is trapped babies he has rented his house out and has no where to go.
Do I call the police, I am worried she will make my kids suffer for it.
I’m lost

I was with my ex for 9 years snd was consistently accused of Dom abuse by her.
Trying to prove her lies was impossible and she used the courts and police to get court orders snd stopped me seeing my daughter got 3 yrs.I begged people to see that she was the abuser and they laughed at me.6 yrs later and my daughter aged 10 has been beaten, bruised, lost hair, raped by her mother’s nephew (all kept from me) and social involvement throughout again without my knowledge. My daughter ran away snd when she felt safe told the truth about the years of abuse. My daughter now lives with me full time,is now at the correct weight and excelling at primary school.........Mother has contact when she can be bothered.....
Not all abusers are men......

My ex and I split up two years ago. He has been verbally abusive constantly and makes things really difficult. Police have been called by my neighbours because they have heard the abuse and my son is 7 and he’s constantly listening to it and /or his family constantly slagging me off and pulling me down. It’s not good for his mental health and it’s really dragging me down and don’t know what else to do

My husband was found to be physically abusing children (my 2 girls and his son he had contact with), I left him and moved on in 2018. He hasn’t had contact since then but he has now applied to the court for contact. Cafcass have just recommended that my eldest girl live with her dad when he applied for residence due to my husbands abuse and stating I didn’t recognise the abuse was happening even though I left him. So where does this leave my youngest daughter with her dad as he’s now applying for contact? Cafcass know he abused my girls, the court are aware but I am afraid they will recommend dad has contact. Thanks.

My ex partner was cheating on me whilst I was pregnant and when found out he blamed it on PTSD (he is a firefighter) he blocked me meaning I went through the remaining months of my pregnancy alone. To give a bit of background information, since splitting up I have noticed my ex displays narcissistic behaviour and it has come to light that not only did he cheat, he financially abused me and emotionally abused me. Gaslighting me into thinking I was crazy over certain events that had occurred. I also found out he was in thousands of pounds of debt and also had ran someone over fracturing their hips and hospitalising them.
He then got in contact the month I was due. I allowed him at the birth and I was kept in hospital for a week, where he also stayed to support us. Once I returned home, he would visit as an when he wanted to but over the weeks this became less and less. In a total of 11 weeks he has spent 16.5 hours with his son. I am exclusively breastfeeding and have been since birth and he has asked me to give this up so he can see him without being in my home. I don’t want to do this as breastfeeding has always been something I wanted to do. It has turned very bitter and he stopped visiting because I wouldn’t allow him to take my newborn baby away. I decided to register my son at the very end of the 6 week period as I wanted to base my decision on the effort that my ex partner has put in. He would regularly not turn up to visits, he would always make excuses, saying he was bed bound ill but then be seen out. He missed hospital appointments regarding our sons health despite promising to be there. I chose to give our son my surname. I decided to not put his details on the birth certificate purely down to the fact I don’t trust his intentions / judgement. And certain behaviour had shown he could not be trusted and was irresponsible. During the first two weeks of my son being born I had to call the police on him whilst he was visiting due to him being verbally abusive and then pushing me whilst he had my son in his arms. I have also had to report him to the police for slandering me on social media, writing Incorrect information about me and the situation.

I also have found out he is doing cocaine.

He has not paid or contributed towards his son at all since he has been born, not 1 penny.

Since leaving me, he has no fixed address. He has been staying with a friend, as well as his new girlfriend (the one he cheated on me with).

I have received an email from a mediation company (where josh has told them I’ve refused mediation) that he is taking me to court for 50/50 custody. Our baby is 11 weeks old on Thursday. As stated, I am exclusively breastfeeding. Should I be worried, does anyone know what the outcome is likely to be?

Thank you

I dont think that i and the real concens, contact stopping, and the prev acknowledged concens, were fairly represented to court as to a weak insight to the long standing history. I was looked at, by the suggestion, implicated, as to any reason child did not have contact, by a uninterested father, was i 'held' a 'grudge against him. Cafcass, personally took a liking. And conducted assessment to suggest patental alienation.
He did the job well, my child was removed, and soon enough, as he wants to control my relationship, as i had explicitly implored to the judge he would, he reported suggested mute behaviour, after contact- it has been nearly over a year. Social workers, due to them delaying seeing my child, start to say i cannot have it unsupervised. The dv, was well recorded, and can be presented. Can i take action? For the first time in my childs life, they have had turned a new age, and i have not been able so much as speak to them. I believe psychological dv, is not being acknowledged. Are you able to contact a experienced barrister. Can we see a way parental alienation, attitude to contact be revoked. Through huge working history, of historical risk.

Looking for help on what I can do.

I applied for a court order in November 2018 so I could get access to my youngest child as the mother would only give me access to my other two children.

She then tock it back to court in March trying to change and cut my contact but the courts didn’t allow this and I gain a extra night with the children.

I have found myself coming under a lot of verbal abuse from herself and her mother constantly and the children are witnessing this as it’s everytime I collect or drop off to her.

I have my children asking to stay with me and does not want to go home. It’s my youngest child that is more happier to go back to her mum as she is the youngest and her mothers favourite child so I can see that my other children are being pushed out.

I can’t afford legal assistant and I had to go to court on my own which I was very nervous about but would do it again for my children.

I have reported to police and social services so many times on her behaviour and the effect that she is having on our children.

Is there anyway that I can take this back to court and how and what can I do about her verbal abuse towards myself and is having a big effect on the children I do not know who to turn to and I don’t know what to do as it feels like am on my own and no one is listening to me.

Any reply’s would be helpful
Many thanks

Hi there,

I'm currently in a situation where I have recently broken up with my partner (daughters mum) because she was violent to me over the space of 18 months and on 3 occasions she assaulted me while she had hold of my daughter, aswell as controlling to the point were I was made to stop seeing my family and my daughter wasnt allowed near them, and if I contacted them it would lead to me being assaulted, and recently I stood up for myself and rang the police on her because she had held a knife over me because I had taken my daughter to see my mum, police have bailed her on a common assault charge with it being classed as domestic violence, social services aren't much help because it seems like they're on her side because she has mental health issues, I agreed to supervised visits for my ex with my daughter, but social are now saying she has the right to anything she wants, and they're making demands of me all the time and I feel like I'm still being controlled, is there anything I can do because Its my daughters safety and well bein I'm worried about, by being around my exs emotional state, her violence, aswell as her parents being alcoholics, violent and emotionally abusive towards my ex, aswell as them trying to take over how we raised our daughter

I have had an on and off relationship with my nearly 4 year old daughter’s father for 5 years. Over the time he has been very controlling, threatening and physically abusive. Just recently he has been cautioned for threats to kill. I have witnesses that heard me shouting I couldn’t breathe etc from a physical attack but he wasn’t convicted of abuse (annoyingly). However 6/7 months ago he was violent to me in front of our daughter and she notified her nursery key worker of this but I never took t further due to fear. Yesterday he tried to suffocate me but because there is only light marks on me the police say it’s my word against his. I am applying for a non-molestation order but don’t really know where I stand on future child access? Personally I don’t want him anywhere near our daughter because he has been violent in front of her, verbally abusive to me in front of her and threatens to kill me and actually tried to suffocate me until neighbours intervened.

I just want some advice on where to go now.

I am supporting a lady currently who is also supported by social services. She has fled a domestic abusive relationship and has asked social services not to reveal her new address
They agreed at first, but then the health visitor commented that if the father had PR could we refuse to divulge the address. I suggested that the father could not insist that Social services reveal the address, but would have to apply to the courts to have that information. At that point the victim could point out to the court why she doesn't want her address to be known.
Can someone clarify and perhaps direct me to this information so I can print it out and take it to the next meeting

I have a 7 year old daughter that is under the care of a social worker and pastoral care due to her father emotionally and psychologically abusing her. Her father keeps accusing my husband of physically hurting my daughter then makes her lie to the police and social workers who have now become aware that her father is manipulating her to do this. She is a very confused little girl that needs help due to her father's tactics. I have a child arrangements order but have ceased contact until our next court date which I applied for. I believe I am protecting my daughter from further potential harm, even phone calls and Skype he harassed my daughter and she comes off the phone/Skype confused. I need a helping hand as I feel out of my depth.

Unfortunately, we cannot advise on individual cases, as with most cases there are two sides to every story which has to be investigated through the likes of Cafcass. In cases of domestic violence or intimidation allegations Cafcass will interview both parents in the case, as well as the children, and any others who might be needed, which could mean social workers, medical professionals, or even relatives. From the interviews they conduct, the Cafcass reporter will determine two things: whether there should be contact allowed, and, if so, how much. It’s a measure of how important the Cafcass recommendation is that the court will almost invariably adhere to it.
ChildSupportLaws Editor 06/08/2018 at 3:24 pm
Child maintenance and child benefit have no bearing upon each other. Your ex will still be expected to pay child maintenance whether he sees your son or not or whether a court allows him to see his son or not.
ChildSupportLaws Editor 06/08/2018 at 3:08 pm
Unless your ex has been charged, you would have to prove that domestic violence has taken place. We cannot advise on what you should do to help your case. Cafcass will get involved if you being in an accusation of domestic violence. The Cafcass staff who compile the reports are known as Children and Family Reporters. It’s their job to interview both parents in the case, as well as the children, and any others who might be needed, which could mean social workers, medical professionals, or even relatives. The reporters are social workers themselves, but their qualifications don’t go beyond that (one criticism levelled at them is that they sometimes make observations that go beyond their field of expertise, such as in the medical area).
From the interviews they conduct, the reporter will determine two things: whether there should be contact allowed, and, if so, how much. It’s a measure of how important the Cafcass recommendation is that the court will almost invariably adhere to it.

^^^And I forgot to mention my ex also is addicted to cannabis and drinks heavily. He played it down to the police when he was questioned (obviously) and is now saying he has given it up. Also he has not given me any regular money for our son. If he pays maintenance does that give him more rights to see him?

I was in a relationship with the father of my 9 month old for 5 years... he became controlling and mentally abusive intimadating me using his size to overpower me. He is like it infront of his family who totally normalise his behaviour and blame his drepression and anxiety. I left him when our son was only 11 weeks old and moved in with my parents. At first I was very accommodating with him seeing our son but he got more abs more abusive so i arranged that he will see him at his parents house with me there. This didn’t really work as he was still abusive and violent in their house infront of our baby and infront of his family, being aggressive to me and also his sister and occasionally his mum and dad. After one incident I reported him to the police who took it very seriously and arrested him however he was released with no further action as there wasn’t enough evidence even with his sister making a statement. Since the arrest I have met him with both our mothers present in a public place and he tried to start an argument at the end of the meeting Which make me feel really nervous and intimidated I can’t believe he would start something in a public place aswell. Going forward I want him to have supervised contact with our son. He keeps threatening me with court. I have messages from him and his family which would be some evidence but I don’t know if it’s strong enough. I don’t know what to do now I am scared of meeting him in public and have said about contact centres which he isn’t keen on. I’m worried if he took me to court he would be really manipulative and get more access than I think he should have. Any advise would be great

I was with my ex for a year and a half and left him in April. We had problems during the relationship which I'm not going onto detail about. However when I found out I was pregnant the domestic abuse started. There was a few incidents which happened when no one was around and I don't believe I have any evidence but then there is some where the are witnesses and I do have evidence. He is now telling me he wants contact with my baby but I don't want him to because he has done nothing for her and I'm scared he or his family will hurt her. What can I do to help my case if he takes me to court? Any help/advice is appreciated.

My ex has been going through court in an attempt for unsupervised access. He is dead set against unsupervised and does not seem to bw giving up. He has made my life hell the 2 years we have been apart and trying to use my 2 kids as a weapon at every opportunity. The court has been ongoing for 2 years. Last month i was cross examined by the domestic abuser who i have to call my ex. And my solicitor cross examined him. The judge found me to be truthful with everything i was saying including the fact that he raped me. The way he presented in court did himself no favours. We were sent away and that was the final hearing. He was told to go on a domestic abuse perpetrators programme and complete it. He is halfway through another 5 weeks to go then i am aware from him that he will be going back to court to try and push for unsupervised. At the minute has supervised in a centre. I was also made to pay half of the contact cost which is £40 a month. Doesnt seem like much but thats 40 i could put to my children. Is there anything i can do to prevent contact going to unsupervised.
ChildSupportLaws Editor 26/07/2018 at 3:10 pm
As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. This means we cannot possible predict what a court may decide.

If your ex committed that extent of domestic violence, if an application is allowed a court will order Cafcass to investigate and produce a welfare report. A welfare report should take into account: the child’s personal wishes, the safety of each party and the safety of the child during contact, any harm suffered by the child and any harm that the child might be susceptible to if contact is awarded; and domestic violence experienced by the child or either parent. As specified in the article, in DV cases, the court will always ensure that arrangements are safe for yourself and your child. This may mean that the other parent should have no contact with you or your child. for further information. If you have suffered domestic abuse, you can apply for Legal Aid, I hope this helps.

My ex assulted me twice in home where are 10 month old was police were called on both occasions. I tried to keep the family together for sake of my son, however a few months later he beat me up breaking my jaw into bits aswel as other injuries. He was found guilty of Gbh and has served a prison sentance. Ive been through so much physically and mentally i cant take any more. And the thought of him trying for access makes me so scared for my son. I dont want them being poisoned or abused hes so unstable. Please help

If you are concerned that this may happen, then you can apply through the courts for a Prohibited Steps Order. A PSO is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. The court would do this via a child arrangement order

Hi I left a query could you please advise

Hi I have been divorced from my ex and have a decree absolute in 2014. My son who is 6 years old lives with me with no contact with his dad for the last 5 years as we separated due to domestic violence on child and myself and the father lives in another country. My divorce application mentioned that my son will live with me and my ex didn’t contest this. I am worried that I don’t have a legal document which mentioned that I have custody. Also in case his father tracks us and takes him away from his school . Could you please advise what I should do.
ChildSupportLaws Editor 04/06/2018 at 11:52 am
If there has been a change in circumstances i.e with regards to your son's recent diagnosis, then you can apply for an 'application for variation or revocation of a contact order'. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.
ChildSupportLaws Editor 04/06/2018 at 10:45 am
I am sorry to hear this. However, unfortunately your question is beyond our remit to advise, given that the court has aready decided. Your only recourse is to seek further professional legal advice regarding this matter.

My ex has done a court order & had my 3 year old son removed from my care using that I have Bipolar & Schizophrenia. I am completely heart broken & not been able to see my boy for 4wks.

I was diagnosed with Bipolar in 2015 following PND, discharged from the community metal team in 2016 and no meds (I manage my moods and full aware of my triggers - emotionally abusive ex to myself and my daughter). I have NEVER been diagnosed with Schizophrenia.

Short story - my 14 daughter (his step daughter) found weed and cocanie, my daughter confronted him, he threatened my daughter, I asked him to leave, he wouldn't go so I called the police. He collected our 3 yr old from nursery and refused for me to see him for 3 days and them produced a Step court order to have my little boy removed from my care.

A solicitor has written to the courts with evidence. Proof of drugs which have been reported to police, doctors notes on diagnose, Social Services report from 2015 to say I am no danger to the kids.

A non molestation intention has been serviced to my ex and this will be added to the hearing on the 4th.

I have some voice recordings of how he abuses us and police reports of domestic, but how do I prove the rest?

Hi there, my son is now 12. Over the years my abusive ex partner (i had a 1 year non mol order at the time which was over ridden when family courts allowed unsupervised contact) the orders have been given and my ex never even turned up for 1st visit. This was over 5 years ago and he goes for long periods of no contact then bullies me into contact with our son completely inconsistently. my son now says he doesnt want to see him but im scared physically how Dad will react, recently he came to drop new shoes off fot him and as it was my son who opened the door his dad came into the house, straight into our sons room and took all our sons shoes that he felt were no good and took them away to diapose of. The courts at the time knew of the extreme domestic violence myself and my son experienced and still allowed unsupervised contact even though i explained to the judge he would push or do something violent to me even when handing our son over for contact and the judge said our differences shouldn't mean he cannot see his son. Every heating was a different judge with a different view on the situation but all took the view it was in our sons best interest to see dad unsupervised. Now my son has been diagnosed by caambs as being traumatized by no play therapy is available in our area due to cuts and now he has developed ticks due to stress. My son doesnt want to see his dad but we are both scared of his reaction if i cut contact. What court order can i apply for? If i can apply on these grounds i will ask them to now consider the new 2017 law regarding domestic violence. Any Advice appreciated, thankyou
ChildSupportLaws Editor 01/06/2018 at 11:11 am
It is highly unlikely a court will remove the child from your son. Likewise, it is highly unlikely the court would hand the child to a person who has been proved to physically abuse the child. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. It sounds as though your son has very little to worry about here, if his child is happy and content.

My question is my son has full custody of my grandchild as her mums boyfriend physically abused my grand child she was removed by a court now her mum is going back to court to get custody back she is still with the boyfriend. They have recently got engaged. We have a section 7 report from caff cass high lighting the abuse. My son is worried she will get the child back.
ChildSupportLaws Editor 10/05/2018 at 2:22 pm
In the first place, speaking to your ex about your concerns is the best option. If your ex ignores your concerns, then Much depends upon the circumstances. A court is unlikely to remove your children from their mother if her new partner is not a direct threat and/or living with her. You may wish to seek legal advice, as much would depend upon the details and severity of the conviction.

My ex partner and I split 14 months ago the breakdown of the marriage was my fault and have always held my hands up to this. There has never been an issue over access but I'm now very concerned over her new partner being introduce to my children .

The reasons for this is that her new partner has a conviction for social and domestic violence and also for assault. I am now thinking about fighting her for the custody of my children due to concerns over there future welfare. Where do i stand in a court of law . I know I have to try mediation first but need to know where I stand.

He seems to have brainwashed my ex into the fact it was all a set up and he's not the bloke that he's being portrayed as .

Advise please

Hello. My eldest son aged 10 has recently been getting alot more upset & is having real difficulty sleeping. This has been triggered by his father telling him he is taking me to court so him & his brother will be sleeping over every 2 weeks. Josh has already seen the school counsellor for self esteem issues and help with recurring nightmares about his dad hurting him. I've also made teachers aware of this so they can try and support Josh/ help where need be. My children's father & I have been divorced 6 year's and no regular sleep overs have taken place in this time. Though there was no violence towards my children, there was intermittently toward me. But it was predominantly emotional & psychological abuse which I only became aware of being in a DV relaionship after seeing a counsellor myself (such was the mental damage & trauma).
I have (for approx. 6mths or more) been allowing an over night stay once a month - (because being forced to by him), but even then both boys are not comfortable and always both come home very emotionally upset and usually hungry and thirsty. I have always permitted regular access; he sees them every Wednesday after school and every Saturday though (due to my boys reactions & changed behaviours) have never been 100% comfortable with even this. I am mindful of trying to do the right thing & law states contact should be regular with both parents.
Threatening language and behaviour towards me unfortunately has not subsided at all and this has been witnessed on many occasions by both boys even now over 6 year's on. He has said he now wants regular over night stays and is taking me to court to get this. I don't however believe this is in the boys best interests at all.
My questions are these please:-
1. Is there any way now to prove or highlight my ex husband was emotionally and psychologically abusive ?
2. If not, given the time that has passed and the fact that I didn't report anything when I was with him or ever since (I've just wanted to move on with my life and block him out but do the best by my boys) what is the likely outcome re over night stays ? Also will courts take into account he hasn't has over night stays for 6 years or will this just go in his favour?
3. Is there anything I can do to prevent having to see him altogether? But if my children want to see him, they can do (sometimes they do want to see him but they are never upset if they don't see him)

Many thanks

Much depends upon whether you have had care of your child to date. If your ex usually cares for your child on a day-to-day basis as the primary carer then it is unlikely a court would take your child from her and hand your child over to you without very good reason. The court places a lot of importance on stability and consistency. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.

Hi, i am asking as i have a few questions need answering on emotional abuse.
1) if it was emotional abuse towards spouse and the police got involved, would the police tell the abuser the reason why they were being kicked out of the house?
2) if the victim claimed this to a social worker without any evidence, would the social worker have the right to take the children?
3) if a 2 yr old said to the victims family that she heard shouting, is this classed as evidence?
4) would emotional abuse give you the right to go into protective custody?

My sister lives in the UK without a permit and has been staying with an EU man with whom she has a child. The man hit her today. And now he's threatening to take the child away from my sister because he knows she doesn't have a permanent residence. Is it possible that he can take the child and what can she do in other to prevent it from happening?

My 8 yr old has spoken about intimidation - shouting right in their face several times and grabbing of wrists and pulling about by his abusive dad's long-distance gf, Isie. who is there at all contact Fri, sat and school hols, as works in school. My child had punched themselves and has been displayed uncontrollable anger fits when he hits himself. He doesn't want to see Isie regular Lu and gets panicky if he can't get something right or finish a part of a game on a device , in the time he wants to. He held his worries over contact in, for over 2 years. Never told me of extent of his dad's partners controlling behaviour.
His dad thinks it's acceptable behaviour. Said , it's what the schools do ! Obviously said by his gf who supports children academically in one.
Ive arranged mediation as courts wouldn't take us back in when child's dad tried last time. Said mediation if issues. I can't go again because he might be granted more contact again. They are getting married . She will be moving in , in
2months or more. Still house , where she lives 3 hours away.

@Jmacc2 - unless your PSTD has caused you particular problems relating to your relationship with those around you, then it should not have an effect. The court's concern is the welfare of your child first and foremost and they will make a decision based on that.

I am currently in a custody battle with an ex partner who I have a 7 month old daughter with, my query is could suffering with PTSD go against me in getting half custody for my daughter?

In this case, you may wish to give Woman's Aid a call via the link here for more advice and to explore your options. If you put money into the house, then you should be able to get this back on divorce.

Please can someone advise me I’m in a very controlling marriage. I’ve only been married 10 months. I been with him for 4 yrs I’m starting to go out of my mind. He will not let me pay any bills he wants me to pay him £700 a month. I’m not on good money I work for the NHS. He is self employed and works 7 days 12 hrs a day. I started to get the shopping every week. However he wouldn’t eat it and bought his own. He has nailed the letter box up and put one up on the wall. He will not give me a key. I have no control over anything anymore. I sold my house and I’ve put £105000 into our relationship. All he has done from day one is threaten to move out . But he loves me as he says (impossible). He isn’t very nice to my daughter. The list goes on he turns the heating down to nothing but when he gets in a around 8/30pm he turns it up. He doesn’t speak to me it can go on for months. What can I do it’s his name on the mortgage I have put a home rights on it. I can’t divorce him till May.

Allowing violent abusers access to children is beyond ridiculous. People claim to want to protect children but will still put them in harms way under the guise of "parental rights". Children are often witnesses to abuse between parents and end up emotionally and mentally traumatised yet it is not deemed enough to keep the children away from perps.
Post separation abuse is also very well known but ignored so the direct victims are also put back at risk and for what? For the sake of the abuser's "rights" with no consideration for victim's rights to not be controlled or abused any more. If the abuser wishes to use their kids as a method of control they can and will with full blessings from the messed up laws that insist on contact no matter what AND by forcing victims to gain permission to do things with their children, including holidays and moving abroad to be safe. You get advised to move away from your abuser to keep yourself and your kids safe and then the same law system will force you to hand over the keys to your life, wellbeing and happiness to your abuser any way. It's not a wonder so many people stay until they are murdered.
There is no true freedom when you have kids with your abuser. They get to move on and rebuild their lives and tell whatever lies they wish to, often with backup from family who are blinded to their true selves and keep their victims under their thumb and even work to have their children removed out of revenge and spite.
Social services will even use dv against victims as proof 'they' put children at risk, not the abusers. Abusers get to pick up and drop their kids on a whim and can even abandon them for years but as soon as they feel like exercising their parental rights, however temporarily, BAM they get exactly what they want. The victim's mental health will also be used against them. Suffer depression even if you take medication and have therapy? BAD PARENT. Suffer PTSD after your abuse even if you've sought help? BAD PARENT. You'll even get additional "illnesses" stacked against you by professionals on their pay roll if it will help social services prove your a bad parent and maybe have your kids removed. But there's hope! Be an abuser and no matter what you'll get access to your kids AND your victim too.

The whole system around dv/contact/rights is fudged up beyond belief.

@Mummy - don't feel forced to put him on the birth certificate, because then he will have equal rights. If you don't feel he should be on the birth certificate tell him to apply to court.

Hi
Split up with partner when baby was born,he was violent towards me previously then after baby was born. I have my concerns as he put baby in danger but says it was because of being upset. He wont be on birth certificate but I have said he can still see baby with our family members. Father doesn't want any involvement unless he is on birth certificate. Is this blackmail? Would he have equal rights if on birth certificate even though he has a history of violence?
ChildSupportLaws Editor 22/01/2018 at 2:04 pm
You would both have to attend mediation in order to try to resolve this issue prior to court. If you refuse to attend mediation, then your ex will have the option to apply to court. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. This means it is impossible to predict what a court may decide.

Hi, I have a 3 year old son and have been split up with his father 2 years now he also has a new partner who I allowed to be a part of my sons life for a short while until his father and partner had split up and his father began to confide in me and he had told me about violence that had been going on in his relationship. He told me that she had been abusive towards him and even gave him black eyes at one point! My child’s father then got back into his abusive relationship not long after this and I have texts on my phone stating that I didn’t mind contact between father and son but would prefer if his partner was no longer a part of our sons life as she can be abusive towards his father and I am scared incase my son has to witness this behaviour. My child’s father is now threatening to take me to court because his partner is not allowed (as said by me) to be a part of our child’s life, where do I stand with this in court?

Hi, I was in a past abusive relationship with my ex that my children had witnessed and on several occasions was reported to the police but I chose not to press charges until the last incident 3 years ago, contact with our 2 children was stopped instantly and he hast seen them for 3 years. I had a non mol order out and following a recent incident I now have another non mol order out. Whenever my eldest sees him in town freezes on the spot and has told me they do not wish to see him, I have a new partner who has raised my children for the last 2.5 years . My ex is now looking at applying for access through the courts. What is the likelyhood of this getting accepted ?

My stepson came to live with my partner and myself a year ago after his mum tried to strangle him which was preceded by her smashing his video games tv etc... and mentally abusing him.
He has seen his mum 3 times in a year supervised from a distance by his dad at a McDonald’s restaurant.
He is 13 and does not want contact with his mum she has moved house and won’t tell him where she lives has told him she’s driving again after being banned but not telling him what car she drives. She has indirect contact through messages and phone calls but these have recently became abusive and manipulative much like the house move and driving, when he doesn’t answer his messages she contacts his friends is there anything that we can do to stop this behaviour as it is really disturbing my stepson to the point he is scared she is going to go to his school as this is what she has told him along with telling him to “get over “ what she has done to him.
Police say they can’t do anything we can’t afford to go to court as earn over the legal aid minimum but have no spare money really as we had to start everything from scratch shoes clothes coats etc .. when he came to us

Hi it wasn't through a court order it was social work that decided of a no contact order. But his family is know seening his daughter. Can he apply for contact from prison. Will be be classed as a changed person if he completes courses and his prison time without my trouble. Thanks for the advice I really don't believe he is a threat he's great with us but j can the social works concern. But what happens if he ever met someone else and had kids or they have kids surely this cannot hang over his head for ever.
ChildSupportLaws Editor 08/01/2018 at 2:25 pm
Much depends upon what the court order specifies. If he has a no-contact order through the court, then this would be upheld unless a court of appeal ruled otherwise. We cannot anticipate what conclusions social services will come to with regards to your partner's connection with you and your child. Much depends upon the circumstances. However, social services will judge that if your partner has the capability of violence to his ex, then he is most definitely capable of harming others, including you and your child.
S.millar 06/01/2018 at 9:35 am
Hi looking for advice. My partner had a bad relationship and was violent towards his ex which lead to a no contact order. He has recently been sentenced and his other family is allowed to see his child now. How can he get contact what we did was wrong and he is being punished but he still has a child he loves very much and wants a relationship with but his ex is making it difficult. Social services have also told me he's a risk to me and my child but he's never shown any signs of violence abuse ect to me or my child when he's realsed can they stop contact with us too. I know reading this it sounds terrible but if people could see what I do he's doing everything he can to make his life better people are just sometimes to quick to judge. I don't agree with violence but there's a huge history between them and what he did was extremely wrong.
Takebackyourpower 18/12/2017 at 1:41 pm
If the loser abuser has never seen your child, never taken responsibility and you have the means, plus there's no court order in place, leave the country. There's nothing anyone can do to stop you. You have every right to relocate. He can't make you legally return, if there's nothing legally in place at the time. The longer you are out of the country, the more jurisdiction the other country has over your child. Just, don't tell anyone your plan. He can't claim PR unless its on a court order. If a parent were to decide to relocate with their child, and the other parent has chosen to never have contact with the child, it would be silly for a court to decide to force you back because the other parent suddenly claims PR based on a birth certificate. I speak from experience.

This was a great read, although very confusing for me because it seems these rules/suggestions were not followed in my case. My wife was the abuser in our relationship. She pleaded guilty to domestic violence and abuse against me along with criminal damage to my property. When we separated though she denied me any contact with our daughter despite previously agreeing to a co parenting arrangement. So i take her to court, where the judge/cafcass all recommend that "although there is no concerns with you daughter being in your care we believe it would be harmful to damage the relationship between her and her mother"!

Please, can anybody give me some advice on what to do now, when the court and cafcass have clearly failed to follow these recommendations...
ANewLife 29/11/2017 at 12:39 am
Make your steps wisely and carefully. My abuser used mainly psychological and emotional abuse, he is very charming and manipulative. He used his public school boy background to support his "model citizen" behaviour. Behind closed doors the truth came out. However more people had seen the truth, including his own family and supported me and our child through the madness.

The courts however are under great strain with so many cases and it appears the time isn't there for these type of cases. My ex uses the courts to continue the abuse, using a regular pattern of time to make yet again another application to court. A lot of the cases don't link so the behaviour is not recognised. You usually don't get to see the same judge and you are lucky if they have the court notes in front of them, often mislaid. I've asked yet again for a section 91 (14) in the hope I can move on with my life with my child. Where there is psychological and emotional abuse more attention needs to be given to the detail and the pattern of behaviour needs to be observed by the court.

If you are reading this, please I cannot strongly advise you to get support around you. Get a good solicitor/barrister, my ex often self represented and out shone my first solicitor. You need a solicitor who can deal with domestic abuse, acknowledge the pathological behaviour and not fall into the traps. If you have lived with this type of abuser you know how you had to manage the behaviour living with it - it doesn't stop afterwards. You do get a peace of mind by not living in it 24/7 but your child will be living with it and will be punished. My child is made feel responsible for my ex's happiness and wellbeing, it's psychological warfare. I know she is being abused but because it is looked at as "inappropriate behaviour" there is nothing I can do but support her when she turns to me! Even when he stripped her of her clothes outside our home, first time all her clothes were removed, 2nd occasion she was left keep on her underpants as he had provided her with those ones - this was regarded as "inappropriate behaviour" rather than using our child as a tool to torcher me and in turn abuse our child.

This type of abuser can manipulate a court and other professionals. The system claims to be under pressure, but this is no excuse. There is no excuse for abuse. Yes a child should have the love from both parents but healthy love. Our child has to deny herself the right to see certain family members and friends because of the consequences, she is clever and is managing in her way. However, she suffers from anxiety due to the behaviour of her father, we are working on this but it is impossible with the abuse is like a continuous dripping tap.

Unless both parents agree you cannot get support for you child unless you get it ordered through the court. This is not an easy process as I've discovered. Again it depends on the judge you see, and they do vary greatly in their understanding of a

My partner has one DV charge against him by a partner from a previous relationship 7yrs ago. We are currently looking into regular contact with his child from a different relationship. He has a relationship with his son and was seeing him every fortnight up to us getting together 7 months ago. At this point he's ex as started to be difficult and is only letting him see his son approximately once a month. She also tries to get him to take her other child (Not my partners). If we were to go court would the DV stop him from seeing his son? What is the best way to get regular contact with his son? There is no DV in our relationship and none before or after the last case.

I have a 3 year old daughter. My ex partner and I separated before she was born. Her father has never seen her although we are currently in the middle of a court case. He always said he never wanted anything to do with his daughter even his family don’t bother and I tried to initiate access once she was born but he showed no interest. He has been both psychologically and physically abusive towards me when we were together. He kicked me in the stomach whilst I was pregnant and it was after this act of violence I ended the relationship I never reported it nor did I see anybody to check my baby was ok. I was terrified if I told officials that my baby would be taken away from me. I wasn’t thinking straight I was at a very low point. I’d had 12 months of emotional abuse from this person we had split and got back together numerous times I honestly don’t know why I kept going back into a relationship with him but he was very controlling. He also had used drugs in the past which made him paranoid he has an issue with alcohol too. I believe he is an alcoholic. He harassed me for months and the police were involved. When our daughter was a year old he applied to court for a child arrangements order. The reason he did this was because he had found out I was in a new relationship the harassment got worse and throughout the court cases he has posted numerous things on social media trying to whip up a hate campaign. I have passed screenshots onto cafcass and he has been told it’s contempt of court yet he has since posted something abusive again. I have numerous text messages from him being threatening towards myself and my new partner. He has applied previously for a child arrangements order and he dropped his application when the court ordered he had a drugs & alcohol test. They also wanted to do a fact finding hearing regarding domestic violence allegations made by myself. After the hearing where he said he would withdraw it the court ordered I send him photo updates every quarter. I advised I needed an email address as I kept no contact details for him and had changed my numbers etc following the harassment. It took him a year to provide an email address and even then it wasn’t his it was another mans whom I didn’t know so I refused to send any photographs until he sent me an email address for himself. He’s now had 3 updates and because he has a way of contacting me he has sent a couple of harassing messages which I have ignored. Next he applied for parental responsibility which cafcass advised him he wouldn’t get as he had no relationship with his child so he has now applied for a child arrangements order. I have a number of concerns, if the court grants him access will this be in a contact centre as I want no contact with him whatsoever? My daughter is 3 it will be very distressing for her to be in a room with strangers. I do not know of anybody that would want to be in a room with him either. He has previously said that he will turn her against me and I

Mediation is really the key here, if they cannot agree between themselves as a family. Mediation takes place in front of a neutral third party. The mediator has no pre-conceptions and will not force your cousin and her ex to make an agreement. They will assist the two parties in taking turns in the conversation, and help them to reach a decision they are ready to agree with. Mediators do not pass judgment or offer guidance; they are there, in effect, to facilitate conversation between the two sides. Mediation is an agreement made pre-court, so if an agreement cannot be reached then one parent may wish to take the matter to court. In which case the court would decide what it thinks is in the children's best interests.

My cousin has got 5 kids the oldest being 17 and the youngest 3. My cousin and the partner are considering a divorce as they’re no longer happy. But they’re worried about custody of the kids. The father is violent and has got a minor violent past and is known to be quite patronising and the mother has had an affair about 5 years ago. the children have witnessed the violence and know about the affair. the mother has also been violent at times but they’ve realised that it’s no longer okay and are now separated but they are worried about going to court as they don’t want to loose their kids. The kids were not happy with their parents relationship but there seems to be a divide between the 4 older siblings. The siblings consist of 2 older sisters and then 3 brothers and the boys seem to be on the fathers side where as the girls are neutral (the youngest is 3 so he’s not really got a side) I just wanted to know what advice you would give to my cousin and whether or not you think they would be able to get split custody or sole custody of one of the parents?

If you are attending mediation, then it's aim is to attempt to resolve problems before the matter reaches court. Mediation, is a formal negotiation and courts can accept the agreement of the mediation instead of having to go through the court process, although it is subject to final court approval. The mediator has no pre-conceptions and will not force you to make an agreement. They will assist the two parties in taking turns in the conversation, and helping you reach a decision that you are ready to agree with. Mediators do not pass judgment or offer guidance; they are there, in effect, to facilitate conversation between the two sides. Therefore, you do not have to agree on anything you do not feel is in your children's best interests. If you fear your ex may try to take the children back to London without your consent, or keep them and not bring them back (if you agree to unsupervised access) then you would have to apply for a 'child arrangement order', which will determine with who the children should live on a permanent basis. You may wish to bring this up in mediation as part of the access agreement.

ive been divorced 7 years now and still having problems with ex using the children to upset me. Always used the oldest for scheduling parenting time and refusing to talk to me about it. and it was against the parenting time order. He is 18 now but the ex has been doing this since he was 10. Now my son has behavior issues. an verbally lashes out at me all the time. all be cause he was made the boss. if the ex talked to me he would call me names. And the kids knew it. the courts just ordered all of us to seek family counsiling for all of us and if he doesnt show up he will not be able to take the kids overnite. he never did show up. and calls to see the kids when ever he feels like it. He had called cps 3 times since the divorce and managed joint custody. he tells the kids they can go to the neighbors but not moms house. when it was his parenting time. he would call me vulger names. The courts ordered parenting time be communicated through emails only not by phone. And he still doesnt abide by that either. Why doesnt the courts step it and stop the chaos. The kids were interviewed an told everything too. They witnessed father abusing the girlfriend too. Can he go to jail for this? Isnt this emotional abuse on a child? i need answers. When i was married. he said he was going to kill all of us. the courts know everything and he was convicted of domestic violence... why not attempted murder. (my shift key doesnt work great thats why sentences start with lower case letters.) sorry

I have 2 sons, one under 3 the other 5 years old.
My partner has become progressively more verbally abusive over the last 2 years.
He is now smacking the children at least twice a week for issues like dropping yogurt on the floor and putting bubble bath in the bath when he told the 5 year old not to in those 2 instances it was around the head.
Recently he smacked the 2.5 year old child on the leg because he wriggled when having his nappy changed. I heard the nose of the smack in another room. It left a red mark which faded before I had an opportunity to photo it.
He has become quite violent with me shaking me and threatening to punch my teeth out.
He is verbally abusive to me in front of the children and be-littles me all the time.
This week I moved away from him in London to my parents in Nottingham with the children for our wellbeing. I am starting a new job in Nottingham and have organised a new school for them.
He is saying I should not have taken them and wants them to go back to London and denies everything telling the 5 year old that it was my entire fault for borrowing his things meaning the washing machine and household goods.
We have arranged mediation for next week which he has agreed.
But he is demanding to see the children whenever he wants.
What should I do and can he take the children back to London.

We cannot predict what a court will decide. However, if your ex is seeing your child through a contact centre, much depends upon whether the judge at some point in the future makes an allowance for unsupervised contact. However, were supervised contact is recommended by Cafcass, then the court will generally adhere to Cafcass recommendations.
Rob Editor 16/10/2017 at 12:49 pm
@Sregor - The standard access is alternative weekends overnight one or two nights and contact one evening per week. The rest is debatable. Besides, he wont be able to apply directly to court, a court will want you to have gone through mediation first before it will allow you to apply.
Sregor 15/10/2017 at 7:01 am
My husband and i seperated in may after several years of physical and emotional abuse. On this occassion when i rang the police he threw himself down the stairs and said i pushed him. I have obtained a non-molestation order and an occupation order and it has been proved in court that he has physical harmed me and that he threw himself down the stairs and i didnt push him. He has been unwilling to financial support his child so i applied to CSA within days of them contacting him he applied to family court proposing a silly amount of contact which i feel he is only doing to reduce CSA payments. What is realistic contact? He current has him one day a week and i have stated he can have him over night alternate weekends but he wants friday to monday and then over night contact two weeknights half of all school holidays alternate christnas' and birthdays

Hi, just after a little more insight. I was involved in a domestic abuse n violence relationship, I would like to stress he never physically punched me, but would often trash the house and throw objects at me. I was locked in if he went out, wasn't allowed to wear certain clothes, the most gos on and finally when my daughter was born he took her from me as he had PR I was very fortunate to get her back and from their went into a refuge. Since then there has been numerous of court hearings etc and a finding of fact. The judge did find certain findings but I was slightly disappointing as not all were found even though all were true. The social worker has always been professional and has recommended that supervised contact is to take place and he has to do a Dvp course. We have a directions hearing next and believe this will be the last hearing possibly. And I'm worried that it will be a case that if he's on this course he will be allowed un supervised contact?
LizU Editor 28/09/2017 at 12:53 pm
@Stayray - if social services have been involved before then they may be again - it depends on why they were involved and whether they feel your child needs safeguarding. Do you really want a child to someone who has five different kids, to five different women and with a history of violence (I'm sure they're not all making it up)? Be careful, it won't be an easy life for you if you do. Plus, if you separate how will you get any child maintenance when he has five other kids to support? Think hard - it's not easy in this day and age to bring a child up, and it'll be more difficult if you're off to a shaky start.
Stayray 26/09/2017 at 4:52 pm
My boyfriend is alot older than me 13yrs. He has 5 kids to 5 different women and recently just got an injuction against him from his ex. She's not the only one that has one against him. I'm guessing this is why he's not allowed to see his kids. They have said for him to be a violent man. Anyway I've just found out I'm pregnant and just wondering if I do keep this baby what will it mean for me and the child? Will I have social services involved before its even born? ?

Please help!

If you cannot resolve this issue with your ex directly, or via mediation, 'Clare’s law’ allows parents to get information about anyone who has unsupervised access to their children under the domestic violence disclosure scheme. Parents can find out if the person has any previous convictions for DV as long as they use this information responsibly. It can be difficult when your partner starts dating again introduces a stranger into the lives of your children. It is a role that you do not want to be taken lightly and it is natural to be suspicious. You would also hope that your ex would not put your child in a potentially harmful situation. While you have to accept that she is moving and is free to make her own judgements about her boyfriend’s suitability, it is also fair to be concerned about your daughters’ safety. However, you need to be careful in the way that you approach this. You do not want to alienate your ex or cause any bad feeling between the two of you. Ideally, you should talk to your ex about your concerns, explaining that you are not judging her choice of partner but purely protecting your children. Try to discuss the possibility of doing a background check together so that she does not feel that you have gone behind her back. The best thing is to keep a close eye on your daughter to ensure there is no change in her general demeanour. Plus, keep a close eye on the situation. If an incident occurs, if you have parental responsibility you have the right to keep your child with you and out of harm's way. However, I would advise you seek legal guidance first in order to explore your options here as keeping your child against the other parent's wishes is never a good idea as it can backfire.

Hi wondering if you can give me some advice. I split with my partners mother about a year ago , her new bf has beaten her up on several occasions and on one the police were notified but she got back with him and presumed her relationship, I am highly concerned for my daughters welfare , she is 3 I am we father and in the birth certificate and have no history of violence or any criminal activitys , can I do anything about this as I feel helpless lawfully ?

Thank you in advance

Your partner has the right to restrict access if she thinks it is in her child's best interests. Her ex husband would then have the option to take the matter to court. However, if he has been previously charged with child neglect and DV, then it is highly unlikely the courts would offer him any unsupervised access, if any access at all. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.

What happens when you as a father are attacked by the mother and when you contact the police they brush it under the carpet on three separate occasions but when the mother puts in a false allegation of assault the police are suddenly interested and your word as black man vs a white woman means nothing? and your solicitor tells you to plead guilty as you being black you would not stand a chance with the truth vs a white woman ! so this has lead to a 5 year injunction order and i have not seen my kids for 3 years! the fake mother dodges family court hearings for me to see my children, some women use this to their own advantage to prevent dads seeing their kids .
ChildSupportLaws Editor 18/09/2017 at 1:45 pm
The most important thing the court will decide upon is the needs of your child. This is seen as the first and foremost priority when making any decision regarding an order. If you are unhappy about the report, it is important that you let the court know about your concerns.

@chucky - It's a police warning - if your b/f is seen near your house - then your b/f can be arrested.

The father of my child has recently been sentenced to 10 years in prison for 2 things he did to me. There is a restraining order in place stating he cannot contact me or be around my house/ work. He was abusive to me but not to the child at any point. Our child is 1 and his family are in touch. If he is requesting to see her am I allowed to take my child to see him in prison? I do not feel comfortable with anyone else taking her to visit him. ( the visits would not be regular)

You can withdraw access from your ex. However, if you will not consent to mediation then he will be able to apply to court. If you fear your ex may take your children out of the area without your consent, then you can apply through court for a Prohibited Steps Order. A PSO, is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.

Hello I have a few questions but first I'll state what has happened.
My ex the father of my 1 1/2 year old son has always been controlling a lazy parent nit paying much attention to his son and only pays alot of attention to him when his parents are down to visit. His always had a drinking problem and has continually been abusive towards me using words and threatening me with social services accusing me of being a terrible mother yet I do everything for our son. He was drinking and he smashed up my house and dragged me around my sons bedroom by my hair whilst our son was in my arms and smacked me in the face a few time the police were called and he is being charged for criminal damage but not for the assault against me as I didn't write a statement as everything happened so fast but a family member did. Now I was wondering if there is a way to only let him see his son under supervision? If I could stop him having him overnight as he has money idea how to get him to sleep or what he eat? And as his threatened to take my son and go to Scotland where his family live if there was a way I could stop him from taking our son out of England? I any help would be much lying appreciated as I'm at my wits end!
ChildSupportLaws Editor 31/08/2017 at 3:12 pm
If your ex is not demanding contact with your/his daughter, then you are within your rights to refuse contact if he requests it again. His option would be to then apply to court. If there is a court contact order already in place, the court would either enforce the order or not. Likewise if there is no order in place, the court would decide what it thinks is in the best interests of your child. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.

I have just left the family home with my two children after years of verbal abuse and recent incidents of physical aggression (leaving no marks) frequently infront of the children.
1st q: they ask not to be alone with him as they are frightened of him (they are 6 and 9yrs) I feel his behaviour is volatile when around them and he frequently criticised them and shouts at them even when I'm not with them. I don't have much evidence other than what I'm hoping to gather from a couple of people that he has been verbally offensive to when the kids were with him so they witnessed it. How likely is it that a court will stipulate supervised access? Obviously I'm concerned that the court will go with unsupervised access and fear for their well-being.

2nd question: he is insisting that I allow them contact with him now and that I return them to his care in the family home. I am terrified that I will be made to do this (by lawyers/police?) even before it goes to court... can this happen?

3rd question: I've been told by social workers that I mustn't allow him to speak to the children on the phone as he could manipulate them and upset them. Am I within my right May to do this while we are waiting for legal decisions?

Last question: I've been told by solicitors that it is illegal for me to change their school but I've also been told by social workers that it will be seen as negligent of me not to change their school as in their current school he has rights to collect them and take them into his care: thereby I would be allowing a dangerous risk seeing as I have concerns of his fitness to care for them without supervision.. what is the right thing to do??? I don't want to do anything illegal but at the same time I need to do everything possible to safegaurd their well-being.

Hi

My husband is current on bail and charged with abuse and resisting arrest whilst our 5 (2 mine and 3 his) children were present. He has never been physically violent with me or the children just verbally abusive when he had too much to drink. He is an alcoholic and is due to be admitted into rehab in the next few days. My problem is that due to the bail charges I am unable to contact him and it is breaking my heart - I love my husband and all I want is for him to get sober and come home - any advice is greatly received.

Where DV is concerned, any reports or orders that have been issued as a result will mean that Cafcass will get involved. A Cafcass reporter will interview both parents in the case, as well as the children, and any others who might be needed, which could mean social workers, medical professionals, or even relatives. From the interviews Cafcass conduct, the reporter will determine two things: whether there should be contact allowed, and, if so, how much. It’s a measure of how important the Cafcass recommendation is that the court will almost invariably adhere to it. Of course, they’ll also want to interview any children involved, as long as they’re old enough. Part of the responsibility of the court is to take the wishes of the children into account where possible, although that doesn’t mean that will necessarily happen. The court will first and foremost always decide upon what it thinks is in your children's best interests.

Unfortunately, in incidences such as this, if both parents have Parental Responsibility then the police cannot intervene to take the child off one parent and give them back to the other. The police cannot choose between parents, that is the remit of the courts. We cannot predict what a court may decide, except to say it will make a decision based upon what it thinks is in the best interests of the children.

Hello there, just looking for some advice. My children's father, let's call him N, split up 6 years ago. We were not married but he is on our two children's birth certificates. They are 7 and almost 9.
Two months ago I moved in with my partner J. He has a daughter who is 6 and she was here the same weekend as my two (they are with their dad every other weekend but that was not arranged through court and he pays maintainence calculated through the CSA based on this arrangement.
Ten days ago J and I had an argument and the police were called by me. He had shoved me but not hit me and he was taken by the police and came back a few hours later. No further action was taken and after social services spoke to both me and his daughters mum they are satisfied that no one is at risk. The kids went to their dads at the time of the incident and I have only been allowed to see them twice since. We have agreed I will move out am I am looking for somewhere. Since then N and his parents have been extremely obstructive in allowing me to see the children and have been poisoning them against me and he is now refusing to confirm when they will be allowed to come back and live with me. I have always been resident parent, they are registered at school at this address, he pays maintenance based on our own custody agreement and he is refusing to let them return to this address or let me know when I can have them back - he will not confirm once I have a new property that is when they can live with me again. Basically no external agency is concerned about my or my children's welfare and I have taken all the steps they and my family have asked but I am not getting much help from them and if I were to bring them back to this house and J stays with his parents does their father have any right to take me to court over it? I am entitled to legal aid due to a MARAC letter from a charity I've been in touch with and I am not saying I won't move out (even if I didn't police and SS have no concerns) but I cannot be kept away from my children any more, my son is very upset and when I speak to them on the phone it is clear they feel unable to tell me anything as their dad is listening and monitoring when I call them. He said he had a sore throat but when I asked him yes or no questions he said he misses me and wants to come back or at least be able to see me. This has been going on for ten days now and I am starting to take legal advice tomorrow and am "allowed" to see my children on Tuesday. I would like some advice on the possible action he could take if I bring them back to our usual permanent address based on the facts that they are not even at risk, I have a child protection officer who is a friend and she has said he would be laughed out of the door taking me to court because of the fact myself and J had an argument! Thanks in advance.
ChildSupportLaws Editor 28/07/2017 at 10:02 am
He will be allowed to seek legal advice. However, if you were hospitalised as a result and received serious injuries, Cafcass would conduct an investigation into this. In cases of proved domestic violence, the court had to weigh the seriousness of the domestic violence, the risks involved and the impact on the child. If you have proven domestic violence and injuries, then this will seriously impact on any decision made by the court.

My babys father became abusive shortly after our little one was born. He was physically abusive on lots of occasions. The last time i was hospitalized with very serious injuries that needed surgery. He was convicted of Gbh and is currently serving a prison sentance for this. On release i am concerned he will want visitation, which i am not happy to agree to over safety for me and my spouse. Because of his conviction will he be even aloud to apply or seek legal advice to have contact. ? Im so worried I've been through so much already.

Hi
I have issues with my daughters dad, he has been emotionally abusive to me for a long as I can remember, whether or not its been down to something as little as wearing a certain top or makeup or wishing I died in labour or throwing a plate at me when I was pregnant.
Since splitting up I have accepted that he has moved on with another lovely girl, however now I am 'dating' someone the abuse has returned. He is saying things like he 'hopes I die', 'hopes i get raped' threatening to 'smash' the guy I am datings 'head-in'.
I feel trapped, I worry he will try and take my daughter away - not return her after his weekend. I don't know where I stand, I don't know what to do.
Please can you give me some advice on this? I feel so trappped by the situation - like there is no way out.

My daughter has been beaten up by her boyfriend can I report him to the police will they do something about it even if my daughter won't

We cannot advise whether you should allow the father to meet your child, the decision is yours. If you wish to negotiate and come to a firm agreement on how access/contact should take place, then you may wish to suggest mediation to your child's father. You can see more via which

I was in a relationship with an abusive man (when drunk only)for about 5yrs-5yrs ago, our son who is 5,has never met him but asking questions. I've recently asked around to check the dad's state and got in contact. They both are so in love from a phn call conversation and want to meet. My mum said the family wouldn't talk to me again..where do I go from here

Hi. I suffered domestic violence in the early 80s by my ex husband. Back then it was not taken seriously by the police. I told no one during the 11 months I was married. It has affected me and my relationships ever since. I am approaching my 60th birthday and feel more than ever I need justice. Just to know someone of authority knocked on his door for answers.
Is it too late.

@Dee - remember Dee, it's his child too. Does he love his child and care for her? He may be angry to you, but most dads love their kids and will naturally try to protect them from any harm. It's only natural he wants to see his kid and if you're getting in the way of that, this may be where the abuse stems from. I'm not taking his side - but try to see it from his perspective. Two nights a month contact isn't much and really he has as much right to see his daughter as you. Hann.

Hi my ex has ptsd and we split due to abusive behaviour (mainly emotional and verbal but also spat in my face and threatened violence in front of my daughter but he never actually hit me). He has contact once a fortnight and for 3 years has often sent me abusive texts (name calling, insults, etc) whilst he has my daughter. Having seen for years how he struggled to contain anger (throwing heavy objects, lots of near misses) I worry when I know she is with him and he is angry enough to start texting me. He drinks but holds down a good job so I'm not sure he has a drink problem but on occasion when she has FaceTimed me he has red wine on the go at teatime. We have a contact order in place but when he starts abusing me I get very anxious that he may harm my daughter. I don't respond to his texts on the premise that I don't want to wind him up more and I wouldn't be able to get the text right so no response is best. After 3 years of this I'm at my wits end. My imagination goes overtime and I worry that (now the finances and divorce are sorted) his hate towards me can only be channelled at the one thing he knows is my life (my child) I feel if I go to my solicitor or the police they may think I'm being neurotic as he has never hurt her nor has she said he's been angry or threatened violence around her (she is very smart for her age and very vocal she says daddy is a bully and a liar even though I keep my opinions to myself) but on nights like this I don't sleep as the worry takes over. He's very bitter about me leaving and ending his abuse towards me. I know he is probably doing it to spoil my child free time even though other than the 2 nights a month he has her my life revolves 100% around my daughter. Any advice or reassurance would be appreciated I feel like I'm going mad!

I have put my issue to you today Friday 9th June at 12.31 but am unsure wether I gave my email, as I've had no notification.
I thought better I send it again and refute to my query rather than type it out and post it a second time.

Kind regards

My marriage came to an end three years ago when I started a relationship with another man behind my husbands back. My ex husband moved out and moved to a different area, and my new partner moved in to my house to live with me.
My ex husband and I have young children, and he has access to them at the weekends.
At start, agreeing to the amounts of custody we both had over the children was an issue and one we couldn't resolve.
Because of this my ex husband decided to apply to the courts for full custody of our children.

In the mean time I fell pregnant and gave birth to my partners and my first child together, and now will soon be giving birth to our second.
My new relationship has been a rocky one at times, mainly due to the amount of stress we get from my ex husband. Clearly his nose is still out of joint and he is hell bent on repenting, because by now he clearly hates me for what I did.
Things got particularly stressful a few months back, due to the stress of this custody battle and loosing my employment, which ended up in a huge row between my partner and myself which became a case of domestic violence.
My partner lost his temper and ended up hurting me, something he had never done before and has not done since.
However the cps took my partner to court on the charges of domestic violence, one which he held his hands up and pleaded guilty for. My partner narrowly escaped a prison sentence as I had hoped he would, he had never been violent to me in the past and this is what I told the judge in my letter defending him at the time.

Because of what happened between us at that time, my ex husband then chose to use it against us in his fight towards full custody of our children.
Because our children were present at home when the domestic violence occurred (but did not whiteness with their eyes and ears) we now have social services on our backs telling us we must do this and must do that and that I could loose my children.
Social services also said that my partner had to leave until this custody battle was over, he could only return on their say so, and if they say so.
We have stuck to the instructions that have been given to us, attended all appointments, and done what is expected of us listed down on my child arrangement order that was issued by the court.
My partner has not been living here with me and our child for months now, this I feel is totally not fare at all. I want him home, he wants to come home, and our child misses him terribly. I need him here, I am pregnant with our child and need him home supporting me.
During these meetings with child services there has been talk clearly indicating that things are in my ex husbands favour. It feels like it is all rather one sided with them more 'on his side' favouring him against me and my partner. I feel like I am about to loose my children at any moment and can barely sleep or eat with worry. Last week I was presented with a section 8, Child arrangement and prohibit

Hello,

I was in a controlling relationship for 4 years.
My many attempts to terminate the relationship always failed, she would always sit in front the door to prevent me from leaving the apartment, after moving out she should repeatedly drive from east to west London, Park in front my residence and refuse to leave While begging me to come back home. After many attempts she managed to get me to move back in (foolish of me). I left my job in west London at her request to find work closer to her place in east London. I was out of a job, little money and no savings. She started begging for a baby. I continuously refused and make it clear that I can't afford to have a baby and that the relationship was not good between us. My many attempts failed and she went off the pill to get pregnant. After the baby was born the arguments started again only this time she didn't mind me leaving so I left. I have parental responsibility and our son has my last name. I was completely cut off from our son, was not allowed to see him and not allowed to visit at day care. I called her father for help in resolving these problems but instead he insulted and made threats towards me. I contacted a lawyer who arranged mediation, she never showed up and made excuses. The matter went to court where she then made very serious false accusations about emotional abuse. She even questioned my legal stay in the UK. It is now clear to me that she will stop at nothing to punish me and keep me away from our son. I habe lots of image and video proof that I was a good father to our son. She is a very talented actress and I'm in fear of never being able to see our son again. There are many more disturbing facts that I did not mention . Can someone please help? I have spent over 7000£ in legal fees do far and I feel like this is going nowhere. We live in a society where people usually believe the woman. I'm in fear that no o e will believe me.

I'm worried for my daughter she is 3 years old. Me and my wife have had a very turbulant relationship, over the 5 years of marriage plus about 6 years (on an off mostly on) before it I feel shes been mentally abuse to me in many ways, and also physically on numerous occasions, I have evidence of some occasions and once was reported to my Dr. he measured and recorded all my bruises. Its not just with me, both of her other children now in there 20's were previously taken from her by social services, she actually put her boy in hospital when he was about 7 or 8 I think, despite her efforts they don't want to know her again in there lives, one having been adopted the other was in and out of mental institutions for year under section. I obviously thought she had changed when I had a child with her) My wife has never accepted responsability for anything that she's done, from everything in her past right up to me when I've been literally black and blue from her, but even thats been my fault, normally followed up by "it was because you laid into me" which I have never done, not that it makes any difference I'm 6'plus tall and 16 stone so if I had of even, then how come it was only ever me that was black and blue. The amount of control there has been from everything from my finances to friends (I have but 2 literally now from being in this situation for years) has been I think very bad, I was only seeing it towards the end and now. Now she's started going back on things shes said about custody of my girl, and to be honest I do not trust her to bring up my child. it will only take her to have a bad day, or get fed up and anything could happen. She already gets me angry by slapping and screaming at my kid, even tho social services have told her her when she was born that it wasnt acceptable under any circumstance. It always be the kids fault though and then go on to being my fault either cause I've not done it or cause I wasnt doing whatever it was she was doing or trying to do at the time.. Obviously I have to do something I just don't know what to do, I'm worried that if I do anything at all it will result in me losing what contact I do have, and I guess theres something been built into me now that makes me not want to upset her. I also worry that she will say anything she can to get out of any trouble including, and foremost making anything up about me to counter that, as said she already claims I've "laid into her". Any advice what I should do?

Hi I have a question,
So I was hit at the weekend by my mother after a heated arguement, my son was at a family members house at the time, I spoke to a friend about this and she has said that if my son has contact with mother then he will phone social services as it is a sign I am neglecting my child as my mother looks after him, where do I stand on this?
ChildSupportLaws Editor 10/05/2017 at 12:46 pm
If your daughter's ex continues to refuse to return the child, where both parents have Parental Responsibility and one parent is keeping the children against the other's wishes, the police CANNOT help, even if the children do not normally live with them. If the parent does not have Parental Responsibility, the police will be able to intervene. They are also able to intervene and remove a child if there is a possible risk to life. If you are concerned about a real and immediate threat to your grandson's safety, speak to your local police force and social services. Otherwise, I'm afraid your daughter will have to apply to court. If this is the case, I suggest you seek legal advice asap in order to apply for a interim contact order and a child arrangement order, as taking the matter to court will take time. I hope the situation manages to resolve itself without having to go to these lengths.

Hi i'm worried about my grandson, his father has been mentally and physically abusive to my daughter, the relationship has ended because of this and each time he has turned up to see his son he has trashed flat and been verbally abusive, my daughter told him as this has happened she would not let him see their now 15 week old baby alone or overnight.
Well this past weekend he constantly went on at her to have the child and wouldn't let up she gave in out of fear and stupidity now he is refusing to bring him back saying falsely that she is neglecting him. How can she get him back and then get a court order put in place that he can only see him in a contact centre as we can't be sure he won't do it again?
ChildSupportLaws Editor 08/05/2017 at 1:53 pm
We cannot anticipate whether he may be granted access or not. The court will always rule on what it thinks is in your child's best interests. If the father is not in your son's life currently, then the court may begin with supervised access. However, it is impossible to predict.
Zach02 08/05/2017 at 8:35 am
It is sadly true that false allegations of abuse made by many mothers are taken seriously by the courts without any foundation or investigation
CAFCASS as an organisation is not fit for purpose and the father is at an immediate disadvantage.
It is also a falsity to think family Courts take failure to comply with court orders seriously
We as a country are decades behind the developed world in our care of children in the midst of acrimonious divorces

My ex partner was abusive towards me. Physically (on a few occasions), mentally and verbally. I now have a restraining order on him. We have a son together who is over 1 year old. I am now wondering if he goes to court if he will get access or not. I am very worried about this. Not only because he abused me but he has no idea how to bring up a child. He's been in and out of my sons life since the day he was born and he didn't see him for 6 months. I am worrying that if he goes to court that he is going to get acess
SAE&* Editor 25/04/2017 at 2:14 pm
@Vonnie - the court sees it that many people take drugs such as cannabis and cocaine recreationally. Our world is not perfect. there are alcoholic and drug addict parents that are still allowed to parent their children. Unless the children are neglected or abused it is seen you can still parent your kids :( Sam

I would like to ask a question please regarding my daughters ex husband he left the family home last summer after ststungnan affair with a close family friend. After him deciding to not see kids for 5mnths took it to court he admitted to smoking cannabis for over 20 yrs on.a daily basis he was given four weeks contact with kids with my daughter present moving onto 4 weeks of 10-4 contact them after that every alternative weekends Friday to.Sunday my daughter told her solicitor that her concerns regarding the cannabis and cocaine habit he had. The judge said he had to undertake not to take drugs 24 hours before he had contact with children or when he had them but confined his habit any other time doing this. As far as I'm concerned drug taking Illegal in any form.nothing was put in.place to.check if father had been taking drugs.can anyone tell me if I'm missing anything please

I have a 4 year old boy and I split from his violent, drug abusing father months after he was born. Social services had been involved during my pregnancy as helix behaviour was disgusting and I'd had to contact police. I was bullied into letting him have my son who, at the time was only months old, stay a couple of nights during the week. He'd come back with a full unchanged nappy and dirty. Then my ex decided it was too much hassle and got in the way of his social life. One day he refused to hand my son back so family had to collect him, I stopped his contact for 5 weeks. I had a non molestation order to be carried out against him but my family thought it'd make things worse so I didn't go ahead. I then let him have contact at my dad's house twice a week. He applied to court for full custody, however he was only granted supervised access 3 times a week due to his violence, drug use and mental state. He was ordered to complete 2 courses a DVPP course and a family welfare course. He also had to complete a hair or blood drugs test. He did not complete the group course as asked because he wasn't accepted onto it. He did a few 1-1 sessions. My dad kept the supervision going, however, my ex pushed for it to be at his property and against my will my dad did as he wanted. This xmas just gone, my dad, who's been manipulated by my ex, kept telling me my ex had changed and he was sorting his life out etc so maybe I should consider letting him try unsupervised. I met with my ex to discuss it, he seemed smart, friendly and realistic about how we could go forward. However, he's reverted back to his old ways and has been extremely abusive, my son is coming home telling me his daddy said he should hit and slap me, that I wasn't going to be around for long and he was going to live with daddy. It breaks my heart and I feel so stupid that I was duped and pushed into this desicion again. I've gone against the court order knowing that he'd not completed the courses. I've contacted the police his week as I'm getting hounded daily with messages about new boyfriends etc, I've not had any sort of relationship since him, I've bee too busy looking after my child and trying to bring him up right. I also spoke to my solicitor, she's disappointed by my families poor judgement and said if we go back to court they might grant him more access because 'at one point I must have seen him as a threat anymore'. I don't know what to do.

My partner took a overdose in January an nearly died. Her daughter was put in temporary care of the child's dad. However the strain of the overdose took its toll. I told my partner that I couldn't be with her anymore as everything had got to much. So my partner went to the social services an said that I was abusive verbally (I'm not I don't call names or get aggressive ) her an her daughter was put in a refuge. However my partner wants to come home and I want her to. Will the social services take her daughter? My step daughter away?
ChildSupportLaws Editor 29/03/2017 at 2:30 pm
If you refuse your ex access to your child, you can either consider mediation in order to try to resolve the issue between you, or your ex will have the option to apply through court. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. Before the matter goes to court, there is a chance Cafcass will get involved and conduct a report. It’s their job to interview both parents in the case and any others who might be needed, which could mean social workers, medical professionals, or even relatives. From the interviews they conduct, the reporter will determine two things: whether there should be contact allowed, and, if so, how much. It’s a measure of how important the Cafcass recommendation is that the court will almost invariably adhere to it.

Hi I have a 7 month old to my ex, during our 6 year on and off again relationship he was aggressive and abusive. He threw objects at me in temper. Grabbed my arms on several occasions while screaming in my face and has pushed me into a wall. He would fly off into a temper at the least annoyance. He's called me horrible things. Tried to isolate me from my friends. When I fell pregnant he argued with me flat out for weeks and then buried himself in work for a few months. When he made a reappearance he ignored any discussion to do with the baby. However I set up contact at a relatives house, but he is now asking to take the child on his own. Is there any chance that a court would rule in favour of supervised visitation? I don't want to stop him seeing his baby but I'm extremely worried about child's safety.
wilmur 24/03/2017 at 9:44 pm
I need advice on what to do. A lady I know has just had a baby and she was allowed to bring her baby home on the condition that her partner only sees his baby in a contact centre. The two of them are violent and I don't know why she was allowed to bring the baby home because she is worse than him but she is a devious liar and is portrayed as the helpless victim but she is not..

Anyway she is still seeing her partner and allowing her partner to see the baby with her all the time and in no contact centre..

I am worried about the baby and I don't know what to do next

Hi , I am so frustrated with Family Law . You would think that they wouldn't allow a child to be put at risk.My grand daughter who was 3 at the time disclosed to her mum her sister and her reception teachers that her dad had abused her . Ovi she didn't say those words she said things he had done but not in any real detail , my daughter stopped contact as he had an order that allowed overnight stays. Police said not enough evidence to charge or interview him , social services, cafcas recommended no contact as children were on a child protection homicide order ,because there had been domestic violence previously in relatioship , sweet project got involved to speak to my grand daughter through social services who she told her dad had touched her in her private area . So since February 2016 my daughter gas been fighting his access to contact as he put in to court she had breached original court order not stating the reason why anyhow through the last year there has been many court appearances and child protection meeting which resulted in my daughter and grand daughters having to move 30 miles away from her family and legally change her name so he didn't know where they lived . In January 2017 they was a fact finding hearing which he denied all allegations puttin it down to my daughter jealousy over a new relationship he was in , the judge dismissed all claims from my grand daughter and agreed that my daughter had instigated her into making allegations , and tgat contact would be given to him . This is jus devastating to us as we deal with the emotional effects it has had on her , and how real this is to us , she is nearly 5 now and constantly talks about her hate of her dad because he hurts her and she never wants to see him again . So you can imagine the upset this has brought to my daughter , social services have said there hands are tied because judge has made her ruling , judge said if my daughter didn't comply with order she would consider residency change . We were in court yesterday and there was a new disclosure brought to the judges attention from her new school she had disclosed a new allegation that we had never heard before and also stated how scared she was of her dad she was . You would think that this was enough of concern to limit contact if any had to be given , well the judge ordered a contact centre for 2 -4 hours that is not supervised for 3 visits then we go back to court on April 11th to take contact to next level , I just mind blown how this can be right and beneficial to my grand daughter who is already emotionally unbalanced at times as well nightmares .She was told to day she would be seeing him and she has become violent to her older sister and withdrawn . This has broken our hearts and totally disgusted with the Law system .
ChildSupportLaws Editor 27/02/2017 at 1:52 pm
You can rest in peace, as it is highly unlikely the court would award your ex an unsupervised contact order.

ChildSupportLaws Editor 22/02/2017 at 2:39 pm
Yes, if you feel your child needs safeguarding from your ex's wife. You can either apply for a Specific Issue Order through court. Specific Issue Orders, much like the name suggests, are orders sought from the family court to determine a particular matter in connection with the exercise of Parental Responsibility. These orders can cover a wide range of issues that you and your ex-partner cannot agree on, such as preventing someone from having contact with your child. Another option would be to stop access directly, but this would give your ex an opportunity to take the matter to court. You may wish to seek legal advice here in order to explore your options.

I have just found out that social services were involved with my child a few years ago because ofnthe domestic violence happening in her fathers home. His wife was the aggressive one. I was never told or contacted by SS. i am the only one with parental responsibility so i cant understand why i was never contacted.

Anyway, he and the wife split within a year of being married and she moved abroad. But ive just been told shes coming back and they are going to try again. Im obviously very concerned about this. Is there any way i can stop her having any contact with my child? Am i legally aloud? Or what can i do to protect my child? Thanks

Your friend would have to seek legal advice regarding applying to access when there is an injunction hanging over him, as much will depend on the nature of the injunction.

When I met my ex partner I wasn't aware that he had previously been arrested for abh against his little girls mother. He moved in with me and my son who was 3 at the time. It was clear he was very jealous of my son and would continually torment him. He also dragged him from his bed, hung
Him upside down by his legs, called him names, held him under the shower and petrified him.
He also used to hit me and say it my fault I had made him angry. He had worn me
Down so much that I believed
Him. I was pregnant by this time and unsure what to do so I stayed with him. He used to hit me whilst I was pregnant. Take my phone and go through my messages to make sure I hadn't told any body what he was like.
Last year he hit my shortly after my baby was born and he was arrested. I didn't press charges as I was petrified of him and his family. He is an alcholic and known to social services for the attack on his previous partner and myself. I have refused contact with the baby as I don't trust him to care
For him and know he will more than likely be violent around him. If he were to take to me court contact do you think this would be granted being as he has attacked two women in front of their children and hurt my other son?
Thank you.

I've been split up from my ex parent for 3 years now and I'm still getting dv with him it's emotional and mental no physical. But he has smashed my TV up in front of my children abused me in front of my children he doesn't bother with our son as he's to busy smoking weed and sniffing cociane... he's with someone who he also abuses but I can't comment on that because she won't open up to anyone... I'm taking him to court for access with our son but he's trying to say now that the court will allow our 3 year old son to go to florida with his grandparents for 2 weeks with neither parent... his grandparents see our son once a month if that I really need some reassuring that this won't happen because God forbid of anything happened how can I get to my son I'm a single parent with 2 other children

My little girls father is in an abusive relationship with a woman he has been with for 14 yeara.....he is treated like dirt, emotionally abused, assaulted, has his belongings smashed etc and all in front of his 6 year old.

Our daughter is the result of an affair we had (don't judge please) and since it all came to light, his partner is worse than ever with him. She has also been texting me abusive messages.

He is asking to start taking our daughter home and I am extremely uncomfortable with this, given how I know his partner behaves. I genuinely believe my daughter would be at risk and I believe the only reason he is asking to take her home is because his partner is demanding it for control purposes, so she knows exactly where he is and that he isn't with me etc.

What can I do?! I don't want to put my daughter at risk but I want her to spend time with her Dad.....Thanks.

The court will always decide what it thinks is in the best interests of your son. I highly doubt the courts will allow unsupervised overnight contact if he is considered high risk, especially if you voice your owns concerns with Cafcass.
Worried 16/12/2016 at 6:55 am
My sons father was charged with common assault b battery against his wife. This was only because she were fused to give further evidence and withdrew her statement. Social services informed me of the incident calling it a 'frenzied attack'. His wife was left with injuries to her head, face, legs arms and chest and her initial statement stated that he strangled her until she passed out. She now disputes this . The referral to social care came through stating he was high risk. I made the decision to only allow supervised contact which I have been supervising , however my plan is that this will progress to be supervised by his mother. I have had concerns re my ex for many years, albeit none that would justify in court me stopping contact, so instead I have worked hard to make contact ok for my son. He has therefore had unsupervised contact on alternate weekends prior to this. I have challenged the concerns with my ex which amount to low level neglect and at times emotional abuse of my son. I believe had she pursued this prosecution it would have been an ABH charge. Her initial statement also stated that he drinks every night ( something I have always known, but never had the evidence) and that he was in drink the night of this incident. They claim this was a one off ! However as. Social worker I know this is highly unlikely . I am scared that my son will be forced to have overnight contact my a court and therefore will be subjected to their relationship and the violence that will inevitably come. Social care took no further action as I was being protective. Probation have also raised their concern with the LA. Please advise

It is highly unlikley your ex would be awarded this, especially as he has a non-molestation order in place and social services are involved. The court will always decide what is in the best interests of your children and would not allow a shared-care arrangement to take place under these circumstances.

I was previously in a relationship with a man whom I love very much.
A year and a half we were together until he left me for someone else.
The start of the relationship was great and he treat my 2 children like his own, he also has a child to a previous relationship whom I also loved to bits and treat as my own.
He told me that his previous relationship was awful and his ex partner was abusive to him, which made me feel so sorry for him and love him even more.
After about 3 months into our relationship things started to change, he started calling me names, telling me I was a useless mother and started to take control of all the finances.
I became pregnant with my 3rd child and he questioned me about who the father was, knowing full well it was him.
From this point things got worse, he would cause arguments everyday over silly little things.
One day my sister and her son was present as he started being abusive and violent, he threw a glass across the room while all the children were there, it scared everyone.
He used to say I was texting other men n stopped me using Facebook.
He'd call me a Slag and say I was being horrible to him all the time when really it was the other way round.
He would grab me, push me, pick me up and throw me, put his hands around my throat and pull my hair, then blame me for it all and would make me beg for forgiveness.
This all happened during my pregnancy with my daughter but she's here and I'm lucky to have her.
My eldest child would write letters to me , saying he was scared and that he was going to go and live with his nanan.
My daughter just would stay up in her room crying and asking why he was always so angry and horrible.
I went to the doctors as it made me feel so down and ill but I couldn't go alone as he wanted to make sure I didn't say anything about him.
The doctor gave me anti-depressant pills and put it down to post-natal depression .
Although I was hurting so much inside I still loved him dearly and prayed that the man I fell in love with would reappear one day.
He stopped me going out, he took control over all the money and I wasn't allowed to spend any, he put all the finances together in a joint bank account, I lost all my friends and he even made me leave my job of 16yrs.
I was isolated from everyone , even my family, I was stuck at home with my children and a dog he got me for my birthday to tie me down also.
My sister was the only one who had any sort of idea what was happening but even then she didn't know the extent of it all.
I eventually found out he cheated on me and he left and didn't come back, he just said it was all in my head.
It was all true and within a couple of months they had booked a wedding which is due to take place in lapland in the next couple of weeks.
During the time of our separation he still kept coming back and playing with my head saying he is sorry and wants to come home.
He never came to see his daughter and I refuse to let him take her

Hi me and my partner are separated he has been to prison for DV on his ex I met him after he got out
We fell in love and got married 5 months later then his true colours came through he was abusive when drunk hit me pushed me around controlled me isolated my friends etc
In 2008 we moved to England from Wales his drinking cheating and abuse carried on
In 2009 on Christmas Day he turned up at my work still drunk from night out where he didn't come home grabbed me demanded car keys threatened co workers who were trying to protect me the police were called and arrested him and presses charges he got a 12 or 24 month suspended sentence and had to see a parole officer after 3 months he was begging me to take him back and he had stopped drinking
I did in 2013 I got pregnant he did grab my wrist and shout at me while pregnant and sober and I thought omg he's violent without drink and thought what the hell have I done
Well we broke up in oct as he got angry with our daughter
I've let him see her under my supervision for her safety I've got stronger and would not let him harm her hence why ending it then
And since that time he has been out drinking he said he won't be doing it again but in time I know he will
I messaged his mother to let her know and for her to look out for him
And got nasty messages back and then a phone call off him being angry that I had done it and he threatened seeing a solicitor to get visitation without me I'm happy if it's supervised
But will a court take into account his past and what happened the day he left ?

My husband pleaded guilty to common assault on me, he got community service. His sons mother will not allow him access without her supervising and only for an hour. It is very hard for him to maintain a normal relationship with his son as she sits with him.
We have looked after his son on alternate weekends for 3 years and he has looked after his son every weekend for 6 years prior to that and no harm has ever come to him and we never have a cross word in front of him.
Would a court order go against my husband? Can she use the evidence the police used to inform her about what happened to me?
How long can we expect surprised visits by her , before we can apply for access?
It was a one off incident and we are fine together and I have no fear, my husband is very remorseful but unfortunately his son has been the casualty in this . Please advise

Have parental responsibility but supervised order made to see my.two.children under such conditions where I am.unable to take.children home and must be supervised by my ex partner who also.has to.care for my eight.month baby.
Primary carer parent (my ex) is now complaining that contact is not strictly being adhered to but given the circumstances changes, it's virtually impossible for my partner to be present at all times.
What punishment can my ex attempt to.impose on my partner for any intentional (due to safety of her own baby) breach of her undertaking?
ChildSupportLaws Editor 17/11/2016 at 2:21 pm
She can, if she thinks there is a good reason for doing so. His option would be to either suggest mediation in order to try to resolve the issue. Or if his ex refuses this and the situation does not resolve itself, apply through the courts through a C100 contact order.

My husband is on bail following DV towards me, it is a victimless prosecution and I don't support Police action and there is a strong chance the CBS will drop common assault charges. However te mother of his son who we saw once every two weeks for the weekend, has denied him access. His son wasn't around at the weekend of my assault and we always put his safety paramount and never had a cross word in front of him. Can she do this?

My partner left me over four months ago when she was seven and a half months pregnant, taking our children with her. We had been together nigh on eight years and in that time, never had cross words nor raised voices. The only fly in the ointment was that I was going into hospital for bowel cancer. Things were great before I went in, we were looking forward to our third child and we were about to buy a new house. I had complications and a five day stay ended up being five weeks. On the day I came out, she left with no real explanation. That was nearly five months ago and since then she has almost denied me contact or access to our children. I have seen my new son for an hour in five weeks. She refuses to tell me where they are living. She has blocked my phone number so I can't call to say night-night or talk to my children or text to ask how they are. I'm completely cut off and there is nothing I can do about it.

My point is this. She has said that if I find out where they live, go to our son's school, rejoin and attend our gym or continue to call/text to talk to or ask about our children, she will go to the police with a stalking/harassment claim.

How on Earth can wanting to be a committed and loving father who needs to see his children leave me subject to a stalking/harassment charge?
ChildSupportLaws Editor 24/10/2016 at 1:39 pm
If you do not register the father on the birth certificate, it means he has no rights to your child and would have to apply through court. However, the court will be given a record of his abuse and any court will always decide what it thinks is in the child's best interests. It is unlikely access would be granted if you oppose it based on his previous convictions. If you register him on the birth certificate, he will be eligible for certain rights. Therefore, if you do not wish the father to have any rights (even basic), then you should heed the advice you have been given.

i got pregnant from a casual partner. We were not in a relationship and he was emotionally and physically abusive when he found out I was pregnant. I moved away from him and he was not at the birth and is not on the birth certificate. Recently he has been visiting his daughter and I have tried to allow him to be around as I thought it was best, however from time to time he starts pushing the boundaries again and is harassing me. He has shown up under the influence of drugs to visit before and I am not happy with him beings left alone with her, but worry that he may go to court and force himself in and with no evidence on my part I'm scared that my daughter could be forced into a vulnerable position. Where do I stand?
ChildSupportLaws Editor 03/10/2016 at 10:10 am
You would need to seek legal advice regarding this matter as it is rare a court will allow a parent to revoke Parental Responsibility, unless necessary.

I split with my partner nearly 2 years ago the relationship was abusive and he was arrested and sentenced, at first he was still seeing the children however that has now stopped he has made it clear he wants nothing to do with them as he has made no contact and we were even in the same shop as him the other day and he ignored them and walked out, he pays no maintanence towards them which is fine by me but in just wondering if it is possible so him to sign over his parental rights to them, I'm sure he would agree to this as it would mean he wouldn't have to pay for them as child maintanence are currently chansing him and if he signed over parental rights in lead to believe he wouldn't have to pay for them and nor would he have a say in decisions I make for them. I know in America you can sign over rights but is it something we can do here in the uk? Also I have written a will up to say that if I die he's not to have the children and they are going to my sister but can he fight this and would he get them? He can't even look after his self properly and last weekend he had the children they came home in the same clothes I sent them in for 3 days they had stayed in them and slept in them so clearly he's not a good father to them. I just want to be able to do as I see fit for my children without him getting involved at any point in the future . If some one could help or advise that would be great.

My step sons father was a physically and mentally abuser to my wife when they were together, however the courts didn't wanna know about the past and how he was and gave a court order to see his son. Now it's been a few years since the court order was issued and things have happened over the years that make you think as a parent. My step son (7 now) always comes back home with bruises, says that daddy calls him names (he's getting diagnosed for autism and has hypermobility) plays too rough with him and other things. Now over the last few years some incidents have happened
1: the dad knocked his sons top front teeth out with an air hockey puck and lied and said he banged his chin and so in turn his teeth hit his bottom ones.
1.1 - Lie, he had no bruise or any sort of Mark on his chin nor did he have any teeth on his bottom half as they fell out.
2: not long ago the dad locked him and his brother (3) in the car and went into a shop to which he was gone for a while.
2.2: now it's my understanding you're not legally allowed to lock children in a car and leave them for any length of time.
3: while over his dads my step sons brother (3yrs) woke my step son up at 5am and told him he wanted something to eat/drink so my step son being the big brother obliged and they went downstairs to the kitchen, upon being down there the youngest wanted bread and butter to eat so he done him bread and butter. Now all is fine up until the youngest got a very sharp knife out and ended up cutting his fingers and there was a lot of blood (my step sons description) and my step son thought the youngest had cut his finger off. All while this is happening the dad and his girlfriend are in bed and not supervising the young children at all.
His dad also calls him names all the time like poof and spastic, he's in denial there is actually something wrong with him (to which doctors think he's autistic and is getting tested)

Now my question after all that gruelling statement,

Can my wife legally stop the dad seeing his son on the grounds of safety......Physically and mentally.
sarah 26/08/2016 at 3:51 am
Is all about women interest. Why nothing good is said about any of the men. Who will allow intimacy let alone having children them if they we so bad. No one in relation just starts and shout on love one. What sort did these people put their partners we need to hear.
ChildSupportLaws Editor 22/08/2016 at 10:20 am
I'm afraid this is beyond our remit to advise (as we can only offer general non-specific advice). I can only suggest you seek legal advice regarding this.
ChildSupportLaws Editor 22/08/2016 at 10:09 am
You don't say how old your child is, which makes a difference, i.e you would more than likely hand more of the decision making process over to a 15-year-old than you would a five-year-old. However, even if your son is older and wishing to make his own decisions in life and you feel you have to overrule those decisions (for what you think is in the best interests of your child), then the best advice is to sit down with your son and explain to him the reasons why you are making those decisions. Your ex will have the option to take the matter to court if you cannot resolve the issue between yourselves or via mediation. The court will then decide what it thinks is in your child's best interests. Throughout the court process Cafcass will get involved and will interview both parents in the case, as well as the children, and any other people who might be needed, such as social workers, medical professionals, or even relatives. The court will make its decision based upon the information in the report. A lot of the time children seem to idolise the parent who is absent from their lives, and some parents feel they have to let their children go and let them find out for themselves, while others will continue to protect their children from the possible effects. As with all parenting, it doesn't come with a rule book and there is no right or wrong, we all have to use our own judgement here.

I am a soldier. While we were still married I was sent back to my home country where my wife refused to move with me saying she didn't want to leave England. We married while I was stationed in the Uk, I resided there for 7 years. Several times she came to visit for long periods of time and left my daughter here as well. I took leave to come take of our daughter while my now ex wife, had surgery. I was blindsided with a court hearing and residency order. I am allowed to take her out of the country since our daughter has dual citizenship. I didn't fight it as she assured me it was only to continue getting her benefits as a single mum. When I picked her up for summer vacation, she was severely bruised. The doctor immediately called child protective service since she also revealed she was terrified of her mother. After many meetings with behavior health I have come to realize I was verbally, emotionally tortured through the whole marriage... On a couple of occasions physically harmed as well. It's hard to admit since most men don't see domestic abuse as ever happening with the male as the victim. There is a case currently open with the authorities of both countries. She is expected back in the UK soon. I have spent the last year constantly being texted and called horrible things in front of my child and have had almost all communication cut off. My ex even went back on our Christmas plans. I have proof to most of this including her stating she has done all of this just because I have pissed her off. My daughter has already made it clear she is terrified of of Her mother, has been told and shows many textbook warning of a child that has been abused. Her therapist feels as well as I do that if I send her back she will be severely punished and I may never see her again. Also she may be undergoing benefit fraud yet she is continuing to use extortion to have me send her money under they able in exchange for communication with my daughter. Our divorce was done through my country because she refused to sign the papers in the UK unless I gave her a payout. The residency order is through the UK in 2013 and was very brief. Can I keep my child past the agreed upon dates until the uk receives my paperwork asking for a review of the current custody arrangement, protection order, both authorities continue the investigation, and she continues to see the therapist. There is so much left that I could say on what has and is still happening but Who can I call to ensure I am not accused of abduction? The courts have not been helpful at all I have to send everything by regular mail. The residency order specifies which recorder I was to contact when I tried I was told the case was closed and to send 220 pounds to reopen it. Also not something I have just laying around as I have just spent 9000 on plane tickets to get her. Also since she is continuing to verbally attack me and I am able to admit and seek help for the burdens I have carried with me due to the domestic

If you have the police reports etc which demonstrate and prove the level of his violence towards you, then the court will make a decision based upon these and the CAFCASS report. However, the issues relating to orders about children can be complex - therefore I suggest you obtain additional advice through Rights of Women here.

Hi

I was with a very violent man for four years. I actually moved to Spain with him. Before we left he was incredibly violent towards me using a kmife on me and beating me black and blue and then imprisoned me. A friend rescued me and I reported him to the police however I dropped the charges as he promised he would never do it again and I stupidly believed him.

We went to Spain to live and were there four days before he got violent but by this point I was trapped as my family disowned me. For a further three years the violence got worse and worse with his using knifes regularly to slice my legs etc. I fell pregnant snd the violence continued until the very end of my third trimester where he seemed to turn nice and once again i stupidly thought it was a turning point. Four days after my emergency c section he beat me up kicked me in tje stomach and told me I had failed as a mother as I hadnt managed a natural birth.

For the next few weeks the violence got even worse with him even beating round the head five times with a broom handle with my 4 week old in my arms. He put a knife into the back of my head and I honestly thought he was going to kill me until I was rescued by the police. I was then flown back by the british embassy.

He has now followed me back and the courts and granted me a non molestation order and prohibited steps order however he is contesting it. He is claiming he is a good father and he wants access.

I have police documents from uk and spain as well as photographic evidence of wjat he did as well as several witness statements.

Please tell me he wont be able to get access or custody? Even having to face him in court terrifies me and I am adamant my son does not need him in his life.

Hello, I am looking for some advice please?

I was married to a man, who I did not realise emotionally and financially controlled me for nearly 10 years. It was quite text book really, he stopped me going back to my job after our first born, made me stop contact with my family, then with held money from me. He told me on a daily basis that I was silly and stupid, and accused me constantly of having affairs, so that in the end I avoided any contact with other men. He would shout in my face and if I tried to escape to another room he would follow me. I couldn't even hide in the bathroom as he disabled the locks.

I did eventually find the courage to end things - after a particularly vitriolic outburst where he called me the most horrendous things and accused me yet again of having an affair.

I have 2 children with him, but 2 years later I still get abuse - on my doorstep in front of the kids, and a year ago he physically attacked me in my own home. Police were called but I stupidly didn't press charges.

I feel worn down by it all - I thought he'd get over it by now but he persists - calling me a pathetic excuse of a woman etc. I am tired of dreading him turning up for the kids - it is never amicable, and I have to say, I do try to stand up to him.

Under these circumstances I know he uses the children against me. He has 2 children from a previous relationship who are now adopted by someone else as he stopped contact with them, even putting in that he didn't want them to contact him later in life.

Is there a legal way that I can ensure that I never have to see or have contact with him again? I know the children have a right to see him - I hope they will make their own judgements as they get older, but I am at the end of my tether and feel exhausted by the stress he causes.

I would appreciate any help at all.

My ex-husband is threatening to stop paying or reduce child maintenance which is only £1,000 (including my rent £500). I do not receive any spousal maintenance. He has already reduced the sum he was ordered to pay before making an application to amend the Court order.

Since the birth of the children, I have not worked and looked after the children. And because I have not worked (which was agreed by him as well), he is using the Wright v/s Wright judgement (which bears no resemblance to our situation) to reduce child support: "once children reach "Year 2" or age seven, there is an expectation that the primary caregiver will start part-time work and make a financial contribution" .

I will also like to add that my ex-husband is actually renting our joint matrimonial home without my consent, thus pocketing the rental income which is in fact financing child maintenance.

Could you please advise if the "Year 2" judgement is the law? I believed that this case was more about spousal maintenance.

lp - I left my husband due to emotional, psychological and financial abuse. I left him with my baby boy after he locked us in the house and refused to let us leave, arguing in front of my baby. He is a very manipulative man who knows how to act. After I left him I was seeing advice from the police and womens aid. He then took me to court on a without notice basis saying I would be fleeing the country. Making it all up! The judge at the hearing I was called to a week later said it was unwarranted and that I had proof that I sought his permission via a consent letter when I did go away before, the first in 3 yrs. he made so many lies just to get me to court. The judge then listed it for an FHDRA hearing but in the mean time he ordered my sons passport to go to my solicitors for the time being (not his as he wanted. He previously used to threaten to take my boy). Judge also put a PSO on him as well. I felt really upset that I was treated like some kind of criminal, passport taken away and a PSO order in place, all because of his lies, even though I proved I have ties in this country, being born here, settled etc. consent letter, it was completely out of order. He was given supervised access in a contact centre.

So at the FHDRA hearing - which I thought would just be a quick hearing to list for Fact finding so I can have my say. I have evidence of a 5 yr diary, bank statements, recordings of arguments and witnesses YET despite all of this my solicitor failed to bring up anything in court, before the hearing telling this is just a directions hearing, and there will be time at the fact finding to do my statement! What a lie! The hearing was all about ex and unsupervised access and overnight access. All I heard in the court room was what he wanted, and the judge just acted like it was a normal divorce and because the contact centre reports (2hrs every week), came back wonderful, they wanted to move to unsupervised contact. Dispite my concerns raised to CAFCASS about the emotional and psychological damage my son would face with him and his family, as they are all very hostile towards me, even to this day one person told me how they are being nasty about me. I didn't get to speak to cafcass on the phone for the safeguarding checks but spoke at the court for all of 2 mins before the hearing. its been two weeks and I still don't have a court order. I applied for a residency order for my son back in April and I still have not got this and my sons passport is still not with me. The judge wanted to close the case saying no need for a fact finding (she had read my C1A application but that's just touching on issues), and said that it would only cause more stress. But throughout this, after fleeing the home to save my son, I still have not had my voice heard! its as if the abuser gets to get away with everything, manipulating the courts and the victim doesn't even get to have her say. I cried down at the phone to womens aid telling them not to tell people

Help - I left my husband due to emotional, psychological and financial abuse.

My ex-husband was very abusive in our relationship he went to prison for aggravated robbery and kidnapping while in prison I cut off contact because I felt that was the best way to get away from him because when he was out he would always come to try to find me and my family will always tell him where I was at he was just released from prison in March of 2016 and a month-and-a-half after he's out of prison he tries to get me back and when I say no she gets upset and verbally disrespect me threatening to physically hurt me he even went as far as saying that he would kill me he said this to me and to our 12 year old son not to mention in the past before going to prison he has had several domestic violence's cases against him for assaulting me I called the police but sad to say they never showed up so I called his parole officer and went and gave a written statements he was picked up but released a few days later I was going to file for child support but not sure if there will be some limitations for him as far as his violent past and threatening

If you can prove the relationship was abusive, then you can apply for a Specific Issue Order through the courts. Specific Issue Orders are orders sought from the family court to determine a particular matter in connection with the exercise of Parental Responsibility. These orders can cover a wide range of issues that you and your ex-partner cannot agree on, such as:
preventing someone from having contact with your child and/or likewise requesting someone to have contact with your child i.e your parents. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order. I hope this helps.

Hi, I'm looking for advise about where I stand, my ex was in an abusive relationship before we got together, i have recently learned that my ex has gone back into that relationship, I really don't want my child seeing or being in this type of environment, is there anything I could do to prevent this? we split up 3 months ago, we have a 8 month old baby. My parents have been stopped from seeing my child, what can my parents do to get to see their grandchild? When I go to see my child it has to be at my ex's house, my ex is always there, this is so I can't take my child to see my child's grandparents. Can my ex do this?

I am very sorry to hear this. It must be very scary for you, especially if you think issues are conspiring against you and you are powerless to do anything about it. Although a Section 7 seems daunting, it will give both your opinions and your child’s wishes and feelings to be taken in to consideration. Anything your ex that constitutes harassment should be kept for evidence or acted upon if his behaviour is intimidating, which defines what harassment is. Also, if your ex has been charged with assualt and has drug issues, then the courts will obviously take this seriously into consideration. While it may seem to you, your ex is a threat, what the court/Cafcass decides may not be as bad as you anticipate. I assume you are taking legal advice regarding this, if not I suggest you try to get as much legal help that you can. Free advice can come from McKenzie Friends, also the Corum Legal Centre here and the Citizens Advice Bureau. I hope this helps.

My ex was emotionally and psychologically abusive towards me throughout our relationship and it took having our child and not wanting our child to grow up thinking that behaviour was normal for me to finally leave. Since leaving the harrassment has intensified and contact has been used as a battering ram to continue trying to control me, keep tabs on me and change thing last minute so that even in my 'child-free' time I can't make plans. Of course after nearly a decade of this behaviour I have not been so quick to submit and have argued my points more. This just escalated the situation and last year I was assaulted by my ex in front of our child. There has never been any acknowledgement or apology for this and although that was the final straw that made me cease contact after trying all I could to keep it going I am now being deemed as unreasonable by the courts for not reinstating it. Once contact ceased our child started coming out with things that had been said to her and in front of her. Our child kept wetting the bed, was frightened to go to or stay in bed, was terrified of me not being with them, was waking me incessantly throughout the night for reassurance and cuddles and was violent and aggressive towards myself and children in their Nursery. It took months and months to work through this period and just as we started to I was issued with a Court Summons because my Ex had applied for a Contact Order. Court proceedings have been used for him to assassinate my character with fabricated accounts and malicious lies and yet somehow the accounts of behaviour and words from our child have been washed over like they never happened whilst I am still deemed a vindictive parent preventing another parent seeing their child even though they've been charged for assault, are attending their penance, have passed a drugs test with a month's notice and have not one shred of evidence to back up their assassination of me.The Court have reluctantly agreed to a Section 7 and I am terrified that my ex will seduce the Cafcass Officer with their scarily plausible lies, unnatural calmness and expert manipulation in the same way they seem to have done with Court. I am terrified they will get free reign to continue messing with our child's head and I really do not know where to turn for guidance and support. Please help if you can.
ChildSupportLaws Editor 23/06/2016 at 11:04 am
As you were unable to finish the thread, I don't know what your question is. However, if you have a safeguarding issue over your children, you can stop contact and your ex would (if he wished) have the opportunity to take the matter to court.

Hi i have 3 children with my ex partner i was with him for seven years from the age 14 which was full of mental and physical abuse in front of my children under 5 years old, he emotionally damaged me to believing i was a failure as a parent even though i did everything right he would tell my kids i dont love them and call me horrible names to them and when acting violent would take my children and wouldnt let me leave with them i felt i couldnt get out of this relationship for along time and believed his treats would follow through if i tried. He had broke my nose nearly broke my jaw (i didnt seek medical attention as i was scared) and many a times beat me in which every case i would not fight back but protect and try hide my children. I finally had enough and one day called the police he was physically violent towards me and my mum and sister whom i called for help that day he was again very physical and was saying horrific things infront of all my children. He went to prison for 10weeks i have a restraining order in place and for a while a panic alarm. A few times he came to my property after coming out of jail which i contacted the police and they couldnt gather enough evidence to get him. contact was made with my children through my mother which went well for a while 3 days a week for a few hours. I had a person come into my house at 1am in the morning looking for my new partner (whom i am pregnant with) and threatening me once he seen nobody was there but me and my children he left leaving a comment of 'if you have any men in your house again i will smash your face in' police believe this was do with my partner but fortunately couldn't gather enough evidence despite cctv showing a man and another in the car entering my property (he also has a friend with the car described). I kept all this from him while police investigated and still today he does not know. The problem is now he had picked up my 3 year old son and brought him back to my mums house (which i was there) my son was screaming for me so i went to comfort him and ask what was wrong my ex was swearing and called my son names for crying which really effected him, so i picked up my son and hugged him and because my ex didnt like that he started getting very veritably abusive calling my unborn child and again myself also saying my children again did not love me and wanted to be with him. I took myself out of the situation and took my child inside with my baby whom is 1 he asked for the children i said no due to his behavior he then started kicking my mums door and throwing the bins in the yard which scared my kids. I called the police as he wouldnt leave and explained what happened witnessed by my mum and my mothers neighbors to them he was just given a warning to stay away from the property. Later my son was playing up badly and saying horrible things to me which when i asked where he got that from he ecxplained daddy said. My issue now is that i have stopped contact because of vio

Have you thought of suggesting mediation to your ex in order to resolve the issue? Mediation is when two or more parties meet to resolve problems before the matter reaches court. It is most often used in family proceedings. It is a formal negotiation and courts can accept the agreement of the mediation instead of having to go through the court process, although it is subject to final court approval. Mediation takes place in front of a neutral third party.

His. Me and my partner split 2 years ago and I have a 4 year old son. Since we split he has had little to do with my son, I arranged all the contact and he has never paid anything. He would do things like not show up or forgetting to pick him up from nursery whilst I was working.
Last year I found out he was taking drugs and I arranged him to have contact supervised by his nan once a week. This worked for a while but they fell out and I had to supervise the contact once a week. Last month he was arrested and given community service and a suspended sentence because he got drunk in a primary school and threatened police officers etc. This led to me feeling very very uncomfortable with him around my son and I asked him to see him in a contact centre, this led to loads of arguments from his mum etc so I agreed him to see our son at his mums 2 hours every other Sunday, however we fell out today as she has continually lied throughout the whole process and been horrible to me. I told her he needs to sort it out through court/contact centre because I don't feel she would tell me the truth if anything happened. Now she is saying this is unfair/his rights etc but I don't know what to do. I understand he has rights but I really so uneasy letting my son go with them every other Sunday when there is no amicable relationship there. Please help what will happen if he goes to court in this situation? There was DV from him in our relationship 2 years ago also.

hi. I've been in a relationship with my partner for just over 4 years. he's always been somewhat emotionally abusive, but I always let it slide because of existing mental health issues he had.
we have a one year old together who he dotes on.
in Dec 2015 we got in to an argument and he ended up slapping me and the police were called. he was charged with assault and given a 2 year suspended sentence and I agreed to take him back if he sought medical help and went to his probation meetings.
he was very sorry to begin with.
I'm now pregnant again, currently 30 weeks he threatens me with violence constably and verbally abuses me non stop and gets so angry so quickly. he raises his fists or comes at me but never hits me.
but i feel broken and I can't deal with it anymore.
he won't let me leave every time I try, he threaten's to take our daughter away from me and move back to scotland. I know I can't stop this because he has parental responsibility.
I don't know what to do.
ChildSupportLaws Editor 01/06/2016 at 12:46 pm
You don't say whether the police were involved, but if they were you may want to speak with your ex about your concerns directly. If you have an amicable split, then she may take on board your worries and you may be able to come to an arrangment regarding having your child more frequently, or what to do should an event like this occur again. However, if you cannot talk to your ex about the matter, then I can only suggest you seek legal advice to explore your options.

My partner and I split up 7 months ago, in which we have had a plan in place in relation to seeing our dayghter. My partner had cheated on me however I'm the one who has to make do with seeing my daughter 3 times her week. I received a call off of her last month stating that her new partner had beaten her up, whilst my daughter was there in her arms. Whilst addaulting her, he also shouted at my daughter who is 14 months old calling her ugly. Whilst this is extremely immature, this is to try and insult me as my daughter looks like me. I stood by her as I knew this is not her fault of course. However, I have learned that she has taken him back and I feel really uncomfortable with my daughter being around him, if he's done it before he will do it again. What do I do next?

My wife planned to take my children away from me. We had an argument and she started to scream to get the attention of our neighbours. She then opened the house's door and run in the street with our two children. Our neighbours called the police and I was arrested. I am on bail because of allegations of domestic violence. Before the police makes any decision, she made a prohibited step order to prevent me take the children from her care, their school and the UK. Her false claims of domestic violence prevented me seeing our children except under supervised contact. I did not commit any domestic violence but the police considered her a victim and, in fact, I am the real victim. How can I prove that her claims of domestic violence are fake?

I am sorry to hear this and you are in a tricky situation because of your dependency upon him for care of your children while you work. If your husband is abusive to you, another question to be raised is do you trust your husband to care for your children when you are not there? I can only suggest you speak to your boss directly about your situation and perhaps request flexible working to accommodate your children's needs, Unfortunately, if this cannot be the case then either you will have to set about changing your job, or finding alternative childcare. If your ex is abusive to you, the sooner you have him out of your life properly, you too can move on with your life and not be in fear. In the meantime I can only advise getting in touch with someone such as Family Lives directly, link hereto see if its advisers can give any alternative suggestions. As you know, once your ex feels he has power over you then what may start as once or twice will accelerate. I hope this helps.

Hi, I have recently separated from my husband who was abusive towards me for many years. I work nights and my husband stays in the family home on the nights I work to look after our children. This was working well but recently he has started being abusive again. What can I do to stop this. I need him here to look after the children as I have nobody else and he is unable to have them overnight where he is living. It is not possible for me to change my working hours at the moment.

I am very sorry to hear this at what should be a magical time for you both. Firstly, if your partner is refusing help, and you are concerned for the welfare of your child then you should either speak asap directly to your health visitor or make an appointment with your GP. Secondly, is there any way you can take some time off work in order to help both your partner to care for your child, and oversee the situation? The main thing you can do currently is try to be as supportive as possible. You may also wish to take on some of the chores and/or take your baby out for a few hours, or make sure your partner can get plenty of sleep, these things will help ease her burden throughout the day. Having a newborn can put an immense amount of pressure on mothers to the point where they feel they cannot cope and this is where they can snap. Trying to ease this pressure may help in the short term. The NHS site here and heremay help. Post-partum rage is a common symptom of post-natal depression, but you want to ensure it doesn't get out of hand. Do some research, find the best ways around supporting her and try to talk to her gently by getting her to understand that her actions are normal for a lot of mothers who are under post-natal stress, but most importantly try to encourage her supportively to seek some help.

I'm a male and the majority of stuff I see is where the females are victims and am therefore finding it difficult to fathom what advice is out there for fathers of whom their female partner is the abusive and aggressive one. The mother of my new born child (7 weeks) is repeatedly shouting at either myself in front of our child or alternatively directly at my child to the point where on some days when I return from work my child is forever crying when my partner see's to her, where as she is all smiles when it's me. My partner has thrown things and in turn broken them, from plates and glasses, to mobile phones and even attempting to launch the tv - all of which has happened in front of our daughter. I'm concerned when I leave for work in the mornings as to what goes on when I'm not around and I'm forever thinking when the next episode will be of which I feel its only a matter of time before something hits my child when rebounding off the wall for example. I have thought this could be post natal depression however when I suggest she see's a doctor, I get more abuse. I just don't know what to do or where to start.

I have recently split from my partner A lot of it is to do with the safety of our daughter and the fact that his other daughter didn't really care about things that I asked to do in order to keep it safe for my daughter. Since the split he has been rather bitter he keeps saying that I was cheating on him says that I've been carrying on with other people. He keeps saying that I've got on gambling addiction which made it before I did have a little problem but I'm not on the head I've got a limit set and I only got one account. He keeps saying that I am throwing CSA when I'm not all I've done is gone off his P 60 from previous year put into the calculator and it came up with an amount which I did send to him he doesn't work for the company they work for that year he is earning a lot less now than what he was before but he has been sending money he's always says it's too much I haven't grumbled at what he has sent but he keeps throwing the CSA thing but I haven't been threatening him with it as well would I want to threaten when I could just go ahead and do it. All I want is for him to stop throwing these things at me is it classed as intimidation or harassment. What can I do I don't want to hear him throwing these things at me all the time cause he does in front of our 21 month all daughter who I'm sure picks up on the tone. I'm being fair he comes to see hair every other day and I've recently let him take her out on his own because previously has been threatening to take some life. His state of mind wasn't as I wanted it to be he wasn't quite on this planet after losing his dad which I do understand and I do sympathise with because I wouldn't want it to happen to me. What advice can you give me

Hi, a few weeks back my partner physically assaulted me after we had been out together. We have a 3 year old son and have been together 6 years he was not present when it happened. This is the first time he has assaulted me in this way. The social services are involved and the police are charging him with the damage. However, we have got talking and he is willing to change and get help with his anger. I would hate to throw away our whole relationship and was wondering is it even possible to redeem it or work on things with all these people involved! Thanks

Hi,
My partner walked out when my daughter was months old. We go through periods of getting along and then something doesn't go his way so he threatens to cause me problems, calls me disgusting foul names and tells me to f off most messages. These are usually done via text etc so I have screen shots. He has already had a solicitors letter regarding verbal abuse and he now doesn't even know where we live so he can't come near, I have to drop my daughter off and pick her up.
He always threatens me to withdraw his money as it is an arrangement and because he gets an injury benefit but earns less than £3k a week! He would pay me £7 which is disgusting.
What do I do? I can't go through the next decade like this.

Was wondering if anyone can help me. My partner held a knife to my chin in front of my children which resulted in me calling the police.it happened over a silly argument and now Social services are involved..There saying it's are high risk case but my partner has never ever committed an offence until now.hes not allowed bck into home and has to have supervision visits.he has to do a course stenght to change but that can be a yr course. I have to see dap...when will this end !!!!
ChildSupportLaws Editor 12/04/2016 at 11:35 am
I think this would be a case of either asking your ex and his partner not to contact you, if they refuse then you could ask a solicitor to compile a letter stating that due to the current circumstances you wish to have no contact. If your ex wanted contact with your/his child then he would have to apply through the courts.

I need some advise regarding my ex partner the father of my child. I left my partner shortly before my daughters first birthday because of domestic violence. Since then my ex partner has been in and out of trouble with the police for domestic violence and has moved in with a new partner who's children are on the child protection list due to the abusive and toxic nature of their relationship. Before I was aware of the violence between them my daughter stayed with them 2 weekends and during those weekends I later found his new partner took and over dose on insulin in my daughters presence, vandalised her clothes and toys and chucked my daughter and ex parter out on the street. An order has been given to my ex partner and his new partner not to be involved with each other to protect her children. But i have been told neither of them are keeping to that order. I was also contacted by social services and told if i allow my daughter to go into the care of my ex and his new partner my daughter will be put onto the child protection list. Is there any sort of order I can apply for to keep my ex and his new partner from contacting myself or my daughter?

My ex emotionally & mentally abused me throughout my whole pregnancy with his narcissistic ways (I didn't know this at the time). It made me physically & mentally ill. He violently attacked me when I was heavily pregnant, resulting in me attending hospital (although I covered for him ??) I am now strong enough to report this to the police (& have photographic evidence) as I have been undergoing therapy. Social services are aware of this. My ex is now demanding visitation & is being aggressive, manipulative & controlling in his contact with me, although I haven't seen him. He pays maintenance but is not named on the birth certificate.
I do not want him around my daughter as he has a vicious temper & I fear for her safety (as a child) both physically & mentally & also mine. With contact, I fear my recovery will be reversed.
What can I do?? Please help me...
ChildSupportLaws Editor 07/04/2016 at 12:58 pm
I am very sorry to hear this and no person should have to take this from another. If you feel your ex is harassing or intimidating you, you can approach the police, please see Ask the Police whichHave you any family or a friend that could step into help and oversee the contact when he is there? This may help, as will not answering the phone to him and asking him to make contact through another source such as email (as at least you will have evidence then).

ChildSupportLaws Editor 06/04/2016 at 2:30 pm
I'm afraid we can't really advise on this as it depends on the information given by both parties once the Cafcass report has been submitted and what the courts decides is in the best interests of your children on the back of it.

My ex has been violent to me for the past 14 years we have 2 daughters aged 7 and 12 I have reported him to the police and have a restraining order against him . After leaving him myself and my girls ended up in a women's and child's refuge which was extremely distressing he has recently taken me to court for access he doesn't pay CSA even though I've filed for it we wasn't married and they don't want to see him due to witnessing him assaulting me . Where do I stand in the eyes of the law ?

Hi Wonder if someone can help me, my ex partner has recently been seeing someone new which is fine as i have been in a relationsip for over a year now, what the issue is that I have is that she has told me that she is fightened of him and is worried that he is going to hurt my older son as she sometimes sleeps in her bed. She said that she believes that he is going to beat him up thinking that he is another man as he is pretty big for his age (14) she also has a split lip and the boys tell me that the house has been smashed up and there is blood over the walls. The thing is she abuses drink alot and i am not allowed near the house as she has told the police that i used to beat her up... which isnt true... i dont know what to do?? She could be lying but what if she isnt? Who do i call? When i started to talk to her about it again she said that i was crazy and that i am making it up. I am sick to my stomach of the idea of someone laying there hands on my boys! please someone help!

@Our Response, My partner and myself have PR. We both were living in my home with the baby, it was me that was caring for the baby since birth, As my partner doesn't know much about how to care for the baby plus she can't control her anger she was taking relanium in the past, I'm British my partner is from Poland.
ChildSupportLaws Editor 23/03/2016 at 2:46 pm
I am sorry to hear of your situation. If the mother is the resident-carer and there was no evidence to supspect she may take your child abroad without your permission (if you have PR), then there is nothing the police can do, but return your daughter to her mother. If you are concerned about her taking your child out of the UK, then you can apply for a Prohibited Steps Order through the courts. A PSO is an order granted by the court in family cases which prevents either parent from carrying out certain events or making specific trips with their children without the express permission of the other parent. This is more common in cases where there is suspicion that one parent may leave the area with their children. We have all heard the stories of a parent taking their child for the weekend and not returning them or going abroad with them and it becoming extremely difficult for the other parent to get their child back. Thankfully, this is one of the scenarios that a PSO seeks to prevent. In addition, if you have a case to apply for custody and you have parental responsibility, then your best option is to go through the proper channels and procedures and take the matter to court in order to let the court decide. However, please note it is very rare the courts will take a child from a resident parent and place her with a non-resident pareant, unless absolutely necessary and it is in the best interests of your child.

Well, it's all about protecting females and nothing for males. Since my daughter was born it was me that was changing nappies, it was me that was bathing my daughter, it was me putting olive oil on her body, it was me taking her to health visitors and gp, it was me doing shopping, cooking, cleaning, washing my daughter clothes and ironing them, putting my daughter to sleep, feeding her. mother of my daughter has troubled past she tried commit suicide twice before I meet her, before our daughter was born and when she was born, my partner sometimes jumped on me, she's very explosive person and swear lots, I had enough of it and was wondering of what to do esp because of my partner said she's taking my child abroad. My name is on the birth certificate.
In the end what has happen is that I took my daughter to police station and reported my partner, she was arrested,
Later on police called saying they're releasing her and that I either take my partner home or I have to give my daughter away to my partner.
My partner is back home and is taking my daughter away and there's nothing I can do about it. Justice? Not for me and my daughter.
ChildSupportLaws Editor 22/03/2016 at 12:38 pm
You could either agree between you who has custody of your child. Or if you feel that your husband may try and keep/take your child, then you could take the matter to court and apply for a child arrangement order

Hi
I am married to a guy who is withdrawing from alcholism. He has been emotionally abusive towards me and has stressed me out and emotionally scarred me. My 5 yr old has seen me stressed out and because of poor parenting on the dad's side, thinks he is a star.
Where do i stand if i was to seperate in terms of child custody? I am afraid he would have equal custody of the child as he has always threatened to take my child from me.
ChildSupportLaws Editor 18/03/2016 at 12:03 pm
If he has PR then your need to keep you updated about your child's well-being and progress. However, there is no legal rules, and this only need be applied in general terms such as school reports, or any other significant occurances in your child's life.

My ex took me to court to gain custody of the children. He lost and now is supposed to see them Fridays after school, alternate weekends and half the holidays. He is mentally abusive and controlling and sends multiple emails telling me how I am parenting wrongly and how we should 'work together' for the sake of the children. Unfortunately this means I should do exactly what he says and keep him informed of the childrens 'health' at all times. He is harrassing me because I didnt report to him about our son having a headache, when I did mention it he has a go as to why didnt I mention it earlier and telling me I should 'consult' with him before booking any drs appointments or trying to sort the problem. I am doing what I think is best for our son during my custody time with the boys. I would inform him if it was a major accident or required a hospital visit but I dont feel I need to instantly report any headache, feeling under the weather or paper cut to him. He always twists it as an example of my 'bad parenting'. where do I stand legally on how much I do or dont have to tell him and when?

I'm looking for some advice. My children and I currently have an indefinite restraining order against my ex partner. He had recently come out of prison, and I've heard that he is looking at putting in a contact order for the children. I've tried several places to try and find out where my children stand with the contact order if they have a restraining order against him. It makes me feel sick at the thought of him having contact. Will the restraining Order be lifted when he puts in the contact order? Or will that have to be done separately? As I understand it, contact order is a civil matter, and the restraining order was through the police. I hope someone out there can offer their opinion.
Ben Editor 08/02/2016 at 10:43 am
@Scaredmum You do not have to attend mediation, or you can attend mediation and still refuse to grant access. It means your ex 'may' have the option to take the matter to court. If your children are under the care of the psychologist and psychiatrist for the matter of abuse, then they will be able to back up your claim that you do not think it is in the best interests of your children. Depending on the circumstances your ex may either be refused the court application and/or reports will be issued to ther court reflecting this and the court can make a decision based upon the reports either your mediator or Cafcass may make directly to the judge. Regards Ben.

Hi...my ex partner was abusived towards myself & the kids....they were all you at the time but still remember the abuse...when we finally managed to get away he was verbally abusive & threatening with violence.....this was 3 years ago, he has recently applied for mediation to see the kids...2 of the kids are special needs & have cried begging not to see him....the kids have been under the care of a psychologist & psychiatrist for the last 12/18 months being treated for trauma from the abuse, the psychologist does not believe he should have any contact because emotionally & physically they will not be able to cope...will he still get access to the kids or are they protected by the law?

ChildSupportLaws Editor 25/01/2016 at 11:53 am
Most of the work will be done before you get to court by Cafcass. The building blocks of the Cafcass report are the interviews the reporters carry out. They talk to both parents, generally quite extensively. Since the report takes around 10 weeks to compile, a number of people are interviewed, a wide range, and there are instances when the court will ask the reporter to talk to a specific person, for instance a health visitor. The reporter will inform parents about the people they’ll interview, which will include the police and a check of the Child Protection Register etc. They’ll also want to interview any children involved, as long as they’re old enough. Part of the responsibility of the court is to take the wishes of the children into account where possible, although that doesn’t mean that will necessarily happen. The courts will make its decision on the back of the details and information supplied in the report and it generally sticks close to what the report advises. I hope this helps.

Hello.
I have separated and now want a divorce from my abusive husband. He has been convicted, I have kept a log of all events after the arrest, phoned police multiple times, and had help from victim support and different domestic abuse agencies.. Also medical records to back up the physical stuff, although he has also been emotional abusive. Now, he did have access informally, until an incident that now involves the children. Going to court, but all I read about is contact with both parents being best. Has anyone got any examples where this wasn't the case, because I'm not really sure how much more this man has to do before the risk to the children is considered too? My children are saying they want to live with me, one saying they don't want to see him at all. What do I say in court to get my point across in a rational way?
Hurt 15/01/2016 at 11:10 pm
Dear Sisters. I was married for 25 years and abused for all of that time, physically, mentally, emotionally. You all know the details, you are living it. I finally left when my youngest, at 15, begged me to go before he killed me. She was going slowly mad. The divorce and everything that goes with it took another 2 years. I got the divorce. My kids got part of their sanity back, but the scars remain. I am now 59, 12 years post divorce , never had another relationship-could not even contemplate it. I trust no one. My advice ? get out, go anywhere , do anything, you only have one life, and so do your kids. When they say they want to see the kids/have dual custody etc - its just to get at you-don't even bother - your children don't need these men in their lives, and neither do you. Meanwhile, my ex moves to another part of the country, picks on someone else, and gets to live another life. But what about me? Where is the justice? For what he did to me he should have been put away for the rest of his life.

Hello, I need some advice. I was in an abusive relationship until my ex went to jailed for robbery so I took my chance to leave him and told him the relationship is over.
He the began harassing me from prison leaving vile messages about what he would do to me if I left. So I took the messages to the police station and they said they would report it to the prison.
I had decided to move out of the house and back to the safety of my family. As I was sorting out belongings I found a gun hidden away. So I called the police to inform them and get rid off it.
He ended up being charged but denied it . It went to trial and I had to give evidence and he was found not guilty.
But still had to stay in prison to finish serving current sentence. I had to move out my family home and into a new one in a new area for protection. One day I received a call from the police saying that they have had reports that my ex had been over heard about what he would do to me when he gets out.
He had conditions that he is not allowed to contact me or my family directly or indirectly and was it allowed near my home or job when he was released.
I had a visit from social services as they was worried about his contact with his daughter and said I needed to take appropriate steps to keep her safe or they will intervin. They also showed me a long list of crimes that he had committed including of gun crimes, kidnap and battery and others.
Not long after his release there was trouble as he contacted my friend and wanted to set up a meeting between us. Around the same time a lady I did not know had made a report to the police that my ex tried to pay her to burn and stab me and take my child.
Once again he denied it even though the shelter he was staying at was right across from the ladies house. Anyway he got a caution as there was not enough evidence.
He soon broke his terms and went on the run. He was found and sent back to jailed
He recently got let out bit broke his terms and currently on the run again.
I am worried because his licence was reduced before he was set free and he is now allowed to contact and see me. I also had a visit from his mom. She came to my mom's house saying he wants acess and so does she, how can he have a cess if he is on the run? And where do I stand in regards to acess as I have read even men with criminal convictions have rights. Please help.

My ex husband emotionally bullied me and financially abused me. He was very controlling and as I was a lot younger than him when we got together I believed everything he said - this resulted in him having complete control over the household money and building up debts in my name. He used to brag about being friends with local gangsters and I was worried that he might get my dad beaten up if I tried to leave him. I dissappeared into myself for 12 years living under his rule. My wake up call came when I was able to check bank accounts and realised that he'd cleared them all out (including the children's) which in total reached about 40,000 - equity from a house sale was the main bulk of this (joint house). He'd never had time for the kids anyway and doesn't pay child support or even send birthday/Christmas presents and he'd have no shame in arguing in front of the kids- I realised that he didn't care about anyone but himself - I didn't realise that I was in an abusive relationship until I stepped away - my mother had bullied my dad all my life and therefore my 'normal' isn't a good baseline - does anyone think that I could act under the new domestic violence law in order that he has to answer for the damage that he has caused? ( years of counselling, medication and huge financial pressures). Thanks in advance - I'm never at peace
loolabelle 30/12/2015 at 11:38 pm
my partner has been prosecuted for domestic violence and served a custodial sentence. I have a restraining order and he does not know where we now live.
im worried about parental rights.
He is taking steps to gain access to our three children and is on the birth certificates of two. No orders have been put in place as yet, so my question is regarding his rights if I die. social services have been very supportive and have told me they have a very long list of red flags held on him (years worth). I am currently writing my will and considering guardianship. The children would not automatically be given to him to raise under the circumstances?

I am a mother of 3, my 2nd daughter's daddy left us when she was just 2 month old and she will be 5 in few days time.

He was very abusive towards me, beating me when I was pregnant and also after giving birth.

One day, just after 2 weeks I had my baby, he beat me to the point of death but I survived and I decided to took overdoes in other to sleep off (and never wake up). I wake up in the hospital and the social service got involved.

My mother jumped in to look after myself and the kids(2 at that time). Social service came to conclusion that I tried to commit suiced because I was in abusive relationship and removed me from their book.

This guy left us to get married with another lady just 4month after leaving me to a British girl in other to get his stay( he did a sham marriage....deceiving the other lady he loves her).

After almost 5 years, I am now married with another baby. My three children only knows my husband has their daddy. My ex partner's marriage has ended and no stay given to him by UKBA. He now want custody of my child(his daughter) so he could stay in the country.

And also want to ruin my marriage because there is no way his teaching will not go against my husband's teaching for the child.

This guy has taking me to court, what can I do to win this case?

***pls ignore any typing error because I can't bring myself to read through again....

Please can anyone help me...I have been told if my ex goes to court he will get access to our 3yrs old daughter...He was extremely violent in the past toe and I allowed him contact with my 7 yr old daughter who he had brought up from being 2...recently she told me she had witnessed him hitting his girlfriend whilst holding her baby in her arms and previously hitting her with a Chrismas tree I have also recently got evidence that his 16 yr old son is now becoming violent with his girlfriend who is only 14 I am quite concerned about him being given access as he is a very good manipulater due to doing the stop...anger management and safer relationships courses and can be a convincing nice guy...or don't want my daughter at any risk of being in any firing line of any violence but without full evidence and just hearsay from my 7 yr old what can I do...all he's doing at the in is putting statuses on fb about me with threats to post pics from nearly 4 yr ago and makes threats towards me when on a phone which I am changing number this week to prevent any more of that...sorry for the drone but I genuinely scared as my 3yrs old is on the autistic spectrum also so doesn't understand :/
MaiaR Editor 23/12/2015 at 10:42 am
@Andra - You could take it to court and apply for a Specific Issue Order if you do not want him to do specific things. You could stop access and let him to take you to court. Short of a court order there's not much you can do apart from making your own rules and laying down YOUR law!
Andra 22/12/2015 at 9:02 am
I have been separated from my partner for two years. He was and continues to be emotionally abusive and I have to keep personal contact to a minimum. He wants the children (9yrs and 7yrs) with him for half of the time and we have an arrangement via mediation for them to be with him 7/14 days. The kids love him and want to be with him but complain about boredom and put downs. My concerns are around (a) continued abusive behaviour and emotinal blackmail towards me (b) constant changing of schedule and fights over it including taking kids out if school without authorisation (c) him leaving kids with relative strangers despite our child's epilepsy leading to unsafe situations and (d) kids not being settled in one home for long enough each week to feel calm and settled. In short, I would like to have a more settled schedule for kids (more time with me) and avoid all sabotaging of holiday schedules. Mediation is no longer working as all he wants is to discuss is his maintenance payments (which he wants to stop). I am a loss in what to do. The consensus seems to be that one just has put up with this abusive behaviour and there is nothing I can do. But it is detrimental to both my mental state and the kids' well being and I find it hard to accept that I have to put up with this. Any ideas what steps I can take to improve this situation?

@Kate - You might have to wait until you are 18. You would need to apply through the courts to have the order lifted.

I need some advice, when I was around 14 my stepdad and mum were in a abusive relationship which got the police involved and went to court, there was then a restraining order so he could not go near me my mum or my younger brother, I am now 17 and want the restraining Order with him and me to be lifted does anyone know if I can do that?

If your sister-in-law is denying access when there is a court order granting this to her, then her ex is in breach, please see link: Breach of Contact or Residence Order: What to Do, here. She can also self-litigate if she cannot afford the legal fees, please see link: Legal Aid Withdrawal: How to Represent Yourself, here. This will help reduce costs and she may also get help from a McKenzie Friend, see link: Using a McKenzie Friend in Court, here. I hope this helps.

Hello, social services are involved because of my partner being violent, we had a fight but he hasn't done it before and I aren't scared of him or feel he is a threat to me and my child, but he has been stopped from seeing her until further notice, will they listen to anything I say because my baby pines for her daddy and loves him so much
Jem 12/12/2015 at 11:22 am
My sister in law has a toddler with her violent ex. She has photographs of the injuries sustained from him and threatening messages. During the court case her ex mother in law was supposed to collect her for court, she did not do this making my sister in law late (put down as a no show) meaning he got automatic custody. She now gets to see her son twice a week. Sometimes she'll travel the 8 hours on buses and he refuses to let her have access. The child is now copying the fathers behaviour, hitting at school and when with his mother saying things such as "I kill you" and "I hurt you". She doesnt have much money and so far is trying to get help through citizens advice, is there anything she can do to regain custody of her son?
ChildSupportLaws Editor 10/12/2015 at 2:16 pm
You should really contact the police about this matter if both yourself and your child are under threat.

I have a 9 month old baby. Social services are involved because her dad was violent toward me. Last month, someone threw something threw my window which caused a fire in my bathroom. Today someone put a threat through my letter box with a hand drawn photo of my house with a burning stick. Will social services take my baby because of this?
ChildSupportLaws Editor 07/12/2015 at 11:00 am
Without knowing the case and his esteemed risk (if previously convicted), this is difficult to give advice on. The Social Services main priority is to safeguard children who may be at risk of harm. Please see Family Lives link, here regarding what you can expect when the Social Services get involved. Family Lives also has a helpline that you can contact if you are concerned. I hope this helps.

Hi. My partner nd I have two kids. He has an elder son who is 4 nearly 5. They have a court order in place saying he has weekend access and she has him in the week. However social services have been involved throughout the little boys life on her side but never on ours. In 2012 my partner took her to court for custody due to concerns raised by social services but recently they have been in contact with us due to little boys mum in a violent relationship despite numerous warnings etc that little boy can't be near this fella. He is now in the process of being put on a child protection plan due to police making 4 referrals to social services as mother has claims boyfriend assaulted her. In the mean time social services have advised we keep the little boy when he comes tonight and get a residency order.. should we keep him or not because of the court order already in place? And what is the likelihood of my partner getting custody? We are all very worried about this little boy this is not the first violent relationship and its not the first time social services are involved
ChildSupportLaws Editor 25/11/2015 at 2:06 pm
I'm afraid we cannot predict what may happen in court. However, Cafcass would be involved and both you and he would be able to have your say. The fact he has had previous sentencing may be taken into consideration. Please see article: What Goes into the Cafcass Family Report? whichI hope this helps.
Wronek91 25/11/2015 at 12:46 am
In addition. Last time when I called police the social workers were involved, but because I don't want to be with father of my baby anymore (and we are not together about 3 months now) social services send me a letter they are not involved anymore as I am alone and I am not dangerous for my baby.
Wronek91 25/11/2015 at 12:40 am
Hi. Need advice. My baby is 5 weeks old. 2 years ago father of my baby had a case in court because of beating me up. Sentence was to do only some work for free. 1,5 year ago he went to prison because another beating me up and smashing my two mobiles. When I was 7 months pregnant he had another case in a court for damaging good and beating me up, sentence was to do 80 hrs and to go to probation for 2 months. We did not talk until I get to hospital for labour. He were there with me, and he was coming to me and baby until she was 1 week old, but he was really rude for me so I forced him to leave my flat and told that if he wants to see his daughter he needs to go to the court. The thing is. I really don't want him to have any rights (he is not on birth certificate), I don't want to leave her alone with him. I now he used to do the drugs, all his friends doing drugs and his family hates me, so I think they would make my baby think bad about me, they will do mess in her head. I am scared to leave her alone. Really really scared. He is dangerous. BTW he is 27 and he was meeting up with 16yo girl, so he might "like" young girls... I know he stopped doing drugs for a while, because he is going to court and he will open a case to have some rights to my baby girl. My question is : is there any possibility that he will get the rights or he will get a time to meet up with her?? Thanks

I'm afraid you would have to seek legal advice in California as we are a UK-based website, concentrating only on UK-based family law.

It depends on whether your ex will allow you contact or not. If she is open to discussion, now the restriction order has expired you could try mediation. If your ex refuses to attend mediation, then you would have to take it back to court and let the court decide.

You could apply through the courts to have your children returned to you. Please see article: When Your Ex-Partner Denies You Access, whichIf you do not know the whereabouts of your children, then you can apply for the court form C4, which is an application to disclose the whereabouts of your children, and means that the courts can put a trace on your ex, in a bid for you to at least obtain contact with your kids.

How can I take the domestic violance restraining order to be lifted it to court ? It was assigned by a juvenile court because babys father wasn't 18 yet. Do I really have to ask for permission for him to be in the delivery room ? What should I say to have it lifted ?
ChildSupportLaws Editor 20/10/2015 at 2:25 pm
I can only suggest she talks to CAFCASS about this who should be able to help make the court experiece less traumatic for your friend, should she have to attend.

Hi. My friend's ex-husband has got a restraining order against him to keep him away from her and her two children that he sexually abused. They are going to criminal court in December but my friend and her children have now received a letter requesting them to attend Family Court which he has managed to get through. Can they be forced to face their abuser in such an environment and even when he's got a restraining order against him? Thanks

You would have to take it through court and it would have to be up to the court to decide.

My ex and I have a 7 year old daughter together, she is brilliant in the sense that i can call or see my daughter anytime however a few months ago my ex's new boyfriend beat her up (my daughter was with me at the time), a warrant was issued for his arrest and he was cautioned. I demanded that my daughter be no-where near him which seemed obvious until a few weeks ago when I found out she was seeing him again.
I called her and asked that our daughter has no contact whatsoever with him and if I found out he had been near him, i persue mediation and demand the same thing and if that didn't work, i would take legal action for court. She replied "she would cut all contact herself as she didn't want to risk her losing her children.
I have since found out, they are engaged and possibly even married. Where do i stand?

Just for clarity, I am not jealous i simply do not want my daughter being in the line of fire should he become violent again.

hi my daughters friend has confided in her and has told my daughter that her father has attempted to punch her mother and that he also tells his daughter she is unwanted and should have been adopted as well as possible physically removing his daughter from his presence by dragging her out of a room. the father has reportedly fallen to the floor and his daughter believes that he is physically poorly but when she has attempted to call for help he has immediately got up and started yelling at her, my daughters friend has said to my daughter that he threatened to punch her and blames the current failings of her parents relationship on her. my daughter has taken my advice and tried to encourage her friend to get help via school support but her friend believes her father is going to moved out (this has been said before) then her problems will be over. however her father blackmails her into not telling her mum about his threats or that hes is poorly (not diagnosed or seen by gp), I am grateful that she is confiding in my daughter as i fully support my daughter and am relieved that she can confide in me when she has a friend in distress however i am unsure as what to do next as my daughter does not understandably want to break her friends confidence by telling someone her friend doesn't want to tell due to a fear of what might happen. i believe that my daughters friend needs help and i am willing to try and seek advice as what to do with the information my daughter has shared with me. This is obviously affecting my daughter as she worries about her friend but does not want to "make things worse" by telling some one other than myself. please could you advise me as what to do next? who do i contact and what can i do to help??

Please help me what to do ! Where do I start ? I was with my partner for just under a year when she fell pregnant . During the pregnancy she changed a lot and became very abusive towards me . Just after the birth of my daughter she was constantly saying she was going to leave me and continued to be abusive. I tried my best to change what she considered my faults were but nothing was good enough. Due to the emotional domestic violence it lead me into counsiling which she made fun of me going to . We broke up soon after when she got pregnant again and had a termination a couple of weeks in . Since the break up she refused me access to my daughter . The doctors diagnosed her with the highest form of depression and reffered her to cognitive behaviour therapy which she refused to go to. After weeks of not seeing my daughter she began blackmailing me into having her overnight against my wishing so she could go out partying. Anytime I'm ill or have arrangement where I can not have my daughter overnight she blackmails me by saying that my overnights would stop and that I won't see my daughter again. I have all text messages saved as evidence. I just want her to stop name calling me, belittling me , blackmailing me and have my days set in concrete . She lied about me to the council saying God knows what but continually saw me for months in after we broke up pretending she wanted it to work when her allegations against me meant there should have been no contact . How do I make her stop ? Should I inform the council she breeched her conduct and saw me ?

If you feel your children may be in danger, then you really need to alert Cafcass to the facts. You owe it to your children not to put them in this situation, should he be granted access. I can't say how Cafcass will view the evidence. However, if you make the allegation, then it will be taken seriously. I suggest you call the National Domestic Violence helpline via the link here if you feel you need some further advice on how to approach the matter. I hope this helps.

Wondering if anyone can help.
I have 2 children to my ex who was abusive to me. I never told anyone or reported it but still have scars from cigarette burns on my stomach and breast.
currently going through court for him to have access. Caffcass have been involved and are reassessing. There last report ordered access but there has been new ino so reassessing.
because he has hit my child on a few occasions and a load of other reasons. His wife is even more abusive kicks them tells them they are stupid and dumb plus more.
He promised me if I ever told anyone what he did I would pay.
I can't prove any of what he has done to the kids. I'm scared that if I tell the court what he did to me and he knows I've told someone. If they still order him access he will use the kids to get at me and god knows what he will do I'm petrified.
Will my scars hold enough evidence for them to believe me or will it just be another alligation?

'ADVICE WANTED PLEASE' My husband has always paid CSA monthly (attachment of earnings as she was receiving cash every month but got the csa involved and told them a different address knowing he wouldn't get the letters and she ended up getting money twice) up until last year when he lost his job which was a very dramatic time, he got a another job straight away but a very low income one. Anyway they were advised from his old work that he didn't work there anyway, hubby didn't contact them but we got a letter saying that there were still taking the same amount from when he finished his old job until we got the letter (he is now paying the correct amount) - is that fair? Shouldn't he pay the less amount from when he started at his new job? Also his child is now 19 and finished college in May of this year and went on to do a 6 week course for a company which meant her mother was not entitled to child benefit - we contacted csa and cb and the csa could/would not do anything until advised by cb - when we contacted cb to tell them they said they'd do an investigation as they believed she was commiting fraud - we've not a heard a thing until yesterday when my husband contacted csa and child benfit who said the decision still stands and she appears to have got anyway with it, she and the child have it all over facebook what they are doing - can this be appealed and if so to who as cb won't speak to my huband about the case....very frustrating!!! TIA

@albert - you would have to seek some legal advice to see whether your solicitor thinks it advisable to apply for interim contact.
albert 01/08/2015 at 7:19 am
Hi, my ex partner of 4 yrs has made dv allegations against me, I'm on court bail atm, I have conditions not to contact her, can I have contact with our 3 boys without breaching my conditions, I'm really missing them with all my heart
ChildSupportLaws Editor 15/06/2015 at 11:04 am
@Adele - I'm afraid you are left with little choice here, as if these are the conditions applied to you, then your children will be taken from you if you go against the order. I have included a link: My Children Have Been Taken Into Care - What Are my Legal Rights? here, which shows you the process, should this happen. Please keep in mind, if your children are taken into care, it will be for the reason that they are considered to be in a harmful situation. I hope this helps.
Adele 12/06/2015 at 9:53 am
My children have been put on a care plan and I was made to take a restaning order out on my husband but me and my children want him home but I've been told that if I take my husband back I will loss my children
ChildSupportLaws Editor 27/05/2015 at 2:05 pm
@Sharon The Domestic Violence Disclosure Scheme gives you the right to ask police if you have a concern that your partner may pose a threat to you. Police and partner agencies will carry out checks and if they show that the partner has a record of abusive offences, they will pass this information to you. I have included a Metropolitan Police guidance leaflet here which should help.

How can i find out if my husband got violence pass
Kaz 10/05/2015 at 8:25 pm
My ex has a passed history of domestic violence and has just been at court again for the same thing I'm now is a safe house away from him and I have photos of three assaults and now I'm going to make a complaint about historic violence towards him I'm jist hoping that he get time for it as he's out on bail and the kids where under social workers tje last tome and they are back involved with the kids
Penny Editor 08/04/2015 at 12:03 pm
@nana - I think in the first instance the mother needs to speak to the father to get this issue sorted out directly. If he doesn't agree then you may be able to apply for a specific issue order through the courts.
nana 05/04/2015 at 11:30 am
My daughter's two boys are in shared care with both parents under an interim care order, cyps social workers are also involved and the custody case is still going through family law court. The boys are 4days with mum and3days with dad. During their time with dad a former neighbour visits father's home where she is verbally abusive to the boys, she calls the elder boy that he's stupid and the younger boy that he's a dead boy if he doesn't do bad behaviour to his mother. I might add that both boys are high level autistic and attend a special school. The father was abusive to the mother, hense the split and will use any underhand tactics to discredit the mother in the courts eyes. Can we stop the neighbour from coming under contact with the boys as she really frightens and upsets them.
Sal Editor 12/11/2014 at 11:18 am
@jamtoast. You would have to talk to social services if they have been involved. But be careful, you don't want to end up in the same situation as before.
jamtoast 11/11/2014 at 5:32 pm
I fell pregnant with my ex partners baby ( he was psychologically abusive ) we seperated I spoke to womens aid , and someome from dvt at my local counsil , after having the baby we tried to make ago of things again he kicked a hole in my wall we seperated and again spoke to woman from the counsil ,

We are not together anymore however is there anyway he could prove to me womens aid the counsil ( if they got involved social services ) that he has changed in the future only at the moment I dont want him back until I know for sure but how would we produce evidence of this if ever it did become the case as he has told me he would join any courses or do anything they suggest to prove he wouldn't , so far he has taken a big step in getting a job which isnt much to most but a big thing for him and I want him to prove to me and any other third partys his changed and is consistent
