How Much Will I Have to Pay?

How Much Will I Have to Pay?

What is child maintenance?

Child maintenance is regular financial support paid by a parent who does not live with their child. The money goes to the parent or carer who looks after the child day to day.

In most cases, this means one parent pays the other. Sometimes the receiving person is not a parent at all: it could be a grandparent, other relative, or guardian who has taken on full-time care of the child.

The payments help cover everyday costs like food, clothing, school trips, toiletries, activities, and general household expenses. Child maintenance is separate from any benefits either parent might receive.

Why maintenance matters

Raising a child costs money. The parent with day to day care handles most of these costs directly, from buying new shoes to paying for school dinners. Regular maintenance from the other parent helps share that financial load.

This is not about one parent doing a favour for the other. It is about both parents contributing to their child's upbringing. Whether parents separated amicably or not, the child's needs remain the same.

For many families, maintenance can make a real difference to a child's quality of life. It might mean the difference between affording a school trip or having to say no, between replacing worn-out clothes promptly or making do.

Your situation may be slightly different. ask a question below ↓ and our editorial team will reply with our advice.

How the amount is worked out

The Child Maintenance Service uses a formula based on:

  • Your gross weekly income
  • The number of children you are paying for
  • How many nights those children stay with you
  • Whether you have other children living in your household

Your gross income is usually taken from HMRC records. This means your earnings before tax and National Insurance, not what lands in your bank account. If you are self-employed or your income has changed recently, there are ways to have this reviewed.

Child maintenance is calculated as a percentage of your gross weekly income. For one child, the standard rate is 12 percent. For two children, it rises to 16 percent. For three or more, it is 19 percent. These percentages apply between certain income thresholds, and the exact figures are updated each April in line with the fiscal year. Check GOV.UK for the current rates, as they change annually.

If your income is very low, you may pay a flat rate of just a few pounds per week. If you receive certain benefits such as Income Support, income-based Jobseeker's Allowance, or Pension Credit and have no other income, you might pay nothing at all. At the higher end, there is a cap of £156,000 gross per annum on income used for CMS calculations. Where a paying parent earns above this amount, the receiving parent can apply to the court for additional maintenance.

Overnight stays with the paying parent reduce the amount. If a child stays with you for 52 to 103 nights a year, the maintenance figure drops by one seventh. More nights mean bigger reductions, with further bands for 104 to 155 nights and 156 to 174 nights. This reflects the costs you cover directly when the child is with you.

If you have other children living in your household, whether your own or a partner's children you support financially, this can also reduce what you pay. The calculation accounts for your responsibilities to those children too.

The government website has an online calculator that gives an estimate based on your circumstances.

Ways to arrange maintenance

There are three main options for sorting out child maintenance in the UK.

A family-based arrangement is a private agreement between parents. You decide the amount and payment schedule yourselves. There are no fees, and you keep control. This works well when both parents communicate reasonably and trust each other to stick to the agreement.

The Child Maintenance Service can calculate a figure for you. You can then either pay each other directly through Direct Pay, or use their Collect and Pay service. Direct Pay means the CMS works out the amount but you handle payments yourselves. Collect and Pay means the CMS collects from one parent and passes it to the other, but both parents pay fees for this service.

A court order may be used for high income cases where earnings exceed the CMS cap, or where parents have reached a consent order as part of divorce proceedings. For most straightforward child maintenance cases, the CMS route is more common.

If a parent defaults on payments, the CMS can directly deduct from wages or benefits and may pursue further legal action in serious cases.

If your financial circumstances change after an arrangement is in place, contact the CMS to request a reassessment. This applies whether your income has gone up or down, or if the overnight staying arrangements have changed.

Whatever route you take, keeping records helps. Note down payments made or received, and save any messages agreeing amounts or dates. Keep records of any income changes too. This protects both sides if there is ever a dispute.

@Thinking You make a fair point about responsibility, and most decent parents wouldn't argue with the principle that children come first. Where it gets messy in the UK is when one parent is denied contact yet still expected to pay, or when CMS calculations don't reflect shared care arrangements properly. Both parents weaponising the kids is the real disgrace, as you say. The system works best when both sides act like grown-ups and put the children ahead of the grievance.
Thinking 17/08/2023 at 9:55 am
Many (as there are obviously some using their brains in more effective way) of these men complaining about the child maintenance, trying to avoid it or to reduce it are a disgrace to the whole population of decent and responsible people, these are men without honor and principles! I put it simple for you, if you bought a car you pay the price for it and it doesn't matter if you can afford it or not, even though you had a car crash next day; if you gave your parents into a care, you pay for them despite your financial situation, you pay tax and you are not discussing if the amount is fair or not. We can move on. If you decide to have children, it's your obligation to bring them up and support them financially. So what you are talking about? These are your !!! children, who else should care for them if not you? if you cannot afford to have children, live a monk life as having sex includes a risk of getting pregnant. The parent who is mostly left with the childcare alone, will have to stay home if children are sick, will be always there for them also having sleepless nights, cannot go out with her/his friends on regular basis as possibly you do or go on holidays (he or she may be very lucky having enough money for that including suitable childcare if needed), it will be also difficult for them to get a promotion in the job down to their availability and other capacities. You should in fact also pay your ex partner for all sacrifices and efforts to bring your children up, for you having time to organise your live however you like. In my country men are forced by law to have share care and still need to pay child maintenance or they pay child maintenance plus so called alimony for the parent with care if share care cannot be granted. Stop using children as a weapon (both parents!!!!). This is a disgrace. You should work together for the better life of your children. If you are rich, so your children should also be. I you are poor you invest in your children the maximum you can and you should always look for possibilities to increase (not reduce!!!!) your income so your children receive all possible opportunities they can. Instead of having silly protests and arguments showing you selfishness and irresponsibility HELP your children to have better future! Thank you in the name of all your children.

My son pays 50 a week, earning 350. He has his little girl 2 nights a week. He has been asked to pay for childcare on top.

The mum uses 15 free hours a week she uses 7.5 on a Wednesday, while she stays at home. And 7.5 on a Friday while she works. The child attends on the Friday u til 4pm. My son has been told he needs to collect her at 4, but he works until 5. He's been told he has to pay for the extra hour. Ontop of his maintenance, which he can barely afford. If he wants to eat. Surely we can request the nursery to use an hour from the Wednesday and add it to the Friday childcare allocation? To save him paying the extra.
SI 05/09/2021 at 8:34 am
How does this work, she's 15 and pregnant and wants to have the baby, my son is 17, how can they share legal rights to the child considering that soon my son will be 18 while she's still pregnant, who can he ask fir support to know what he can do to be the main carer of his child?
Dad 04/09/2021 at 12:31 pm
I think it’s a disgrace that men get done over. How a woman can manipulate the kids and when he can see them, and get 15% of his hard earns cash while claiming beniffits and doing sweet fa but sitting in her phone all day. Absolute disgrace.

I have 4 sons 3 with my ex wife and another with someone else.

I haven't had DNA, so who knows if they are all mine, I have bought 3 of my sons up like any father would do.

How much CSA would I have to pay? I've applied to the courts for DNA and they've just ignored the possible consequences.

I me a let's face it without DNA anyone could be the biological father to your children.

Hi.
Regarding the payments made to my children from my ex partner. He insists the money he pays towards the care of his children covers my fuel costs for them to dropped off to him?
DaveJ 24/08/2020 at 12:58 pm
I have offered my ex wife 3500 a month for the 3 children and 1500 for her. I also pay private school fees for the 3 children on top of this amount. I am consistently told I am out of touch with reality and that this is not enough for her and the children to live on. Whilst I am lucky to have a good income, I also work 6 days a week.

I would like to have my daughter stay a few nights a week but my ex wife refuses as it will drop her maintenance, what can I do ?
BM 25/10/2019 at 2:47 pm
Hi i had already agreed to pay my ex during our seperation i will continue to pay for my share of the mortgage and house bills, even though i am not living in the house. She is now claiming child maintenace, which i am happy to pay as it will cover food and clothes. But the CSA will not take into account i am already paying towards living expenses so each month i am paying £900. what are my options with my case?
Mpops 15/09/2019 at 1:35 pm
my ex and I used the online calculator to see how much maintenance I will receive for my daughter. it said £72 per week, but as he will have to travel a 60 mile round trip to pick her up and then again to drop her off, I offered for him to only pay £50 A week instead. Now he's saying he wants to pay me per calendar month (even though he gets paid weekly) because some months is a 5 week month and he doesn't want to give me "4 extra weeks money a year".
Is maintenance worked out by week or calendar month?
Should I tell him I want the full £72 per week because of this? And is it up to him to pick her up and drop her off?
I do work part time (30 hours) and would work more but I can't because I'm looking after my kids. I do need the money weekly and I cannot afford to pay the fuel costs if I had to pick her up every week.

I have struggled bringing up my now 16 and 18 year old myself not ever recieving maintenance from their father. I am now happily married to my husband that has one child to a previous partner. We was both satisfied paying £54 a week. But getting back from our honeymoon found out he now has to pay £62 a week. We have been working 6 days a week to pay for our wedding and it seems like his ex is getting treated for it too. This system is just so wrong!!!!
stu 27/08/2019 at 11:34 am
why is it we get calculated how much we pay to our Ex before tax and not after tax? I earned 38k last year but my take home pay was 32k yet I was calculated on 38k which to me is a massive over calculation due to the fact I have to live off a lot less.

my monthly take home pay on a good month is 2k AFTER tax and NI. out of that I have to pay my mortgage all my bills that comes to 1,100 leaving me with 900 out of that I have to pay 630 in csa leaving me with just over 200 to live off for the month. out of that I have to buy food and essentials like shampoo soap etc etc. I have no joys in life and have recently sold my car as I couldn't afford to run it anymore while my ex is driving around in a range rover.

the system need to be looked at and I think its about time the CSA take in to consideration people out goings. at this rate am going to have to sell my house and walk away from my job because I just can not afford to live.

1 we should not be calculated before tax it should be after tax

2 who ever asks to use collect and pay should be charged for it not the person not asking to use it and is more than willing to pay direct debit.

3 all essential outgoings I.E Mortgage/rent, bills and weekly food bill all should be taken in to consideration when calculating someone.

4 a court order should have to be in place before CSA will get involved to state the arrangements made between both parents for over night stays. there is far to many EXs lying about over night stays and refusing access to gain more moneys.

5 the percentage of how much one should pay needs to be scraped. there should be a fixed weekly amount. there is no way it costs £600 a month to look after a child

the system is outdated and needs massive change to many fathers are losing everything and in some cases taking there own lives because they can not afford to pay the maintenance being told he has to pay.

Hi, I'm having trouble working out what I should pay as I have 2 ex's, one of which is very reasonable to my circumstances, the other is not. Ex no.1 i have 2 children with aged 15 and 13. They see me every 3rd weekend and 4 full weeks per annum. Ex no.2 i have children with aged 7 and 6 who i visit 2-3 times a week as i am on good terms with ex. I currently pay £240 every 4 weeks to each childs mother but my circumstances have just changed.

My take home pay after tax is £1900. My key outgoings (if they matter) are as follows;

Rent, £1000 per month
Council tax £120 per month
Utility/phone/house bills £150 per month
Car finance £225 per month
Car tax/insurance £80 per month
Ccj's £40 per month
Child support £480 per month
Travel costs £100 per month

I've not included anything for my own personal living costs and food etc and am struggling to get my head round what's a fair amount to pay child support wise. Any help on how to make a fair assessment/calculation would be greatly appreciated. X

How can Father’s get away with this sort of rubbish they see there child but yet won’t provide for them, if you can’t go half on your child’s needs than you should stop seeing them there better off with out you in there lives.

My daughter was put in my care 8 years ago, no child support because daughter mother got married and husband paying child support and stop paying as they come of age so I pay £20 to new system to get £7 a week but decline paying me nothing because they are state benefits and have her daughter once a week is that true and I’m £20 worse off because of false info on new csa booklets. Where do I go from here. Thanks chris austin.

Hello everyone I pay my ex £700 a month and when I asked the csa how they work this out they said it's worked out fair to I pay the same as the ex to bring up the kids. I'm very sure my kids don't get 1400 a month spent on then so it works out I'm paying 100% of their up bringing and she not having to put her hand in her pocket at all it's very unfair as I'm loving on the bread line I'm having my parents help me out every month so I don't lose my house as I have also had to spend all my savings in court fighting to see my kids that cost me a year of the kids lives and 12k to prove the ex was a compulsive liar

The system is a sham it's unfair and wrong

My husband pays child support for his son (13 yo) to his ex girlfriend and she is asking for more which I do think she is entitled to. He rarely stays with us. However we have a child together also who does live with us and I don’t understand how to work out how much to give his ex. The calculator doesn’t seem to account for having a second child that lives with us. Unless I am being stupid or that doesn’t make any difference?

Today I was advised from CMS how much they are taking from me which has resulted in me having to hand in my notice today and give everything up as I have been scrapping by on less than £150 A month the extra £108 they want is going to leave me with £42. Which I will need to leave on, feed my child when he is with me and normal cost of living. CMS are worse the debt collectors and how there staff sleep at night is beyond me. So by xmas I will unemployed and have no where to live Merry Christmas peeps.

CSA/CMA is a joke, im paying 40%of my wage to these for one child, and it's crippling me financially. Once I've paid bills I've got literally nothing left, no money for my daughter's school trips or son.s bus fare no new clothes for us every month can't afford a car or blooming home insurance for that matter. It's ruining my marriage and my relationship with my kids at home because I can't afford nice things for them, but when my son from my ex comes over he's got all the latest designer clothes and games. And we're borrowing money every month to see us through.

My husband pays £140 a month for his child to a previous relationship and we have 3 of our own children who are very young. The calculations made by CSA are from his self employed work which varies all the time. Because the payment has to be made it leaves our own children with not much. Why are my children worth so much less than his other child who gets the set amount when I’m not working or receiving benefits yet the mother of his other child is living on full benefits/housing etc just for having kids and not wanting to work? Why are my children entitled to less of his money?
Sammy 20/08/2018 at 4:42 pm
My ex and I have a son who is 17 years old and turns 18 in January. He has left school and begins college this month, doing a course that equates to an NC or SVQ2 level. My understanding of this is I am still legally responsible to pay my ex when my son is in full time education, no higher than A-level education, which is the level this course would be?

When the ex and I split years ago, I went on to have 2 children with my current partner. Both children still in primary school and nursery. I never reduced the amount I paid my ex. This is something that would be factored in to payments if I was to go through the CSA or whatever the name is these days? Having a quick look at the maintenance calculator available online, having 2 further children with my new partner seems to have little to no change at all.
Grey78 Editor 13/08/2018 at 11:08 am
@Jayg - if you are not working, then your ex may have to pay child maintenance to his child. Give CMS a call to find out.
Jayg 12/08/2018 at 6:53 am
Our two children are split. The six year old lives with dad and three year old with me. Their dad works full time. I live in a new relationship and do not work. Does my ex have to pay maintenance for the child who lives with me and would I have to pay maintenance to him for the child he has.
RoryR Editor 17/08/2018 at 2:10 pm
@MJE as child maintenance is assessed on earnings from the a previously he might have been earning less. It's the only way they can extract money if there are no HMRC tax records for 2016/17 (they have to work from previous years to do their calculations). You should get this year's earnings attributed to next year's child maintenance.
MJE 01/08/2018 at 10:49 pm
Today I have been awarded £11pw going on the calculation you have got from HMRC for tax year 2015. We are now in 2018 and my ex partner takes home over £400pw. Please explain how this is a fair calculation. The response I got on the phone was this is what HMRC have given us, despite being a calculation of over 3 years ago? This surely can’t be correct and I should have to wait a year for you to review?
Jmrit 01/08/2018 at 7:26 pm
I have a daughter with my previous wife.for who i pay maintenance.i now have a son with my new wife does he come into acount when working out maintenance payments.
David 29/07/2018 at 1:32 pm
Why is it you feel that it is morally right to take money to the point I can afford to live?
Despite not seeing my child because of a spiteful ex? When the payments go up i am over £100 short a month to pay my bills and get food shopping, so I have to choose what to pay each month and get myself Into more debt.
ChildSupportLaws Editor 27/07/2018 at 12:15 pm
A family-based arrangement is not set in stone and should be open to such negotiation. If your ex refuses to take such issues on board (if the balance is unfair) then you would have the option to apply to CMS, if you think you would be allocated more money. My ex husband has been paying child Support since my daughter was 4 years old. While on Child Support he always paid on time and the amount increased every year as she got older. Two years ago with the amount of £240.00 a month, he asked if he can do direct payments. I agreed, thinking that being civil will be the new future. My daughter is now in secondary school, obviously older, obviously wanting new things and wanting to do more things, a school week trip to America in February which has cost £1560.00 is still being paid monthly by myself... not to mention the everyday expenses..
I asked him if he can give a little more and he’s refused.
He earns £1,370 per month. This is his only child.
Am I being unreasonable or does he (should he) pay more monthly. If we were still on the CSA he would of paid more because it used to increase. I sooo regret the direct payments now.
Please help me. I work in a school as a teacher but I am struggling.

Child maintenance and child access are two separate issues. If your ex doesn't want to pay the suggested child maintenance, you can apply via CMS. You can see more about arranging contact or access via whichIf your child is newborn and you are breastfeeding, you may wish to come to a gradual contact arrangement. This can be organised through mediation, if you cannot agree between yourselves.

I have a newborn child. My ex wants to pay maintenance but he is self employed saying his hours of work are unpredictable. I have asked for his gross income for 2016/2017 but he is refusing to share this information with me.
He is asking to have a new born child over nights, when he can’t even change the nappy, or is very nervous around the baby and scared of holding the baby. My son isn’t drinking much fluids and I have been in hospital now for two weeks, he hasn’t bothered coming to see him or texted to ask how he is doing. He asked me what I need for maintenance payments so I suggested between £50-£60 a week and he doesn’t want to pay this.
ChildSupportLaws Editor 12/06/2018 at 11:43 am
It is a difficult question to answer as it is worded hypothetically. However, with regards to earnings, if he is employed and paying tax via HMRC, then the earnings figure is taken from the amount of tax he has paid annually. If your ex is self-employed, then it is more difficult to prove. To get a proper answer, you would have to clarify your question in more depth.
Star girl 11/06/2018 at 9:55 am
My ex has suggested to court he works well over the hrs he has declared to CMS and is either lying about what he works to court to alter contact arrangements or lying to CMS about his earnings, what would be done in this instance?
ChildSupportLaws Editor 11/06/2018 at 9:22 am
Your husband doesn't have to be registered on his child's birth certificate to be named as the father to CMS. All biological non-resident parents are responsible by law for paying towards the day-to-day financial care of their child regardless. If your husband wants to claim parental responsibility for his child, then If your husband disputes his parentage, then Your income is not counted when assessing child maintenance, as you are not deemed responsible for supporting your husband's child financially.
Mistified 10/06/2018 at 9:24 am
My husband has a 9 year with his ex partner. He has been giving his ex money based on our calculations using this webpage. But he isn't on the birth certificate. Every time he mentions it she stops contact. Where does he stand with paying maintenance while not being on the birth certificate. Also is my income taking into consideration when working out child support?
ChildSupportLaws Editor 15/05/2018 at 12:57 pm
If you and your ex live in the UK, then the basic rate paid via CMS for one child, they will pay 12% of their gross weekly income, two children, 16% and three or more children, they will pay 19% of their gross weekly income. If you have a family-based child maintenance arrangement, then a figure can be negotiated between you. If your ex decides to leave the country, there is a The Reciprocal Enforcement of Maintenance Order (REMO) Unit that can help to register and enforce child maintenance orders internationally. However, this only applies to certain countries, you can find the list which

I have four year old and I have been paying child support for the pass 3 years. The most I was paying was $1577 monthly. Now I know all of the money is not going to my daughter. Since my daughter's mother has been collecting child support she has bought a new car. She refuses to give me back a TV i BOUGHT FOR $600 when we were together and she is always shopping. How do I fix this wrongful situation?

I have a teenager who I have been paying £300 PCM to the resident parent for the last 4 years. This is an unofficial agreement, which I have no issue with paying but I have always suspected it is quite high for my income. My partner is expecting twins soon and I am sure this will affect how much I pay.

I tried using the online maintenance calculator but it gets a bit confusing as I can say I have 1 child I pay maintenance for and 2 who live with me, but I cannot define how long they individually stay with me throughout the year. In this case the teenager is 2-3 nights per week and the twins will be 24/7.

Will this affect how much I should pay?

His ex does not work but my partner does.
She has now stopped contact unless she gets £400 permonth.
Can i just get some advice please
Teuchie 03/05/2018 at 11:03 pm
I am non resident father, two children staying 140 nights a year. I earn 3500 a month. CMS assessment but I also get blackmailed into providing many other additional costs.
Resident mother earns 10000 a month and frequently leaves children overnight care of boyfriend and is clear the money I provide does not get used for childrens welfare.
Do I have a right to challenge the CMS assessment, given it is leading to personal hardship for me which impacts on the care I can provide my children.
JillN Editor 09/04/2018 at 3:36 pm
@MM under the CSA net income scheme, the percentage of income paid was 15% for one qualifying child. Under the new gross income scheme it is 12%. Under the previous scheme many men (and women) were trying to avoid paying by putting money into pensions etc in order to bring down their net earnings and so they would pay less child maintenance. The gross income scheme was put in place to be more transperent and fair to try to prevent this happening. Some paying parents are actually better off. So if you want to blame it on anyone you can blame it on the fault of the people who were trying to get out of supporting their kids... not CSA.
MM 07/04/2018 at 1:08 pm
I have been paying CSA for a number of years and have just been notified by this new CMA department that my payments will now go up by 40.59%.

I’ve just queried this and its apparently because the CMA’s calculation is a percentage of your taxable gross, how can this be legal? They’re ignoring income tax and NIC so calculating payments based on income that I don’t even get and which is much higher.

How ican the government do this and can I legally challenge this?

I have just split with my partner. We have two children but one is at college and starts uni this September. One child will be staying with him 2 nights a week. He earns approximately £30000 a year. How much will he have to pay. Also he says he doesn't have to pay any money to me he can put it in the children's bank accounts is this right as I thought the money was supposed to help with everyday living cost
ChildSupportLaws Editor 13/03/2018 at 2:42 pm
By law, every non-resident parent is responsible for paying towards the financial day-to-day care of their child/children. This is regardless of what the other parent earns. Child access and child maintenance are not connected. Child maintenance has to be paid regardless of whether the parent sees the child or not. If the person is having issues with access, then mediation and/or the court is there to resolve such issues. Likewise, if a non-resident parent is not eligible to pay child maintenance i.e because they are out of work, this does not mean the resident parent can use this as an excuse to restrict access. Non-resident parents are assessed on their income and the amount they would contribute financially to the child's welfare if they were still living under the same roof. It would be deemed unfair to expect just one parent to have to pay for all the day-to-day care of their child.

I am in the same position as lee :Lee Lee's Question:
Divorced 5 years ago and ex wife has dragged me through the mud for reasons that she still doesn't explain. I put it down to some post natal change after our second child was born. Either way she earns three to four times wages I do. I'm on the bare minimum after having a mental crash and my business suffering. And constant abuse from my ex even after she moved cities. Which means I have to pay X amount to travel to pick up and drop them off as she refuses to drop them or meet half way. My main query is if she is earning three or four times more thane. How can it be justified that she claims off me ?? It's leadinge into further depression with her on sided demands and all the hard work I put into my business over 12 years I fear will go down the drain. Because I can't afford to keep up payments. She doesn't ' need ' she is being unreasonable spiteful and she constantly changes the goal posts when I can have the kids. If that wasn't bad enough arranged times at the strain station she hasn't turned up so I've wasted my money because she can't communicate properly. I'm so down with it all. Surely means testing should work both ways. How many men have been seriously affected by this situation I wonder. 100s of thousands I imagine

I appreciate you responded to Lee's question but I feel it was answered. Can you explain in more detail please.

My partner may have a 4 year old daughter with an ex partner. He payed an agreed amount for 2 years until she stopped access, he is unsure if the child is his and therefore stopped paying the maintenance about a year ago. During that time his x partner has ignored all his attempts at making contact. The CSA have recently wrote to his employer reqesting a payment of £800 per month to be deducted from his wages. Obviously my partner cant afford to pay this, and is reluctant to pay any further maintenance at all as he is unsure if the child is his. Please advise how to proceed in this situation.

Every NRP by law has to pay child maintenance. However, not all countries have reciprocal child maintenance orders. The link here shows a list of countries where parents can apply to enforce or change a child maintenance decision made in UK courts.

My partner just got informed he must pay back child maintenance money 5 months back for a child that may be his (woman run away with a newborn calming that child is someone's else). Before that 5 months someone else was paying money till proved that he is not a father. It doesn't sound right, how can you pay for a child you don't know you have. I also read somewhere that CSA/CMS can start enforcing payments from the application date so I don't understand where that 5 months back is coming from.. or if she submitted the form why he wasn't contacted earlier. We are planning family of our own, we just started renovation of an old place to have family, we don't have money to pay anything back. He is also paying for a 'know' child, how is it calculated when two children are from different mothers.. is it 2x15% or 20% divided by two..
I really appreciate help as my world just has been shaken.

You can see how much you should be paying via whichTherefore, if your ex decided to go through CMS, then CMS will calculate what you should be paying based on your previous year's income. Child maintenance and child access are two different issues. If your ex stops access, you would have to suggest mediation to your ex as a way of trying to resolve the issues that you have. If she refuses, you would have to apply to court.

My wife and I split up in November 2016 and divorced in August 2017. We have 2 children and she lives in rented accommodation and receives housing benefits etc etc. Since November I have been paying her £1k a month, when my wages were good. Now my wages have dipped the £1k is now 50% of my monthly pay and I can’t afford it. I have a girlfriend and we are looking at moving in but I believe if I stop or reduce this payment she willl stop me seeing the kids. I think £1000 is way too much and I may have been a bit naive in paying this amount for so long
ChildSupportLaws Editor 15/02/2018 at 12:58 pm
The child maintenance calculator, whichgives a good benchmark of what you should be paying. CMS prefers parents to make their own family-based arrangement based on the calculator, so as not to have to go through its administration charges etc. If you are paying below the amount in a family-based arrangement, then it stands to reason that your ex may wish to claim more. However, if you think your ex is withholding access in order to claim more money, then you have to option to discuss this with her mutually, via a solicitor, via mediation, or take the matter to court. A court will not allow your ex to withhold access to gain more money and if you have had regular access to date, then it's likely a court will allow your access to continue as previously arranged. The main objective here is for both parties to be fair and to come to an arrangement that suits you both. Remember though, child maintenance and child access are two completely different issues and are dealt with separately. As in all cases, the court’s main concern is the welfare of the child in question. The court will always put the child’s best interests first and this main issue will determine the outcome of any application for an order.
ChildSupportLaws Editor 15/02/2018 at 11:31 am
CMS calculate child maintenance based upon a non-resident parent's taxable income only. If you wish to take the matter further, you would have to suggest mediation to your ex, or if she refuses, seek legal advice to see whether you have a case to resolve the matter through the courts.

My ex (although never married) has my child's childcare responsibilities and we had an agreement for maintenance based on on-line calcs using my salary that was agreeable to both. Since then my child has decided she does not want to spend time with me (not sure if ex was influencing this) and so she is with my ex 100% of time. My ex now wants maintenance payments to increase to reflect this and she is threatening action if I do not co-operate.

My ex lives in a house that I have a significant stake in and the property is mortgage free although I still have a large mortgage on the property I live in.

The current rules do not seem to consider that I am subsidizing my ex's living expenses because she does not have a mortgage despite her re-marrying and living there with the new family and my child.

Can I use this 'subsidy' to offset some of the maintenance payments demanded by my ex? Please advise - Thanks

Hi there,

I have been separated with my ex for over 2 and a half years our agreement together was me to pay £150 maintenance each month that I have done and never missed it. Now am getting threatened with she wants £350 a month of contacting the csa. Where do I stand. I have proof of my money going in every month also I have my son as often as I can but she limits this so she can call csa for more money. What are my rights I want my son at least 3 times a week if not more.

I pay child maintenance for 2 children on the basis of having them 3 nights a week. Although it was more like 3 and a half nights on average. Since getting my plan of payment my ex wife has started a new job and it seems I have them 4 nights a week on most weeks now and my parents take and pick them up from school a lot during the day. My questions are - does any of the circumstances above affect how much I should be paying? a) having them more nights a week b) my ex wife now getting a wage c) she is having them less time during the day and my parents are having them more.

I have three children with my exhusband. He earns about 4 x my wage annually, so over £100k. At first we split the care 50/50 and he paid for school uniform, clubs, clothes etc. He has always refused to pay any money directly to me. Now the older two children spend more time with him as it is closer to school etc and it makes it easier for them. I am happy for them to be with me more but they found it hard travelling between 2 houses all the time so I decided it was best for them to do what they found better for them. My exhusband is now saying that I have to pay him £320 a month for their care, even though he earns so much more (he is taking the three of them and his two step children to Australia for three weeks in the summer so he can't exactly be skint!)and he has said he is going to go through the CSA. My husbands pays child maintenance for his three children and has done for the last 10 years. With recent changes to CSA he has been sent a letter to say how much he will pay going forward however the salary they quoted was way more than he earns. On calling CSA he was told that the figure was based on 2015/16 earning, which is still incorrect. He explained but was told that's was the only figure they were happy to go by, even though wrong. We have the children every weekend and through the week but so that is not an issue. How do we get the correct figure taken rather than a made up figure? In addition we still have to feed and clothe the children, plus holidays etc and have a daughter of our own to support.

If the paying parent’s gross weekly income is between £200 and £3,000 and they pay child maintenance for other children, this is taken into account when working out how much they should pay. The Child Maintenance Service simply reduces the amount of weekly income that it takes into account. For example, if the paying parent is paying for: one other child, their weekly income will be reduced by 11%, two other children, their weekly income will be reduced by 14%, three or more other children, their weekly income will be reduced by 16%. Hi I pay £70 a week for my daughter and I have her every other weekend from Friday afternoon till Sunday afternoon, I’m self employed and earn £575 a week before tax and expenses, my daughter also lives 100 miles away so I travel 4hours round trip to pick her up and the same on the Sunday to drop her off, it works out at £120 in fuel a month would this be taken into concideration into what I should be paying?
ChildSupportLaws Editor 31/10/2017 at 11:32 am
Only overnight stays are counted when assessments for child maintenance are being made.
Wilksy 30/10/2017 at 11:12 am
My partner pays full maintenence for both his children weekly but he has them for around 17hrs per week but not overnight. Its an agree ment between himself and the mother. Is he supposed to get a reduction due to the amout of time he looks after them?

Hi I have a child who I pay £20 a week for plus I buy clothes and nursery expenses etc. I have my child 6 out of 14 days and I earn £300 a week. Should I be paying this much as a few people have said I pay too much. Thanks.
ChildSupportLaws Editor 16/10/2017 at 4:00 pm
On the basic rate, if the non-resident parent is paying for one child, they’ll pay 12% of their gross weekly income, for two children, they’ll pay 16% of their gross weekly income.
Meg 16/10/2017 at 10:47 am
What happens if the person is paying csa for 1 child but as anouther child with someone else and lives with them would he still have to pay the same amount to the first child?
Mania 14/10/2017 at 8:16 pm
Hi. Just wondered what % of wage should be paid for two children that stay 3 nights a week (from previous marriage) when I have a child that lives full time (from a different relationship)
Gman 13/10/2017 at 12:09 am
@ginny same here I support my son have him 3 nights a week, she sends him to school in a uniform that is taking to bits, never works and spends the money on nights out and holidays, I asked my ex to arrange a tutor for our son as he is struggling at school yet she won't do it as she may have to contribute (I'm unable to as get tutoring here as I work shifts).
The whole system stinks. Its just another way of penalising men and making money for lawyers
SiH Editor 12/10/2017 at 11:16 am
@Jghmc - I think it's calculated through HMRC which works a year behind, so it's calculated on your figures for last year. Next year you will be calculated on your earnings for this. It's tough if your earnings drop.
Jghmc 10/10/2017 at 7:59 pm
Why am I to pay child maintenance based on figures from.last year when my income this year is lower? The calculator gives me a different figure to the figure I am provided with because I am on a lower income..

Advice please. My ex earns £5118 per month before tax (£3599 after tax). He pays maintenance for 2 children who he has for 2 nights every fortnight. As he earns over £100 - £200pw what is the percentage he should pay over that amount. Can you give me an idea what he should pay monthly please?
ChildSupportLaws Editor 21/09/2017 at 12:33 pm
On the basic rate, if you’re paying for rne child, you’ll pay 12% of your gross weekly income, two children, you’ll pay 16% of your gross weekly income and three or more children, you’ll pay 19% of your gross weekly income

So I have found out that my ex's 3rd child is my baby, he is now 4. I currently pay £380 towards the 2 children we had together age 13, 10 and the CMS are trying to take £300 a month for a 2 year old I have from another relationship. If this 4 year old gets added onto the CMS along with my two eldest what affect if any will this have on the claim for the 2 year old. Sorry I am sure I could of explained it better but this is new and confusing to me
Ginny 16/09/2017 at 12:01 pm
I'm all for child support. But how come they say that your child needs lets just say £500 a month to live on. When if you don't get child support and getting income support you don't get anywhere near this amount to support a child. So why dose the government think it's ok to yet again rob the tax payer of all their money. I know for a fact that my husbands EX usesd the money for holidays with her friends. Not taking her child with her . We never missed a payment, UNTILL YET ANOTHER BALIFFS LETTER CAME. And we paid the thing off , so that month she never got Money. It was not a day over late payment and she was on the phone to the csa. My husband used to let her deal with the bill payments. But she never paid any. Leaving a mass of debt that came to my husband. Over the years we have paid off thousands of pounds clearing the mess she left him in. She moves form house to house not for the BALIFFS to catch up with her. By the way she was the one having an affair that ended the marriage. We now live in a caravan as we can't afford to rent UNTILL the child support stops.( when the child is 20.) How can this be right. Please someone tell me.

My partner has been paying £195 a month for his daughter. I have 7 children that my partner supports at our house and now we have a child together. Does this mean the amount he pays for first child reduces or stays same as he's been paying same amount before he moved in and no other children to provide for and now he's got 8. His monthly income before tax is £1964

I've just been awarded child maintenance for my son from August 2017 . It is my understanding the figure yo be paid was calculated on the 2017 tax year. Can you confirm if that covers April 2016 till April 2017 or April 2017 until April 2018 please ?
I'm a little confused as my exhusband informed me he was leaving his employment and was supposed to leave may 2017 ( to avoid having to pay maintenance) yet the figure given to me had been based on his income that I knew about. I've called the CMS but they just say it's worked out on tax year 2017? They confirm there has been no contact made with my ex. I'm confused as yo if I will receive payment or not. Due to start oct 2018. Thank you

If you are paying via a family-based arrangement, then you can see how much you should be paying via the link here based upon your earnings. If you are paying via CMS, then it is at your discretion whether you pay more or not. But you will not be forced to pay anything extra through CMS.

Hi, I am paying £50 a week on top of buying all of my child's nappies, milk, etc. I buy any other items needed,as my child grows, like a booster seat. I am now being asked to pay over £100 a week. I have my child for one night a week. I don't think I should be paying anymore than what I am paying/buying now, am i correct?
ChildSupportLaws Editor 25/07/2017 at 12:35 pm
Calculating costs can be done via a family-based agreement which can either be arranged between you or via mediation.
ChildSupportLaws Editor 25/07/2017 at 12:29 pm
A family-based arrangement it just that - agreed between you. A good benchmark is to see what you would be paying if you were paying via CMS, please see calculator here.

I split with my husband in April 2017. We have two children.Due to my new job keeping me away midweek residential training for 17weeks it made sense he stayed in the family home with the childrenand I arranged rent. In another family home. Three bedroom also. I collect them on my way home Fridays straight from school and they stay until Sunday evening. I am now home permanently again albeit in a full time job. I would hope they will do equal time with us each now. We are less than a mile away from each other in the same village. Both the children are teenagers. How can costs to one or the other be calculated?
Ben 24/07/2017 at 4:27 pm
I have been paying £300 per month to my ex for a few years now as part of a family based arrangement for my two children. Both her and I have remarried. She has recently asked me for a further contribution towards school uniforms and school travel for next year which would run into hundreds of pounds for me to pay. As far as I am concerned this is what my (hardly unsubstantial) maintenance payments should be used for. I have a family of my own to support now, so it would be diverting badly needed money away from my step-children (their father is dead so we aren't getting any support from him). Does she have any grounds for asking for extra money or would I legally be entitled to decline or provide a reduced amount?
Jim 24/07/2017 at 1:57 pm
I have been split up from my wife for about 8 months now. I try to help out as much as i possibly can. Both my boys live with their mother but stay at least 2 nights a week at either my house or my mother's house they also spend a fair deal of time at mine and my mother's houses without staying over due to my ex working late. I work shifts so getting a routine sorted is difficult. I was just wondering how much the maintenance payments would be if the boys spend approx 30% of their time with me or my mother/step father? I don't want to dodge any maintenance but I do want it to be fair
Lou 21/07/2017 at 8:11 pm
Hi I have recently contacted the CSA regarding maintainer payments for my son! My ex was unemployed last year and so the letter he has received is based on last years earnings which was about £1300 they say he only has to pay me £365 for the entire year with is £1 a day for my son! He is now in full time employment and earning nearly £500 a week. Do I have to accept this payment based on his earnings of last year or can something be done? I just think it's unbelievable that he's earning that amount and only has to pay a £1 a week!
Henn Editor 06/07/2017 at 4:06 pm
@Tori - it sounds as though your ex is a serious child maintenance dodger and scared stiff you'll go to CMS. If he looks as though he is earning a good amount and you think he is, then CM will go on the amount of tax he pays per year. It's risky but it's definitely worth having a word with CMS. If he's got 158 properties, he must be on a good salary. What car does he drive, what's his house like? You can take him to court too if his lifestyle is flash and you think he might be earning more. A court will look more closely at his accounts than CMS might.
ChildSupportLaws Editor 06/07/2017 at 2:07 pm
It is unlikely the CMS would increase your payments as the payments are assessed as a specific percentage of your earnings. The only recourse your wife has, is to apply through the courts for help towards school fees. You are currently under no obligation to pay this extra money. However, if your wife decides to apply to court and the court decides in her favour, you may have to pay arrears.
Tori 05/07/2017 at 7:44 pm
My ex hasn't paid maintenance for since my daughter was born 15yrs ago. I did get in touch with the CSA around 2006 when she was 4 and they told me that they didn't have enough evidence (or along those lines) and closed the case. We'd had a bad break up and didn't have the money for solicitors and court. I made contact with my daughter's Dad in March of this year and said it was about time he started contributing. He's given me £200 per month which i have to ask for as he won t set up a direct debit. He has his own business and owns 158 properties which he rents out.
I had no idea about how much maintenance should be given but he told me that £200 per month is what he gives for his other child and has said that I'll get nothing if I go through the CSA as his solicitor will tie them in nots. Is there anything that can be done?
Dave 05/07/2017 at 9:44 am
Hi, I have greed to pay the CMS calculation of £279 per month to my wife for my daughter. This was calculated by CMS contacting HMRC for my earnings which I have no problem with. My daughter goes to a church school which costs about £160 per month and my wife wants an extra £80pcm towards this. I strongly disagree with my daughter going to this school as I feel the teaching and curriculum used are poor. I would much rather she attends a good state school. If my wife goes back to CMS to get my payments increased are they likely to agree with her and increase my payments?
Thanks for your help.
ChildSupportLaws Editor 29/06/2017 at 3:25 pm
Yes, it is taken from the paying parent's gross annual yearly income before Income Tax and National Insurance are taken off. But after occupational (employer) or personal pension scheme contributions are taken away. The non-resident parent will usually pay less child maintenance if they are paying either the basic or reduced rate, and they or their partner are receiving Child Benefit for other children living with them. You can see more which
Tracey 28/06/2017 at 2:25 pm
My husband and his ex had an agreement on child maintenance. She has now contacted the CMA to arrange direct pay and they say he has to pay £150 a week more because they calculate payments based on income befor tax and NI. Is this right? It seems very harsh. We have a disabled child and he isn't being considered in this decision. We could lose our home and I am terrified.
ChildSupportLaws Editor 27/06/2017 at 2:36 pm
If you feel your ex is being fraudulent and earning more then he says, then you may be able to take the matter to court. However, you would have to be able to prove this. Child maintenance is based upon the amount of tax your child's father pays through HMRC. You would have to be able to prove he earns a lot more. However, this is not an easy task. Therefore, you may wish to seek legal advice to see whether you have a case.

My sons dad has 1 child living with him and oays for another through a family arrangement he is self employed. First he tried to declare nil income this was rejected then he claimed my son wasnt his so we did a dna test which he was. Payment has been calculated at 14.65 a week is this serious? It doesnt even pay for a days childcare/food or clothes for that matter. He is putting his earning in his wifes bank to avoid paying more what can be done? I work full time and single on my own with 2 kids 14.65 is nothing to me and it will not have any benefit what so ever to my son childcare is 300 a week alone.
ChildSupportLaws Editor 15/06/2017 at 3:55 pm
You can work out hiow much you should be paying via the CMS calculator here. If you are in arrears the CMS can take up to 40% of your salary. Otherwise, on the basic rate, if you’re paying for one child, you’ll pay 12% of your gross weekly income, two children, 16% of your gross weekly income or if you have three or more children, you’ll pay 19% of your gross weekly income.

I have 5 children, 1 I don't see, been paying was for the last 17 years to her mum, get a letter saying it's gone to cms now, letter came today I've now got to pay 300 a month for one child. I earn just over 2000 a month and have 4 children living at home. How do you justified give 300 to one child, when I can't even afford to give that to my other 4 children. The mum is laughing and won't budge on a sensible agreement. Surely this can't be right, where is the equal in that?

I have recently had a claim made against me because I wasn't paying enough.. I did only pay £100 a month for 2 children, but doing this I have payed for hair cuts an clothes an general welfare.. I earned £26,470 with a lot of overtime, bonuses an premium hours for working shifts 2-10 an nights in 2015. I received my p60 later then usual an only earned £24,000. I am now not struggling cos am only on 22 grand basic.. this system is wrong I have my children regular an now can't afford more petrol or food so who is in the wrong I now cannot afford to live or support my children how I was.

My daughter is 7 and I have a case open with the CSA, mine has not been changed over yet. After her father went self employed, well made himself a director of his own Limited company he asked if could pay me direct, I agreed as otherwise with no company records the CSA advised me he could end up paying very little to begin with. That was nearly 2 years ago now, he refused last year to give them up to date income details and they did not persue it, if I ask them to persue it this time do they have to or do I have to say it is because I think his earnings are more than he last told them, I know also I would need to ask for a variation of earnings to be looked at as he will be paying himself a small salary to dodge the nat insurance and tax and probably excess pension payments and lots in dividends. I do belive he is paying quite a bit less than he should and over the next however many years his earnings per year will no doubt go up regularly. It is a total NO for me to approach him about money. Any advice welcome.

If you have a rental agreement in place that you have signed for, then you are responsible for this until the end of the term of your lease. You should really discuss this directly with your ex and try to come to a family-based arrangement regarding your contribution. If your ex has taken the matter to CMS, then you will have to talk to the CMS directly.

I suffered domestic violence with my ex 14yrs ago and did not put in a claim for Csa because I did not wish to aggravate the situation. I solely raised my daughter financially and emotionally for 14yrs. My daughter is now living with her father and he is demanding that I pay him child support. This is immoral and wrong. Where do I stand on a legal point of view?

ChildSupportLaws Editor 26/04/2017 at 10:43 am
Much depends upon whether he is also in full-time government approved education up to A-Level equivalent. If his jobs are part-time and run in parallel with his education, then you would have to contribute towards his child maintenance. However, if he is in full-time employment and is not in education, then you would not have to pay.
ChildSupportLaws Editor 25/04/2017 at 10:44 am
Regardless of whether your ex has his child every weekend, he is still legally repsonsible for helping to support her day-to-day needs for the rest of the week. If you have a family-based arrangement and your ex is refusing to pay, then the Child Maintenance Service will be able to help impose this

ChildSupportLaws Editor 19/04/2017 at 1:44 pm
If your daughter's ex boyfriend is not in receipt of an income and/or paying tax via HMRC, then child maintenance payments will stop. Unfortunately, if Child Maintenance Services states he is not eligible to pay, then I'm afraid there is little your daughter can do to pursue financial support from him, unless he agrees to a voluntary family-based arrangement.
ChildSupportLaws Editor 19/04/2017 at 11:50 am
Only the paying parent's wages are taken into account. As it is the paying parent only who is responsible for contributing financially towards the day-to-day welfare of their child.

My daughters ex partner pays £10 per week for his daughter. He also has another child. He now intends giving up work for a 4 year degree. I assume that he will have no income now and payments stop.

Can he do this and what can my daughter do to ensure his daughter continues to recieve support?

MattJ Editor 04/04/2017 at 12:12 pm
@Carrot - if you go to Child Maintenance Services then they will sort this out for you. The paymentsto each child should be equal - not in favour of his ex wife!
Carrot 03/04/2017 at 9:58 pm
My ex partner has two children to his first wife and one child to me. He currently pays his first exwife a set amount that they agreed on, which is quite high. Due to this amount he can't afford to make a payment to me. I have looked on the calculator ad he pays far too much for his first two children and so I have asked if this payment can be split three ways and therefore each child receiving the same amount. He is worried that his exwife won't agree to this. Legally where do I stand with this as I think it's unfair that my child doesn't receive any money from her father.
ChildSupportLaws Editor 03/04/2017 at 2:30 pm
Regardless of who your ex lives with or what her living/financial circumstances are, they have no bearing on the amount of child maintenance you would pay to support your child.

Hi, I pay child support through a family based arrangement and have never missed a payment and have always thought I pay fairly. The last couple of years she has started to demand more an more money and to stop her from harassing me I have given in. Now she is demanding even more. It's looking likely that she is going to get a court order against me. I have offered her more and asked for her to sign a written agreement but she is just ignoring the offer. I live abroad and know she will have to use REMO to enforce the order. I used the CMS calculator with what I would earn in the uk and its says 250 a month. As I am paid more in the country I live in, I also have to deal with a higher cost of living. After working out the cost of living difference and applied this to the CMS formula, it says pretty much the same, maybe even less. Would the courts take the cost of living where I am into account? The relationship between and her mother is so bad that I don't feel I will ever have the chance to see our child again until she is no longer under her mothers care.

Hi, my husband pays child maintenance for his child. His ex wife is asking for more money as she thinks we're under paying her. She says she'll have to go through CMS. We think it's a good idea as then there is no disputing the payment. According to the online calculator we should be giving her less, however after yo speaking to the CMS they say it should be slightly more than the calculator. What figure should be accurate...

My son turns 18 soon and she still wants the same.. how much % of my pay do I then pay for 1 child.. and is it based on gross weekly pay or net.? I don't have my kids overnight at all.. Im happy going through the family based arrangement but she wants CMS involved. Is this a must if that's what she wants.. I don't mind paying but not giving her the same for 1 child as she had for 2
My friend wanted CMS involved but because the absent parent was involved wanted to pay on a family based arrangement then my friend was declined CMS pay and collect scheme...
ChildSupportLaws Editor 22/03/2017 at 10:42 am
If your ex is not working and paying tax via HMRC, then it is impossible to claim for child maintenance. If your ex is evading paying tax, then you would have the option of reporting him to CMS, if you can prove where he is working etc.
ChildSupportLaws Editor 21/03/2017 at 2:05 pm
Unfortunately, if your ex is working cash-in-hand and not paying tax or NI, then it is impossible to get child maintenance payments from him, even through court.

My ex partner of 6years works many hours doing cash in hand jobs to avoid payment, we both had fertility treatment after trying for four years, had a beautiful baby we both wanted and knew was disabled but after our baby at six months had heart surgery he left, and not bothered to see her and when I've contacted him thru phone for maintenance he saying he will not pay and has moved on with his life. Is there any chance a can get a maintenance order thru court?? instead of csa as he dodges by working cash in hand not to pay?
MitchellD Editor 15/03/2017 at 2:36 pm
@Advice needed - they shouldn't base it upon your new husband's wage as he is not seen as being responsible for supporting your child. You need to ask them why they want details of your husband's wages as what he earns is irrelevant.
Advice needed 14/03/2017 at 11:14 pm
I am really confused between the CSA and CSM. I brought my daughter up alone from the age of 2 months old and her father avoided any payments due to being in and out of work. I later met and married a partner 8 years ago who works away during the week and comes home on wknds...he has supported my daughter as if she was his own. My daughter has now decided to live with her father and partner who are both claiming benefits and do not work....she seems to think this is the better lifestyle (due to not having rules and boundaries in place and wants to party all the time) she is 16 and in full time education. I am more than willing to use my wage (I have always worked) and pay maintenance but they are basing it also on my husbands wage? Is this right? If he is not the biological father will his earnings be taken into account? I understand we are married but why should it be his responsibility after all he has done! Advice needed really quickly please as they are ringing and demanding money all the time.

If a man has 3 children by 3 different mothers (who doesn't live with him), what percentage of his earnings would the csa take and would it be divided equally between his children?
ChildSupportLaws Editor 03/03/2017 at 12:08 pm
You would have to speak to the CMS directly regarding this as we do not have knowledge of its administrative processes.

Please can someone give me some advise as I am getting conflicting information from CSA and CSM. I have two children both living with with there mother. I am currently paying through the CSA. I know one case closes next month and she has applied to go through them and I pay without being charged by CSM. The second is proving more difficult and is adamant she wants me to be charged for as much as I can be charged including admin charges. What I need advise on is firstly how will this work if one case is closing and the second may still be open with the CSA. How will this work as I am sure this will have an impact in what I am to pay? Secondly do i get a choice in how I pay as I am worried i will have no say in this and may end up being charged just because the mother wants to punish me as much as she can. Much help will be appreciated.

Hi, my partner has a son who's 13. He has been paying maintainence since he and his ex split up. His ex has been in a long term relationship with another man for the last 5 years. They live together and he works but she does not. They have 4 other children at the house besides my partners son. His ex has been saying for a while that she no longer wishes their son to live with them and that he should come and live with us. This is imminent, it will happen within the next couple of weeks as she cannot cope with a teenager. We very much want him to come and live with us and are prepared to do everything to ensure that he has a happier life with us than what he has been having recently. My question is how do we get the child benefits off his ex without causing problems, it is likely she will not give this up easily. Also would my partner be entitled to any maintainence from them, and would both their incomes as a couple be counted? Thank you

The Reciprocal Enforcement of Maintenance Order (REMO) Unit helps to register and enforce child maintenance orders internationally

I have a daughter with a UK resident and in almost 3years now I haven't heard from him. All attempts to reach him has proven futile. I lost my job and it's been really tough for us. I live with my daughter in Ghana and he leaves in the UK. Please advise on how I could get him to pay for the child support. Thanks

Under shared care - who pays for childcare etc on the non resident parents days? My understanding us that a lower amount of maintenance is paid as costs will be incurred however I receive the lowest rate of maintenance and pay for everything including childcare on his days. Is that right? I can't find an answer to this anywhere.
ChildSupportLaws Editor 14/02/2017 at 10:02 am
You can find out how much he should be paying whichHowever, much depends upon how much income your ex declares to the HMRC, which (given expenses) can often be quite different to what you assume he is earning. As CMS assesses each cased based on the non-resident parent's earnings, this can either go in your favour, or you may realise you are better off financially in a family-based child maintenance arrangement.

You can double check via the CMS calculator here .
Craig 13/02/2017 at 2:26 pm
How can it be right that the payments are calculated PRE-tax.. But then I am having to pay those amounts POST-tax?

Because of this. I am actually paying MORE each month, even though I have recently had a child with my new partner. This is surely going to impact on what I can afford care wise for my child that is living with me, yet the CMO don't seem to take this into account??

If the amounts were deducted PRE-tax (like pension payments) then this would have less of a hit on my actual take home earnings..

I just can't get my head around it!

I have always payed for my child and always will.. But I have to care for my other child too, and that includes paying for the house that he lives in!

I earn £52k a year and have my youngest daughter (15) 7 nights / nine days per fortnight.
I gave her £50k from the house and 8 years of my pension. We were together 16 years.

My ex has remarried and they both work
I pay my ex £250 per month. It was £500 before my eldest turned 18.

This seems excessive. Is it correct?

Hi I have one child to my ex partner, he works on average 40 hours per week. He also has a child to another partner.
Neither of he children live with him. Is two calculations needed? Or is it the amount of 2 children then divided the amount we would receive?
And what percentage would it be, or what should he be paying to provide for his child? Thank you

You may be able to claim the flat rate of £7 per week if your ex wife is in receipt of incapacity benefit

I now have custody of my 10 year old son. Me ex is on incapacity benefit and does not work. Can I claim maintenance from her? It is not the money but the principal of the it all as she was always quick to ask me for extra money while he resided with her. Now boot on other foot and says she is not entitled to pay me anything

ChildSupportLaws Editor 20/01/2017 at 2:42 pm
Yes, your partner should be paying child maintenance to his children if there is no agreement of shared 50/50 care. With regards to his eldest, every parent has the basic responsibility to provide for their child up until the age of 16, when they are legally allowed to leave school and get a job. After this age, it depends what the child chooses to do. If they continue in full-time non-advanced education not higher than A-level equivalent, for at least 12 hours a week, then his maintenance payments will continue until his child finishes the course or until they turn 20.

Child maintenance payments do not naturally extend to university education and only extend to your son's qualifications not being higher than A-level equivalent. Child maintenance payments are aligned to stop once child benefit stops. Yes, child maintenance may be officially extended to cover university, but this would have to be decided by the courts. Of course if your ex wishes to continue to support his son directly (as he is living away from home), that is up to his own discretion. However, as it stands currently, you are in receipt of a benefit you are not entitled to.
sharon 05/01/2017 at 2:02 pm
I am receiving maintenance which was set by court order for the father to continue payments until the child reaches 18 or finishes higher education whichever is first. My son has gone to university and living in halls so still comes home during holidays and weekends etc.
Please could you explain what the requirements are for when i am likely to no longer expect payments for my son?
I have seen reports that courts can extend maintenance to cover the duration of higher education if the non resident parent has the ability to cover the costs.
Thanks

My two kids who live with me full time are both in full time education. One is 17 and the other 18. They both have part time jobs. Does what they earn effect what their father pays me? He has asked me for their income details saying the child maintenance agency (who he pays through since csa stopped) have asked him for these details. I was aware that their income while in full time education has no effect on what he pays, an I right?

You can see how much you should be paying via the calculator here. I'm afraid we can't advise whether you should stop payments or not, as only the CMS/CSA can help you with this. Hopefully, you will find the answer on the site in FAQs.

Hi There, I´ve been paying an agreed monthly amount to my ex who lives with our child. This amount was agreed between ourselves without the need for any agencies. She has now requested more money and decided to go through CSA to receive it. As CSA will make me pay from the point her application was made ( this week) 1 - Will they take into account the payments I´m currently making and deduct accordingly ( I bank transfer, so this can be proven) or 2 - Should I cancel all future payments (as she´s advised me today she´s submitted her application) and await CSA to tell me how much I will have to pay moving forward. Of course, I will set aside the money as if I´m still paying. But I need to avoid paying double as of course it is unlikely she will send me back any overpayments. BR, Steve

One is reasonable the other totally the opposite and is constantly demanding more.
How do I calculate what I should be paying each of them based on weekly earnings of £600 having them less than 52 nights in a year?

Yes, this is still showing the CSA process which is still in force for many existing NRPs. We will put in a paragraph in for those claiming via CMS.

I think either you or the new CMS are mistaken in saying that the maintenance is worked out on the net income, they have changed to working it out on the gross income !!! This has meant them estimating my child maintenance payments have increased from £500 a month to £750 a month............I can't afford the increase.........I've been broke ever since the divorce as my ex kept the house we lived in so now has no mortgage but mine is almost £200k.

I have a private financial arrangement with my ex-partner as regards assistance with costs for our son. Over the last 6yrs he has been staying overnight with me a minimum of 150 times per annum and over the latter 2 yrs at least 190 times per annum due to extra curricular activities & tuition as I am the only (willing)parent who can transport and support him in this way. I also on top of a monthly pay at least 50% for his clothing, school uniform, toiletries and further general expenditure as is required plus I make sure he has a paid spring and summer break! I live on a fixed pension and fell that now that my son is nearing 18 yrs of age (in full time education)that it is only reasonable that I can stop the monthly amount and just continue with the other direct support as stated above ( & to a greater amount). I would appreciate some advice on my planned Yours sincerely Glyn.

The Courts set maintenance for my 2 children at 1% of my gross monthly salary.
I have not been allowed by my ex wife to see my children and they are so scared they will not respond to emails.
My wife is saying I should be paying 16% of gross salary.
Who is right and what should I do?

I am currently separated from my ex partner we have a 3 year old child together. I work 25/30 hours per week and I am really struggling to support my self living on my own my son stays with me 3/4 nights per week how much maintenance should I have to pay if my ex partner is claiming full child tax and child benefit and my son stays a few days a week at my place.
NINA 03/10/2016 at 2:55 pm
I have not been living with my ex since I was 4 months expecting and now my child is 18 months old.

His father has never really paid contribution towards his necessities and not been around or had much interest from the very beginning until my son was over 1 years old.

I always gave him access and even invited him to my birth although we were not on good terms.

His financials contribution was only picked up on when I contacted the child support agency, and him being a director of 3 companies. all his accounts show he is not earning from each company which I am full aware that he is not providing the HMRC with the factual income amount in order not to pay for my sons maintenance.

The CSA have had information that suggests that he is not earning enough and does not have to pay anything towards his finances but this is absurd and he is fooling the system.

He was happy to pay me privately an acceptable amount per month as a mutual agreement towards my sons expenses but as this letter from child support agency came through he stopped this payment although he is earning and working full time self employed and earning comfortably.

It really frustrates me as the only person this is and will effect is my son in the future and his father is only concerned about him self and what suits him best.

Who can I turn to for advise?

How can I prove that he is defrauding the system so he does not have to pay his way. Its totally unacceptable and due to his spiteful behavior towards me its effecting me, causing me stress and hurt knowing that his childish behavior will only effect my son in the process.

I'm British and living in England. My ex wife is American and has moved to India with my son. She is financed by her millionaire parents and on divorce we sold the house with her taking over half the equity and all its contents. Informally, we agreed it was a clean break. Now wants child maintenance from me. Can she use the UK Courts as an American in India?
ChildSupportLaws Editor 01/09/2016 at 9:52 am
If circumstances have changed (which they obviously have) then your ex can ask for a variation to the order in the UK, based upon those changes.
ExpatDad 31/08/2016 at 9:27 am
Once our divorce and settlement/maintenance agreement was made an order of the court in South Africa (we were married in SA), my ex wife and children relocated back to the UK to settle. As the non-resident parent, I have adhered to our maintenance agreement since it's inception but now that I have remarried and returned to the UK, my ex wife is wanting to approach the UK Government to increase my maintenance obligations, because she feels I can afford to pay more now that I am earning in Pounds. Our maintenance agreement specifically catered for the option that if I chose to return to the UK, I would continue to pay the Pound equivalent of the Rand value to her, which I have continued to do. My question is this: If we have a South African maintenance agreement in place, that we have both signed and agreed to, which I am also adhering to, will the UK Government be able to implement and enforce an new maintenance plan to increase my payments to suit her?

Hello I have a child with my ex partner and I have him three nights a week every week plus six full weeks a year holidays. I buy all his cloths and all his school uniform. I also have to buy extra things for my home due to my sons disabilities which my ex gets benefits for. Now she is asking me for money even though I sometimes have my child more nights than she does.
ChildSupportLaws Editor 22/08/2016 at 1:45 pm
As with every non-resident parent, by law you are responsible for paying towards the day-to-day care of your child. Child maintenance and child access are two separate issues, meaning you still have to pay maintenance regardless of whether you see her or not. If you wish to apply for access to your daughter, then you can do this through court.
jo 21/08/2016 at 11:55 pm
My ex husband is now getting maintenance payments from me after threatening to "get messy" as I had started divorce proceedings against him. I don't have any contact with my daughter (not seen or heard anything for nine months) he will not encourage her to have anything to do with me or my whole family (this is a due to him gradually brainwashing my daughter) I'm just wondering why I'm even paying this as he has totally deleted me from her life, but us happy to take my money.
ChildSupportLaws Editor 11/08/2016 at 2:11 pm
You don't say if you have a family-based arrangement, if so there is little you can do except to contact the CMS and see whether you can claim child maintenance on top of the school fees, or suggest mediation to your ex as a way of trying to resolve the issue. Legal advice would be another option as much depends on the situation and whether your ex has taken an executive decision and not consulted you (as the other parent with PR) that maintenance would be stopped.

My son lives with me and see's his dad twice a week. He has been paying maintenance since he was about 2 years old. His dad is self employed but has quite a lot of money does very well. Our son is about to start private school (full fee paying place as suggested by his father). His father has now cancelled all maintenance payments to me and says this is because of his schooling. Any advice?

Hi, I have a son with my ex partner to whome i have never been married too. I have always financially supported my son, by paying trough the child support agency, now called child maintainance agency. The calculation has been made based on my P60.
I recently sold a flat and as a result I have made some capital gain, can you please clarify if my ex partner is in title to receive 15% of the income made?
In addition can you pleas explain if my ex partner was in title to receive additional contribution for a rental income of the flat I previously owned?

Or, more importantly than my comment below, why is the number of nights a fixed number on here and wide bands on the guide I mentioned below.

Thanks again.
Paul 12/07/2016 at 8:38 pm
Hi,

Why is the information presented here different from that in the CMS guide called "How we work out child maintenance" found on the .gov.uk site?

Your site states 15% of my NET weekly income and the guide says 12% of my TAXABLE GROSS weekly income.

Both give two different answers and if you use the calculator found on both websites I get a third, even higher number.

Thanks.

There is only so much your ex can demand in a family-based child maintenance agreement and if that amount is more than requested through the CMS, then it may be an option to set your ceiling through its level which can be accessed whichThere are no rules to specify what your ex is spending the money you contribute to your children on, as it may go towards unseen things such as gas, electricity and water bills and general keeping a roof over your childrens' heads. If you think your children are being neglected then you would need to seek legal advice regarding this.

Hi,
My daughter is 19 later on this year & has been at college for full time course in Beauty & has been accepted for full time Level 2 Hairdressing this year.
Her dad has paid maintenance willingly at slightly less than 15% for her(no other children involved on either side) but has all of a sudden halved it with no prior notice.
Can he do this?
ChildSupportLaws Editor 01/07/2016 at 10:07 am
If you’re the parent paying maintenance, and you have to pay travel costs or expenses, you may be entitled to apply for a variation. If your application is accepted, the CMS will make a new maintenance calculation, based on your gross income, less these expenses, please see CAB whichI hope this helps.

Hi, I am the non-resident parent and the mother lives in Switzerland (And is Swiss). She is asking for a lot of money but if she gets what she wants then it means I will be financially inable to see my child ever.
Is there a specific calculator or department that assists with such matters?
The UK calculators probably don't factor in air cost and hotel costs for visitations of child abroad, as I want to see my child as much as possible.
Thank you,

Hi my ex currently earns £5000 a week. I understand that the maintenence cap is at £2000. Do the CSA ever take this into account?
He left us with absolutely nothing? He took the family car, demanded that me and the children move or is the rented property we lived in together. I had to borrow money from family and friends to move, buy some second hand furniture, rental deposit.....

Initially he gave an overpayment which he insisted on even though I had repeatedly told him that he wasn't paying the correct amount. But he wanted to pay less per month and a larger amount at the beginning. He refuses any firm of communication apart from through a solicitor which I currently pay for. He has said that he will reclaim the overpayment if I ever contact him directly. I have adhered to this because I believe he would just stop the payments.

I work part time in a school as this fits around the children, but the nursery fees well exceed my pay. I do get government help with this and they pay up to 75%.

He does not have any contact with the children.

Would the CSA ever consider awarding a proportion of his actual earnings rather then capping the amount at nursery 40% of his earnings.
ChildSupportLaws Editor 27/06/2016 at 2:06 pm
You should call the CSA directly and report the change in circumstances

Hi my child will be 20 in November, I have been the absent parent and paying maintenance. However, my child has moved in with me due to poor relationship with my ex how do I go about stopping payments - I usually pay to the csa.
john 13/06/2016 at 11:29 am
For self employed people.what is included as an reasonable business expense, eg would csa take into account a personal loan which was used to purchase a work vehicle? .
ChildSupportLaws Editor 09/06/2016 at 10:32 am
You would have to contact the CMS regarding this.

Hi
My son pays through csa for 1 child (£120) and he has a private arrangement where he pays by direct debit (£100) for his 2nd child, monthly payments.
Will csa take into account the direct debit payment if he informs them.
The children have separate mother's my son is not with either mother.

Hi i wonder if any one could help me? I have been with my partner for 6 months, and we would like to move in with eachother. Up until now he has been supporting the ex and kids and house etc but recently has decided to get set csa payments set up and stop supporting the ex just his children. He has 2 kids with her and i was wondering if anyone new if he moves in with me then sets up the csa payments will they take my wage into account aswell? As much as i know they are his kids i do not want to pay maintenace for children that arent actually mine! Thanks for your help! X
ChildSupportLaws Editor 20/05/2016 at 10:52 am
You would have to ask the CMS directly regarding this. It may be that the case was reviewed on being taken over by the CMS and a discrepancy was found.
ChildSupportLaws Editor 19/05/2016 at 12:56 pm
You can see how much your ex should be paying via the CMS calculator here. I hope this helps.
Tammy 19/05/2016 at 8:59 am
Does the way that CMS calculates maintenance payments mean that resident parents that had a case with CSA will now be entitled to less than they were through CSA as I have just had to change my case over & with £60 outstanding from the CSA case & no payment this month the monthly Payments I receive now has gone down by £45 a month. Thanks
Debbie 18/05/2016 at 7:05 pm
Have just separated from husband 2 months ago. We have 3 children, he earns roughly £160 per week, plus overtime and putting 7% into a pension. He hasn't given me any money as yet but he says he only has to pay me £27 per week for ALL of the children... I know you can't give an exact figure, but does this sound reasonable or should it be more or less? Would rather settle this without needing to involve csa officially
ChildSupportLaws Editor 16/05/2016 at 10:38 am
I'm afraid we cannot give a clearer figure than the CSA/CMS can give. You may wish to contact the CSA/CMS directly.
bob 15/05/2016 at 10:31 am
please could someone help me work out how much I should be paying,
both ex partners have different figures and I have been on the csa Web site and got a different figure to them.

I just need some clarification on how much I need to pay.

thank you

Hello,
i am in the process of getting divorced and my ex wife and child still live in the marital property until the divorce is finalised. my ex has refused to contribute to the mortgage which is in my sole name and has now instructed the CMS to claim child maintenance. Will they take into account the mortgage payments i am making on the property they are living in when working out the Child maintenance?
Gaz 07/05/2016 at 10:05 pm
Hi ! I currently pay 243 a month for my sons childcare which goes straight to the nursery and then I give my ex 50 into her bank for my son ! I only have my son about 2 - 3 times a month and when I go to see him I have to travel 4 hours there and 4 hours back home . I used the calculator and it said I should pay 35 per week , does this cover childcare if I go through Csa and pay my ex ?
Partly30 06/05/2016 at 4:19 pm
My partners ex has the opportunity now to have custody of her son full time after 7 years but will not allow us to sell the marital home unless we give her £28k up front for maintenance for the next 6 years (and that takes him up to 18) has anyone done this before & can the ex still make a new claim if sshe uses all the money up? I mean we would get some sort of legal document but I have read these do not always stand up if she decides to make a claim against us. Advice would be great.
ChildSupportLaws Editor 03/05/2016 at 12:22 pm
Unless the circumstances have changed in either your son's wage, or the amount of time is sees his child then there is no need to notify the CMS as it will conduct an annual review, Please also I hope this helps.

I have a son with my ex and he has a daughter with another ex. He is paying us both £55 a week in maintenance. I've checked the csa calculator and the amount he has to pay is £114 a week. Is this between us or each?
ChildSupportLaws Editor 16/03/2016 at 12:47 pm
It's a very tricky situation if your ex is self-employed as there are certain ways in which he can avoid declaring too much income to the HMRC, please see CMS calculator here which can give you an approximate breakdown. You can also call one of its advisers who will help further.

Hi my 1 year olds father is working two self employed jobs , 1 he gets between £180/280 per week and sometimes more and the other job he get £1100 a month. He gives me 20 a week and sometimes 80 it depends but from we broke up he would only give me buttons if im lucky as his excuse is he needs money for travel. He has a daughter in a different relationship that he doesnt pay for as the mother moved the child to england. When i told him i was getting csa involed he said i would only get £30 pound a week if lucky im just wondering how much actually would i get for my daughter. I have her full tine on my own as he comes to visit her wen he feel like it.

Hi. My ex husband and i share custody of our now 11 year old daughter and she lives with him the majority of the time because at the time of our split i was working full time and he wasnt at all, it was the better option. Now i am in snother relationship and ive had another child i do not work and my exhusband does, but the living situation is still the same as he refuses to acknowlege that our daughter wants to live with me now. I havent been at work since july 2014 and i finished my mat leave in may 2015 after deciding not to return to work. I received a letter from the csa stating that i owe £1058 in missed payments even though i am unemployed, not claiming a penny in benefits and in the whole of 2015 she was with me over night for 153 nights. I am positive i called to tell them if my change of circumstances and im worried they are gona send balifs in for my belongings to pay what they say i owe.
I bend over backwards to accomodate my exhusbands needs, in the 4 and a half years that we have been split he has only brought her to my house 3 times, even when i was 8 months pregnant in the middle of August i had to walk 3 miles to pick her up and walk her home because he wouldnt even meet me half way never mind bring her to me. He owes me money that he refuses to pay and claims all the benefits he can aswell as work. She wants to live with me midweek and with him weekends but refuses to even speak to her about it, she is afraid of speaking up incase she "hurts his feelings".
If I have to pay a fine then ok, thats fine but i havent been working and surely dont owe anything.... Im very frustrated and feel like im being treated unfairly.

Hi I pay £30 per week to cms as I'm on a low wage. She doesn't think its enough, she thinks I should pay for after school fees and holiday clubs. I have my son on average two days a week and alternate weekends. She is now taking me to court which I'm very worried about it as I can't afford to pay anymore.I thought if the the cms were involved and have come with a figure that I shouldn't have to go to court. I also have never missed a payment. Could you shed some light on this please and tell where I stand on this situation. Thankyou
ChildSupportLaws Editor 25/02/2016 at 12:51 pm
I'm afraid there is little you can do if the HMRC verify his accounts. It is a problem that many parents face when attempting to claim child maintenance from the self-employed ex, as it is very difficult to prove.

Hi there
I've 3 kids and my ex paying me £309 through csa every month. My ex is self employed & got two fantastic famous Restaurant, the restaurant is busy all the time but when he told csa he minimise his income to £1,200 a month . I know he is lying but how can the CSA will find out? Do you think they can check his bussiness statement or other thing to find out the truth? Any help pls let me know.
ChildSupportLaws Editor 10/02/2016 at 12:07 pm
You can check how much you should be paying via the CMS calculator here. However, if you have fallen into arrears, the CSA or CMS can aim to collect all the arrears within two years and may ask you pay up to 40% of your income, depending on your circumstances and other financial commitments. If you think this arrangement is unfair and you're struggling financially, then you should prepare a financial statement which you can use to show what you can't afford and what you can afford to pay. You can take this up via the CSA/CMS complaints and appeals

I earn about £1200 a month have rent and bills to pay as well as food to live ! And csa take from me £456.99 a month ! Surely this can't be right ? I'm struggling to live as my csa payment is more than my rent ! Any advice ??
ChildSupportLaws Editor 09/02/2016 at 2:09 pm
While some people are content to make sure they provide for their family, (although perhaps not your ex) others do the opposite. Every parent has the basic responsibility to provide for their child up until the age of 16, when they are legally allowed to leave school and get a job. After this age, it depends what your child chooses to do. If they continue in full-time non-advanced education, not higher than A-level equivalent, for at least 12 hours a week, then your maintenance payments will continue until your child finishes the course (or turns 20, whichever comes first). You can stop paying child maintenance when child benefit is stopped. On another note, once your child reaches an age where they are more self-sufficient i.e aged 16 (if not at home) or 18, then you will be able to request your ex to sell the house, and financially split the asset, as it is no longer considered a family home. I hope this helps.

Have I been too good? friends say I am over generous. Have not lived at home for eight years but close by so see my two daughters four five times a week. ...taxi to and fro etc. No great animosity between me and wife & my concern is whilst at school my two daughters have a stable life and are secure. I moved out of family home a nice four bed house big garden etc and moved into a bedsit..........quite content as not materialistic.. I work pretty much 6 days a week self employed . I pay all family home mortgage / bills / pay for wife's car buy children's computers even car for 17 year old's birthday and am happy to do so....As both children are now close to university / leaving full time education would like to know when I can step down a bit. Whilst kids were at school my wife worked part time [10hrs a week] and I'd like her to step up a bit but as friends say she aint going to cos you are just too soft. Would like to know what my legal fiscal duties are when daughters are 16 and 18.

Thanks
ChildSupportLaws Editor 03/02/2016 at 2:51 pm
I think in this case I would have a word with the CMS here. You can speak with someone confidentially about the matter. While the CMS would prefer you to sort out your finances between you in a family-based arrangement, which is what you have in place already, it may be your ex is earning more and therefore would be eligible to pay more.

Hi
I divorced my husband after our daughter was born three months premature via an emergency cesarean and he refused to help financially whilst I was off work (I was a contractor at the time), so much so that I returned to work just two weeks later whilst our daughter was in hospital for a year.
Whilst working, I got the job substantively and never took any maternity leave (unpaid) when our daughter did come home. I carried on working.
He still refused to help financially - he was living in the house I bought prior to meeting him.
I then sold the house and bought another one that was a real family home all out of my money with not a penny from him - and it is only my name on the mortgage.
I then paid for the divorce after I uncovered him having an affair. He walked away with what he came with - nothing and did not request a share of the house - even though I could prove he never contributed to purchasing it or paying for it.
I agreed he could keep his pension.
He agreed to pay £50/week into our daughter's bank account by way of maintenance.
However - should he be contributing more due to fact I pay the mortgage tp keep a roof over her head (£1000/month)all the bills, childcare fees as I work full-time, sport club fees for our daughter, music tuition and additional support due to additional educational requirements due to our daughter being premature.
We have no communication so this is not something I can broach with this man, who is unreasonable at best of times, snd who has only ever said '£50/week is more than CSA would give you'.
He has also decided not to see his daughter for almost the past year as has not texted to confirm he will see her during the day one Saturday (he has never had her overnight, has refused). We don't know where he lives but believe he may still work for the same company and he may have got re-married.
Any advice you can give would be appreciated.
Best wishes
Any advice you can

My situation is incredibly bad, I split with a woman after a brief relationship, everything she had told to snare me was lies when I tried to amicably end things with her she announced she was pregnant and immediately set out on a massive hate and slander campaign, I went to the police 6 times in October 2014 and even done a statement on the 5th of November but the police seemed completely uninterested in helping, on the 6th of November the police shared an appeal and description for a sex attack that happened not far from my home (which apparently occurred 29th of September 2014) I will add at this point I was still in a relationship with said women and have evidence to prove I was with her that evening. On the 6th of November she uploaded Kate perrys dark horse a song about revenge to her Facebook page with the words 'so flipping true' and a winking emoji face. I saw the post at time via a fake id set up to monitor the online slander and wondered what the psycho had done next.......I was to find out the next day, 2 plain clothes officers were repeatedly knocking my door so I went and answered, my first words were...this is to do with (name withheld) the officers immediately lied with 'no can we come in' frightened I let them in on which they announced they were arresting me for rape on a 13 yr old girl i cannot describe how awful the next 24 hours were, upon my release (the victim didn't pick me out of id parade which obviously she wouldn't when I was only there as an act of revenge) I tried to file a complaint against the woman for maliciously diverting an investigation but they refused to listen and still had the nerve to bail me on original charge to my home address where I lived in sheer terror whilst filing multiple complaints against the force. All the while the woman's online harassment of threats and slander continued but as now I was a suspected 'rapist' officers would not even come to look at evidence. The first investigation revealed multiple facts and also the error that caused my arrest. Basically the anonymous crime stoppers line has certain measures to rule out what's. Malicious and what is possibly good info. The arresting officers acted without checking any background they offered an apology and a feeble amount of compo and stated that the women won't be investigated as they can't say she made the call it's a loophole in the system I have battled and battled the police over this to no avail corruption is rife in this force protecting there precious hotline is more important than prosecuting a dangerous sociopath. Even the police believed the child she was carrying was not mine but she contacted csa 3 months after he was born and I paid for a DNA test..,. To my absolute astonishment it turns out to be mine, although someone I knew had met this women in hospital and in there she was telling everyone the father was a nightclub doorman so it makes sense why she was so hell bent on destroying me as she doubted I was the

I have recently stopped communication with my sons dad and am concerned about the arrangement we have had in the past and how it will continue. I have never lived with my sons father and for 8 years he has payed my£150 per month. I did not challenge this as i did not want to rock the boat but now i realise i have been under paid as for 6 of those years he earned 45,000 net. Can i claim retrospectivly for the shortfall?
Also, now he is earning a wage form a group run by a group of trustees. Will this effect my claim in terms of direct from wages as he is not employed by a 'company' but a community group? Also, the rest of his income is from occupational pensions. Will this count as earnings and can i claim direct from this too?
with thanks

ChildSupportLaws Editor 08/01/2016 at 12:35 pm
I'm afraid we do not have this information as we do not do the calculations. Your partner would have to go directly to the CSA for this information. If you partner has a family-based arrangement, there are no specific rules as payment would be decided mutually.

I earn between 1500 and 1700 pounds a month depending on overtime. My ex partner has came up with a figure that she claims the csa will take each month. What would I actually pay? With all my expenses each month just to live egg rent, gas, electricity, car Insurance, food, water and so on, it comes to 1420 month that I pay out. I'm hardly left with much income to spend myself. Could you give a rough but as close to accurate figure please? As I pay 200 a month now out of our own agreement together. In a recent dispute she claimed they would take 205 a month off me.
Lisa 07/01/2016 at 6:41 pm
My partners ex has received £100 pw consistently for the last 5 yrs for the 2 children when assessing how much he should have paid each week and should now pay do you look at previous years rates and assess wether overpaid that year and or underpaid to backdate any over/underpayment. If so what are the rates for 2 children from 2010 to date.
Thanks
ChildSupportLaws Editor 07/01/2016 at 12:45 pm
He may be eligible to apply for a special expenses variation. Please see CAB whichI hope this helps.

My partner will have to pay around £130-£140 to csa, he already pays £100 on travelling to pick his child up. Will this be taken into account?
ChildSupportLaws Editor 06/01/2016 at 12:36 pm
No, only your ex's earnings will be taken into consideration regarding the support of your children, as your children's welfare is not the responsibility of your ex's new partner.

Hi if my ex husband moves in with his new partner. Will her wages be taken into account now thay have a joint income?
ChildSupportLaws Editor 04/01/2016 at 2:07 pm
I'm afraid if he is on benefits, then the most you would be entitled to is a flat rate of payment. If his gross weekly income is between £7 and £100, then he may be eligible to pay a flat rate of £5 a week.

No, regardless of whether she is re-married or not, the biological father still has to support his child.

I have a question of what happens if I marry my current girlfriend.
She has a young child from her ex (they were never married).
He pay a small amount as child support (the not that) & have visitation rights (every two weeks for one night).
Will she lose her child support from the child's biological father ?
ChildSupportLaws Editor 08/12/2015 at 11:28 am
I'm afraid there are no rules and you would have to decide what works best between you if you wanted a family-based arrangement. However, if you wanted a more official arrangement, you would have to apply via the CMS

My ex husband is a self employed taxi driver and has stopped paying maintenance. He said that it will be very difficult to get money from him as he only declares earnings he wants to and when his accounts are done then I will be entitled to nothing!!!!!
ChildSupportLaws Editor 30/11/2015 at 10:35 am
Yes, child support is a separate matter and it is your ex-husbands responsibility to help to support his children. Should you need any further advice, please contact the Child Maintenance Service helpline via whichI hope this helps.

My husband and I split up and in the process of a applying for a divorce. He has our son stay over 1-2 nights a week. But he doesn't see he should pay child support. We took out three credit cards over the time of being married but all are in his name. I have offered to make payments towards one. We also have some things on credit that still needs to be paid off. He wants me to help pay towards the rest of the credit cards and things on credit each month by transferring him the money. And he says he shouldn't have to pay child support because of him paying the debts off. I can't afford to send him £60 a month and supply full support financially for my son. My question is Should my ex pay child support after all what he says?
ChildSupportLaws Editor 25/11/2015 at 2:02 pm
You would have to contact the CSA directly, but yes, it is likely the child maintenance you receive will be re-assessed accordingly.
Lin 24/11/2015 at 9:38 pm
Hi
I have two teenage children by my ex who has re married, he pays CSA for both children but has just adopted a child, will my payments now be reduced for my children due to him adopting?
ChildSupportLaws Editor 17/11/2015 at 12:06 pm
I'm afraid it is out of your control, as whether she wants to keep the child or not is her decision. Whether you have anything to do with your child t is entirely up to you (and your ex). However, you may still be financially responsible, should your ex choose to apply for child maintenance and cite you as the biological father.

My ex told me she was pregnant 2 weeks after we split up I said I did not want to keep the baby due to the situation she said she was going to keep it anyway as weapon against me how so I stand now I do not want anything to do with her or the child !

Hi My expartner pays £40 a week but sending me half of that some weeks when goes on sick pay is that correct you only meant to get half of money for my child if hes on sick pay for a week?
ChildSupportLaws Editor 09/11/2015 at 11:35 am
Every parent has the basic responsibility to provide for their child up until the age of 16, when they are legally allowed to leave school and get a job. After this age, it depends what your child chooses to do. If they continue in full-time non-advanced education, not higher than A-level equivalent, for at least 12 hours a week, then your maintenance payments will continue until your child finishes or until they turn 20. In 2013 the law changed, making it compulsory for all UK children to continue in some kind of further education until the age of 18. This is not necessarily a full time college course - it can be an apprenticeship or full time employment (over 20 hours a week) that includes some education or training. There are certain higher education courses, such as apprenticeships, that do not count as full-time education, so it is important that you check with the CSA. If your son decides aged 16 that he wants to get a job and not continue in full-time education - which includes studying for 12 hours or more a week - then your payments would officially end in the September after his final school term. I hope this helps.

At what age do I stop paying maintaince ??
My lad is 15 at the moment
ChildSupportLaws Editor 04/11/2015 at 11:12 am
You don't say whether this is a family-based arrangement, or not. However, you can see how much you should be paying via the Child Maintenance Options calculator here.
Tofy 03/11/2015 at 5:40 am
I've been paying higher payments since I left in June 14, as this was what she wanted to cover living costs as well as maintaince payments. I can't continue paying for all these costs not due to financial issues, I just don't see why I should be paying for her living costs, I'm told I'm obligated to keep a roof over his head and heating in the house. What's your opinion on this?

I have recently moved in with my partner can CSA take my partners earnings in to account?
Adam S 14/10/2015 at 12:46 am
Hi,

I have a amicable relationship with my X partner (we are not married) we have a wee toddler and I have used the HMRC calculator to work out what my obligation should be according to the law.

My partner is the stay at home Mother and she also works around 15 hours a week.
Her salary is not enough to rent a place for herself and our child.

She has told me that legally I am obliged to pay approximately £750 PCM towards her rent on top of the £600 that I will already pay her.

According to her if she claims housing benefit the monies paid to her via the benefits will be taken from my wages.

With me paying out the best part of £1.5k a month it makes it real tough to live to a half decent standard myself.

I cannot find anywhere online that substantiate that claim and I was wondering if anyone else is in this situation that can help me find out what the correct procedure is.

any pointers in to the right direction would be of great help,

If you are unemployed, then such changes in your circumstances may mean a change to the amount of child maintenance you pay or receive. As specified in the article, if you are unemployed then you may not have to pay child support. If your earnings are £7 to £100, or if you, the paying parent gets benefits, then you would pay at flat rate. I hope this helps.

Please advise my ex has been reducing his net take home pay by buying into a company share scheme at full wack for yrs and I therefore have had a reduced amount of csa and no cash or benefit wen those shares are sold. Is that right? Do they just look at net pay after tax etc?
Rich Editor 16/09/2015 at 3:08 pm
@Chally - The CSA is averaged out across the year regarding what you should pay. Any extras are negotiable between you and the ex. So it depends if you want to put your hand in your pocket. At least if you are paying the correct amount and she goes to the CSA, she won't benefit any further!
Chally 15/09/2015 at 8:00 pm
Hi my ex and I used csa calculator, and agreed I would pay that amount, straight to her to avoid fees. Our son wants to go on a school trip, and my ex wants me to pay half or she will go to csa for extra, surely what I pay per month should cover the trip ?
ChildSupportLaws Editor 07/09/2015 at 11:56 am
Yes, you can either calculate via the CMS Options calculator, whichIf you do not wish to contact the CMS directly, you could try the Citizens Advice Bureau or Family Lives who may be able to give you some further advice
ChildSupportLaws Editor 04/09/2015 at 2:30 pm
You need to inform the CSA that she is not giving any details in order that you can pay the amount agreed. If the CSA is charging you interest for a situation that is not your fault, you can complain via whichGiven you are also on a part-time wage, it sounds rather a lot, therefore please see the link to the Child Maintenance Calculator here which should tell you how much you should be paying.

advice needed I am on a part time wage and now CSA on my case got told this week when they phoned I have to start paying £313.82 per month for 1 child I have been saving every month but the mother of the child is refusing to give them her bank details so I can start paying but now im getting penalised for this and keep adding on 20% onto my bill surely this is against the law it needs closed down and the government needs to look into things not even seen my daughter in 15 years and they had the cheek to say do I have contact for me to get her bank details to start paying her ADVICE PLZ
ChildSupportLaws Editor 03/09/2015 at 1:55 pm
I'm afraid if he is in receipt of benefits then it would be considered he does not have the money to pay for child support so he would be awarded a nil or flat rate status. There is little you can do here as child support payments are based upon the non-resident parent's earnings .
Kat 02/09/2015 at 8:02 pm
Hi.
I live in the Cayman Islands, my son is 10yrs old.
When our son was born, he signed an agreement (which I still have a copy of) stating that he would pay $80KYD per week. This was witnessed and notarized by a local Justice of Peace (JP). His father has never paid child support. And he moved to Bristol England, when our son was just over 1yr old.

I have tried through local agencies to have this enforced, but to no avail and I have given up.

And advice? Please?
He lives off of the UK government, he refuses to find work, he collects whatever welfare he can. AND now he has 3 other children.

This means my son gets left behind, doesn't it?

BenJ Editor 11/08/2015 at 12:37 pm
Child maintenance is usually calculated by averaging the payments out over the year. The non-resident parent is still usually expected to still pay child support, unless otherwise arranged between the parents. But, given the child is on holiday with the father and he is catering/paying for her day-to-day needs many parents agree between them for the non-resident payment to halt paying over this time, as the money is for the care of the child, not for the mother.
Kit 09/08/2015 at 9:12 am
My ex pays child maintenance for his daughter but he refuses to pay if she is on holiday with either him or his mother - is this right? Or is child maintenance still payable ?
Thank you
Ado 06/08/2015 at 11:06 am
Been paying £40 a week for years, and struggle what's left after paying bills... Why is it that if I get a better payed job what's worth £800 a week that you take more off me just cause I earn more and got 2 kids at home. Why is it that, that child is worth more than my other two at home for really the parent to spend on themselves other than my child.

He works for at least 15 fulltime weeks a year plus every Saturday. And i still struggle to get anything off him moneywise even when he is working during the holidays. And now he is talking about buying a new car next year?! Where do i stand because i am getting sick of him using his student status as a 'get out of jail free' card. Thankyou.

Advice required please. I have 2 children with my estranged husband. My eldest child has a disability and I receive DLA on their behalf plus carers allowance, housing benefit, income support, tax credits and child benefit. When we separated we agreed to have shared care of our children. This means that we both have them 7 nights out of 14. I agreed that because of this arrangement I would not seek any maintenance. I would also keep the child benefit and DLA however I would provide all the children's clothes, shoes, school trips etc and that the DLA would be used for whatever was needed for our child with additional needs.
Recently things have not been great between me and my ex and communication is almost nil. Because he works full time I have both of the children after school every day until he comes to collect them after work if it is his night to have them (5.30 ish). I also have them every inset day (7 per academic year), plus most of the school holidays (13 weeks off per year and he has them for 3!). If either of them are off school sick I also have them. If he takes a days leave from work and it is the school holidays he still doesn't have them that day even if it is his night to have them, he still comes to collect them at 5.30ish.
I have recently discovered that he is moving in with his new partner and her children. So my question is, should I now approach him for maintenance? My youngest child has said that they won't want to live with him and his new partner for 50% of the nights (child is old enough and intelligent enough to make that choice).
The other thing is that although they may spend several nights a week with my ex he clearly is not doing his fair share of parental responsibilities. I have spoken to him and said that the care of our children is not 50:50 however the response I always get is that he works and I don't however I am unable to work at this time because I have a child with a disability. I would love to work and be able to support myself and my children however that is not an option. Any advice would be gratefully received.

My ex is self employed and always told me if we ever split I'd never see a penny. He's right in that I only gt £5 a week for his 2 children. He has had holidays abroad, drives a decent car and the new partner has a holiday cottage. The new partner also "works" with him so I guess she is getting a larger "wage" than he gets yet the income is jointly shared between them. Is there anything I can do about this. He doesn't pay anything else towards his children so I pay for all school items including uniforms and all school trips as he always pleads poverty if I ask him for a bit of assistance. Getting fed up with him trying to bully me about issues regarding he children when he doesn't help me fund them!

He has recently changed job to work for an agency as a stop gap too a better job comes along, he now only brings home £250 a week and csa want him to pay at least £41 which is the £1000 a month yet after important bills ie rent ctax gas electric car tax car insurance that's his wages gone ? Can this be right ?

My partner pays £100 maintenance a month (2012 scheme) and is leaving work to go back to full-time education in September. We know that he will then qualify for the nil rate (which will be temporary because he will be working again from next July. My question is IF his ex-partner applies for a variation what other income will they look at? Is it just his or mine included? I am a full-time university student with a child ourselves that we have struggled to support the past year due to lack of money! Yet we see her continuously buying herself new clothes/trainers. He has contact with his children also on a regular basis with overnight stays (although she did want to keep this to a minimum for more money, even states that in the court papers)

I have a 15 year old daughter, I have paid for her maintenance since her birth, by arrangement and then through the CSA. I have maintained contact and have tried to be a part of her life but this is becoming strained as her mother is stressed and I fell like I am constantly under threat of a review of my monthly payments. I earn approx £1,600 per month and pay CSA £200 per month which is always paid on time and am curious as to what any review of my payments may be. I have no other dependants , have an average mortgage, pay into a pension etc.
thanks .

I assume your wages are £17500 gross? Then you will be paying roughly £173 per month based on seeing your daughter and her staying over average 1 night per week. This is on the assumption that she is still in full time education.

My partner has his children (sleep over) 6 days out of two weeks, he pays for their schools meals, activities, other school fees, activities with their mother (camping) clothes, christmas/birthday presents, etc, we pay for the same things when they are with us.
They were are cohabiting couple and have parted on bad terms, she has asked for a monthly maintenance fee so that 'she can live, and that the children don't lose out, she only works two days a week and the boys are both in full time school, she refuses to get more work.
She is about to move into a large house with her boyfriend and is still expecting this monthly allowance from my partner, he currently does not give her anything as he pays for all these things for the children, he also is still paying for the house they own together that he does not live in or her. She is also asking for money for rent that she has paid since she has moved out!

What are my partners rights with these extortionate demands?

@boo - if you are claiming maintenance through a family-based arrangement, then the figure is negiotiable. However, you don't say whether he has given a reason for the drop. If you think it unfair, then you could go through the CMS in order to make his payment official, but this does cost and it may end up that he is paying less once the costs are factored in. However, you can contact the CMS via the link here if you wish to speak to someone about this further. I hope this helps.

ChildSupportLaws Editor 03/06/2015 at 12:05 pm
@johnnyboy - you can check through the Child Maintenance Options calculator via the link here how much you should be paying. You can apply for access through the courts should you want regular contact with your child. If granted, this would make the contact official and if your ex denied access once a court order was issued, then she would be in breach. In addition, if you do pay maintenance under this obviously very precarious family-based agreement, then make sure you are not paying cash, as should you ever need to prove it through the courts then you wouldn't be able to. I hope this helps.

i have one child with an ex partner. Been apart for a long time I was paying her cash weekly for my child. I have finally moved on and settled after a period of time. She got wind of that, very jealous stopped any contact with my child. Still expecting payment I complied and soon realised no money was going to my child. I stopped payments to her, unless I could have access. I would continue payments. She never complied. Of late after 10 months she has started making contact and bartering with my child asking for money. I have started paying again yet she is still making excuses and I have had my child for ten minutes in 10 months. Other than going through courts. What is the amount I should pay officially.

Hi, my daughter and partner split. They have two children and my daughter and he both work. My daughter pays the mortgage on the house and bills including nursery fees as child care, but it would appear that 'dad' is only liable for £31.00 per week as he has them for 2/3 nights a week. He was paying more through their own private arrangement but he's now refusing to pay and with £31 per week she won't be able to afford to pay the bills. Is this taken in account with payments? Thank you

@Trojan - When working out net income, the CSA exclude the income of any partner living with the parent. But, they may take into account the contributions he makes to the household income, or his protected income, which might affect how much he has to pay.
Trojan 12/05/2015 at 5:19 pm
Hi there, my ex husband currently pays maintenance for our 2 children. If he moves in with his girlfriend (who has 2 children herself , no relation to him. She works full time and receives a small amount of maintenance from her ex for her own children) would this then affect how much maintenance he pays me?
ChildSupportLaws Editor 12/05/2015 at 12:40 pm
@Tanky - you can see how much you should be paying via the Child Maintenance Options calculator here. Yes, your maintenance payments would be calculated solely upon your income and as a percentage of it. You can also ring up and speak to an advisor should you have any further questions to ask. I hope this helps.
Tanky 10/05/2015 at 8:59 am
Hi,after I pay my bills including child maintenance then I am left with £40 a week to live on. With this I have to get food petrol etc. Myself and my ex-wife came to an agreement over the amount of money I would pay. But would the CSA take in to account my overall financial situation? Also for example during the Easter holidays I had my children for two weeks which meant an increase in petrol and food costs. Should the figure payed be adjusted to reflect this

My child support payments are ridiculously high nearly 50% of my earnings...is this legal! They leave me with no money every month can't even afford get a birthday or Xmas presents...my child doesn't speak to me anymore because she thinks I don't love her...I've tried explaining that CSA takes so much money that I can barely feed myself!! Thanks CSA

I have one son whose biological father is currently in Australia for a 18 month work visa. Can csa still collect from him as his payments are irregular and low. I am aware he is on a good salary over there.

Hi, my daughters father is currently not working and on jsa but has been employed on and off over the past year. I have just submitted a claim to csa and was wondering If I will only receive the flat rate of £5 per week or If they take into account his income when he was working over the year when calculating what he should pay? Thanks

Hi, my son earns £260.00 per week before tax, and after pension contributions. he has one child at home with his partner and one that lives with ex-wife. how much maintenance should he be paying? he receives no other benefits. thanks, Sally
Rich Editor 13/04/2015 at 12:16 pm
@Cj - is it a family-based arrangement? If so it is just a matter of trying to get him to agree, you could tell him you are closing the bank account and send him your new details. If it is paid through the CSA/CMS, then you really need to get on to either one in order to try and sort it out. But, I don't think there is anything you can 'legally' do.

Many Thanks

My daughter's father lives in Ireland,Athlone. My and my10year old live in Edinbirgh.
He pays alimony to my Lithuanian (as we are lithuanians) account 68 euros pcm.
I asked him many times could he transfer money into my UK account, but he always find reasons not to do so,because it is so convenient for him.
Is there a legal way to obligate him to do so?

Many Thanks

It amazes me that people are moaning about giving £120 a week or so towards their child- part of the maintenance payment is towards housing the child.....then on top of that food, bills, even childcare....how does £120 even touch what it costs? Get a grip!!!!
ChildSupportLaws Editor 07/04/2015 at 1:52 pm
@HJS - you don't say how old your son is and why you have been paying it directly to him. If the CSA says you owe money then you should really take it up directly with the CSA. I'm a little confused at your question. Would it not be a good idea to pay off the arrears and the mother what you owe for your son's upkeep as assessed by the CSA? You say the mother is asking for £30K, do you owe her this money? Be aware that if she says she will 'leave you alone' if she gets the money, is only a verbal agreement and holds no weight whatsoever. If you have other outstanding financial issues with your ex and they are getting a touch messy, then it may be worth going through the courts in order to sort both this and the child maintenance out. I hope this helps.
HJS 03/04/2015 at 11:34 pm
Hi, Ive been paying regular payments to my eldest son, however I have not being paying the mother. We had an arrangement 2 to 3 years ago where I gave her several thousand pounds and a car total say 10k. Ive always sent 300 a month. I spoke to my son recently and he said she has stated she wants 30k and will leave me alone for good. She lost us our house through not paying the mortgage and bills and also had an affair. No one will take this into account, however I'm in a position now to pay her whatever the past, the kids come first. This is now having a detrimental effect on my stable relationship, but I'm willing to pay if its reasonable, say from 800 to 1000 a month. When I attempt to talk to the CSA they just ignore everything previous and state that I owe several thousand pounds. I am more than willing to give the mother regular monthly payments of 1000 pounds. I live off shore and have a new family and support a family of 4. My question is, how do I arrange the payments? is it through the courts or through CSA.
Kind regards

My partner pays £200 a month for his 2 children, who live with their mother. However, we are expecting a baby in the next month and wondered would his payments be reduced as he has another child to pay for or would he still be made to pay £200?

@Bigbill - if you are unhappy with the service from the CSA and you don't think this estimate is fair because you have been receiving JSA, then you can complain via whichI hope this helps.
Bigbill 17/03/2015 at 6:30 pm
Gets a phone call you owe us £2700 and then came out with it's actually £4780 for periods I was getting jsa and they wasn't taking any money out of it why has this happened and is it right ? And it's got to be payed back within 2 years
ChildSupportLaws Editor 13/03/2015 at 12:23 pm
@fathernorights - yes, you will have to still support your son wherever your ex lives. I am sorry to hear about the breach of court order, which you will have to take back to court. If you do not have the funds and it will go through a UK court, then you can self-litigate, see link Legal Aid Withdrawal: How to Represent Yourself here. I hope this helps.

Hello.
I am foreigner awaiting paternity results from a UK fling - I am willing to support financially only, with an amount deemed fair and just by an adjudicator.
I am focusing on rebuilding the damage I did to my wife and children.

may be 10 years ago I had a very low pad job less than 200 a week after tax and most times before tax so I only payed 25 pound I have never missed a payment I have always used the csa I only had one child then lost my job and signed on than got new job told the csa and my payment restarted was only paying 25 again then about 2/3 years later they asked for about 3.500 pound in unpaid payments was no discussion thay just made me pay they had most of my wage left me with 103.29 a week for nearly a year I did some over time lots nearly killed me and still don't understand if it was a cock up on their half I don't think I should of had to be the one to suffer.

@Augusta13 - The UK has Reciprocal Enforcement of Maintenance Orders (REMO) with a number of other countries. Austrialia is on the list, therefore I have included a gov.uk link herewhich gives you extra information on how you can enforce a maintenence decision. I hope this helps.

Bit of advice, my sons father recently emigrated with his new family to Australia, I was informed by the csa that his payments had stopped and they closed our case here, he's not forwarded any new address or contact information. How do I go about into trying to track him down out there as he's not set up anything else
ChildSupportLaws Editor 23/02/2015 at 10:53 am
@Mug - if you are unhappy with the service you have recieved, then you can complain. You should have been put on a reduced rate when you were unemployed. I hope this helps.

Basically I'm having money taken out my wages. I lost my job informed csa and signed on 1month later I was given my job back and again I got in touch with then. 3 months later I got a letter stating they are taking 400£ a month I've spoke to them about this and nobody cares it's just not fair
ChildSupportLaws Editor 18/02/2015 at 3:04 pm
@Marc - yes, if you are a paying parent then the CMS can re-assess the amount of child maintenance you are paying if you have special expenses of more than £10 a week, or £15 if your income is £200 or more. It comes under 'other financial commitments', I hope this helps.

Hi I have a 8 years old son who lives 80 miles away. I have been paying around £250 a month until 2 years ago to his mother, however as Im self employed, this as become irregular due to poor trading ect. I still see my son on average every 3 weeks, however his mother never drop him off, or half way. It's a 320 miles journey to pick him up on a Friday them drop him back on a sunday, costing around £80 in petrol. Could some of that be part of child maintenance? Also, his mum would send him down without spare clothes (I used to buy him loads of clothes/shoes ect before), so I had to ensure he has all he needs at my house, specially if we go away on holidays. Can this also be taken into account as child maintenance? Thanks
ChildSupportLaws Editor 18/02/2015 at 2:48 pm
@Ok Dad - it comes under the legislation of REMO which as stated by NI Direct is the process by which maintenance orders made by UK courts on behalf of UK residents which can be registered and enforced by the courts or other authorities in other countries. It also states that this is a reciprocal arrangement which means that foreign maintenance orders in favour of individuals abroad can be registered and enforced by UK courts against UK residents. For more information please see the NIDirect whichI hope this helps.

I separated in 2008 and CSA has been in place since 2009. I have not seen my children since 2012. I have heard from a third party that they may have been removed from the UK and are now living in Spain. Am I still liable to pay CSA for UK non-resident children?
Danny Editor 13/02/2015 at 3:00 pm
@Joncross - only if she declares that you are paying the loan, and or you can prove that the loan went to her. Can't you agree the maintenance between you, and take into account this loan?
Joncross 12/02/2015 at 11:26 pm
Please could I have some assistance.
I separated from my sons mother about 5 to 6 years ago. We have always had a good relationship after this. A couple of years ago she asked me to guarantee a loan for her to buy a car and to help with Christmas for my son and her other children. I did this but my ex stopped making the payments which meant I had to. The loan had a huge interest rate on it so I decided to tak a personal loan out my self to pay this off. The payment for the new loan is 110 per month. I then agreed with my ex that instead of her paying the loan I would use her maintenance (100per month) I usually pay her to pay the loan that she agreed to
All was well until recently, where now I think she will want to claim maintenance through the csa.
Do you think the loan payment will be taken into consideration when calculating how much I have to pay? I have done some research which suggests it could be but suggests only if we were still together when the loan was took out.
I have my son every weekend fri to sun and occasionally sun night.
Thanks

I would just like some information as I don't agree with having to pay for csa when I have my daughter 3 nights a week and the mother has her 4 nights. The mother claims every benefit going including disability allowance for my daughter as she has a very mild case of cerybal paulsy. Baring in mind I don't live in the same town as my daughter so I have to travel every weekend there and back on a coach. I pay for everything my daughter needs when she is in my care. I don't get any help from any one for my daughter. I have recently just been through court for full custody of my daughter as the mother had her put on a child protection plan by social services because she is suffering emotional abuse she's still on the plan now. And I didn't win custody this world is one messed up place. That cost me thousands and I'm still paying the debt now. Why do I have to pay her money yes I work but I get 6.50 a hour and not even getting my full weeks work as Thers not enough.

Can you give me a rough idea regarding my current payments to my EX.
I earn 25.000 pounds per year and take home roughly 415 pounds per week. I pay 120 pounds per week to my EX she works full time and earns 27000 pounds per year, she receives child allowance and claims child tax credits, she is doing ok. I have my son at least one night a week and several afternoons every week, what would I expect to pay if I contacted the CSA and why. Thanks in advance Laddox

This system is corrupt, grossly unfair and flawed. I have two children with one mother whom I was in a relationship with for thirteen years and have payed direct maintenance to but also spend a lot of time with my kids. I have another young daughter from a three year relationship with a bitter, vindictive, alcoholic mother who refuses me access even by telephone. Until six months ago I was paying her directly too before she cut me off from my little girl completely. Now she has filed for payment. The CSA and CMS took £430 in one week out of my wages the week before xmas for one six year old daughter. After lengthy conversations with the aforementioned parties informing them of my financial commitment to my other two kids, one of whom they already knew about, they said that I would now pay a combined 19% between the three children. In the meantime they have now written to the directly paid mother giving her details of my earnings (where is my data protection?), informed her that I must pay £145.44 every week until the end of 2015 (but my earnings differ week to week and there was no mention of percentages). The other mother is being overpaid and given 39 days to respond to the updated transfer from the CSA under the 1993 scheme to the CMS under the 2012 scheme. I am just inside the 40% tax bracket and get raped by the taxman each week. In turn... The CMS are now raping me by granting what looks like 25% OF MY GROSS to both mothers including one who won't let me see my daughter. These departments are committing daylight robbery. If I was to become unemployed tomorrow after paying taxes all my life I would be awarded an embarrassing amount of around £60 to survive each week as an adult. My six year old daughter is getting £117 a week from me when her mother is earing £25000 per annum. This is to a mother that has no reason other than being spiteful for not letting me see my little girl. All the agencies are interested in is the money Instead of focusing on the lives instead.

Good afternoon. I live in England. My ex partner is responsible for and is currently paying CM through the CMA DIRECT PAY for our 1 year old daughter. There is a very strong possibility that he will be emigrating to Canada next year. Would it be a good idea for me to get a Notice of [intention to proceed with] an application for a financial order or court ordered child maintenance in place now, in the event that he leaves and stops payment?
Many thanks.

Hi my partner is paying csa for his older 2 children. His 17 year old daughter goes to college, but works around 21 hours per week. We have 2 children of our own. Our son has talipes and we have to make weekly trips to hospital which is a 40 minute drive so have petrol and parking costs. We also have an autistic daughter. Should he still be paying CSA for his daughter, even though she is earning her own money? And also will the CSA take into account the extra expense involved with having 2 disabled children? I agree he should pay for his other children, but it is coming at the expense of our children as we can barely afford to eat!
ChildSupportLaws Editor 07/01/2015 at 2:02 pm
@Ace - no. If she is not longer in full-time education then you can stop paying if she is 16 or over and getting certain state benefits - including Income Support, or if she stops being eligible for Child Benefit, or if
the parent receiving the payment stops being the main carer of the child. I hope this helps.

@Tan - Many people who are self employed see it as a way of escaping payments through disguising their earnings which reduced the amount they owe to the CSA. The CSA takes the amount from the most recent tax return. Unfortunately, self employed people who want to avoid paying CSA will try to declare as little as possible in their tax return in order to pay both less tax and child support.
tan 09/12/2014 at 8:05 pm
It would seem the csa benefit the wealthy and victimise the poor. A non resident employed parent earning £20.000 a year has to pay £40 a week maintenance for one child per week. Yet a self employed person, such as my ex, gloats and mocks me about only having to contribute £10 per week when he earn £50.000 per year. Disgraceful.

I think it's very UnFair how csa work. They don't care about the non resident parent.. They just want to bleed them dry.. The non resident parent moves on and begins a new family, wife children etc and the csa use his income including working tax credits if he recieves them which is fine BUT.. Not his other children's child tax credit benefits..as the residential parent obviously is claiming child tax credits anyway..I'm all for supporting kids after seperation but what I think is totally wrong is how CSA use the child' tax credits and class it as your income.. Obviously it's there as a benefit for children for a reason..so what gives them the right to take money away from this??? Did you no csa and child maintenance are to different organisations??Where as child maintenance does not class child tax credits as your income so why does the csa??this needs to be stopped It's a Terrible organisation what is 1sided
koppel 30/10/2014 at 4:03 pm
Personally i think that mothers who have full custody and are in reciept of csa should get it knocked off the child tax and child benefit also theier income should be taken into consideration. i have an 8 y o lad whom i dont see after an 18 month court battle and visits to contact centres ended when the government got rid of legal aid. My ex knew i didnt have the money to continue with it so basically stuck 2 fingers up at me. I recieved a letter from the csa to say they want £40 a week off me plus money for arrears. I am all for supporting my child but what they are asking for is scandalous. I bike it 7 miles to work and 7 miles home in wind rain snow or shine as i cant affford to run a car. setting off @ 5am and getting home @7pm for £250 a week. My partner has 2 children and i try to support them all and run the house on just my wage. My partner cant work yet as her daughter is to young for full time school and we cant afford childcare. We struggle along whilst that c**t sits there raking in 2 wages (1 off its new partner] benefits .plus has 2 cars and a mortgage. the law stinks and so does csa. your better off not working
Sarah 30/10/2014 at 3:46 pm
This system is a joke! Who runs on organisation like this?? Its about time the government pulled their fingers out sat on a pile of money at home forcing dads to be homeless whilst the mothers laughing all the way to the bank, every father should pay for their child but not half a wage! COME ON open your eyes dads need to live to! I have two children and would never use the csa on my ex because I dont hate him enough to put him in an early grave and steal his money. Csa should be used as an alternative if you agree to give up your benifits, its one or the other its wrong to be claiming so many benefits plus juicing your ex's wage to a point where he would be better off on the dole than working. I feel ashamed to bring my kids up in a world like this with this disgusting government, and even more so how are csa even aloud to operate this way?! Any mother who tries to argue against this should also be ashamed nobody should be aloud to work for nothing, women play the system because they can.

Hi i have a 4 yr old daughter who livez with me.. her father and i split up when she was 14months old. He pays anything from £0 - £20 a week for her. He is self employed with safestyle and says its comission based so if no sales then no wage for him so child gets nothing. Would going to csa be a benefit for me? The father gets cash in hand and has no bank account.
ChildSupportLaws Editor 17/10/2014 at 2:51 pm
@Robert. It depends on what your income is - but as shown on our website if a non-resident parent earns £200 or more per week, the CSA calculates the amount of maintenance they should pay as a percentage of their net weekly income. For one child, this is 15%, for two children this is 20% and for three or more children it is 25%. I hope this helps.
Robert 16/10/2014 at 9:16 pm
I have 2 children by differ t mothers. I've always paid maintenance to the mother my first child and we've had a verbal agreement that has worked well. I've just separated from my current partner and my second child and wish to pay maintanance. What % of my net income should I pay for my second child? Do I pay 10% of net for each child (20% total) or is there a set amount that I am obliged to pay for each child?

Question- Contrary to Equality Act 2010 - I have just Established that contrary to this Act I am Disabled as I have had cancer. I was Medically retired from the Police and receive a Pension- For many years CSA have taken this in to Account as Income- And would not accept that I was classified as Disabled . Should this Income be taken in to Consideration? for CSA Purposes?
Mumoftwo 12/10/2014 at 8:34 pm
My ex husband is self employed and maintenace he pays does not reflect the company's income or his lifestyle. How can I prove 'real' income. Will the CSA look into this for me? We have previously had a proved arrangement.
CuriousChris 09/10/2014 at 10:37 am
I have my daughter as much if not MORE than my ex wife. She sleeps at mine 2/3 nights per week and MY parents house another night per week. Also either myself or my parents take her and pick her up from school the majority of the time. I have been paying £100 per month to my ex wife, as a verbal arrangement, despite all of the above but she has now applied for CSA. I'm not really concerned about this as I have a very poorly paid job with a basic salary of £12000 per year, however I want to know my rights. She works full time and earns possible twice the salary I do and also must get some sort of child benefit for our daughter - I recieve no benefits whatsoever and have to pay full rent, council tax, car insurance, gas, electric, internet, phone, food bills etc per month. I always have too much month left at the end of my money :) I don't think it's fair that I spend lots of time (more than my ex wife) and money on my daughter and still have to give my ex wife money especially when she earns double what I do? I have evidence of days/nights my ex wife has her child and the times me and my family have her. Any advice and people to discuss this with would be greatly appreciated. All the best everyone! My boyfriend has a 5 year old daughter and is split up with her mother for 4years he has to travel 196 miles to pick her up on a Friday and the same on a Sunday to drop her off and he still pays the mother 160 a month is this right?

Hello. My bf and I split up im 18 and he turned 18 awhile back as well we have a 2 month year old son and were sharing custody he takes the baby on the weekends but the baby doesnt spend the night with him because hes to little still. My ex lives with his parents and I live with mine my parents dnt work because there retired and his parents both work and my ex also works (I dnt work I go to college) my ex earns around 700$ per week sometimes more if he works on the weekends or goes to texas to work. My questions are approximately how much will he have to pay for child support? Since he has no bills to pay besides his prepaid phone car insurance and gas . Also, if I find someone to be with but not marry will my ex have to pay the same amount of child support?

I have been paying my child maintenance ever since my ex and i split through a personal arrangement at the basic rate of 15% and have no problem with this at all. my ex works full time as a professional and I have regular contact with my 14 year old daughter take her out and also pay her monthly pocket money direct to her.
my ex has moved in with another guy along with my daughter, and this is also cool. Until this point despite that fact i knew not all the mantenance goes on my daughter, i was happy paying but now she has moved in with another guy to his home, who also works full time, do i still have to pay the full amount or am i within my rights to reduce the cash payment to my ex but continue to provide pocket money, school trip payments, clothes and other essentials direct to my daughter? i would appreciate any advice any one may have in this matter. thanks.

@cassy, yes you can make a claim to the CSA regarding your ex's maintenance payments.

My boyfriend has two children with his ex one aged 18 one 15 he used to pay maintenance a few years ago when he worked, not through csa but agreed to stop when he became unemployed. He hasn't saw his son for over a year (his sons choice) and now she is claiming csa. My boyfriend does work and we have a child together, just doesnt seem right for him to hand over money when the ex and son wants nothing to do with him. How much maintenance will my boyfriend have to pay each week/month?

If my expartner is on the sick does he still have
TO pay me maintenance for my 1 child
Jane Editor 22/09/2014 at 10:53 am
@Sherri, they won't take any benefits she receives into account because the CSA don't look at the claimant's income, they just look at the income of the parent who is paying the CSA. The should take into account the amount of time the child stays with your husband and reduce the amount accordingly.
Sherri 21/09/2014 at 1:30 am
Hi, my partner has a son with his ex. She claims disability allowance for his son. His son stays with us for more than 52 nights a year. Should the csa take the disability allowance that his son receives into account when calculating payments as she gets the full amount? Thanks
Laura Editor 15/09/2014 at 11:50 am
@dean, it doesn't seem fair that you should pay maintenance to your ex if she hasn't paid you for the past 10 years. Does your daughter live with her mother full time now or do you have shared custody?
dean 12/09/2014 at 5:39 pm
My ex and i had a child when the baby was 8 months old the mother decided she didnt wanour baby so i bought her up my ex became a druggy evenually cleaned up and wanted access i had legal custordy but gave her access she never paid a penny to me for our daughter now my daughter Is 10 and decided she wanted to try living with her mum which i agreed as at her age she needs her mum as pubity etc is coming. @J, it's not right who told you that? Your ex has to pay for his daughter regardless of how many other kids he has. Go to the CSA and they will work if out for you and if necessary put an attachment of earnings on his wage.
J 12/09/2014 at 1:10 am
I have a 16 year old daughter and her father has not paid for her since his 2nd child with another partner. I was informed that because he has 2 dependant children living with him that he does not have to pay for my child so I have received nothing for the last 10 years. How can this be right when I know people in the same situation who have to pay csa?
Mikey1 08/09/2014 at 10:19 am
I pay my ex the required amount asked off me by the social services every month by Standing Order direct into her bank account. She now tells me that I must contribute half of the costs of school books which is € 111 She has informed the principle of their school to get the money from me . . Do I need to pay this amount ?
Dawn 26/08/2014 at 1:36 pm
Quoted from above:
'If the non-resident parent has some CSA arrangements and some Family-Arrangement maintenance then unfortunately, the CSA cannot take into account the Family-Arrangement maintenance paid. It can, however, take into account any court orders in relation to maintenance.'

Does this rule remain with the changes from CSA to the CMS? I have an order with the CMS that enforces payment as for two years he refused. He has now contacted me saying he is dropping the amount he is paying because he is providing maintenance to his other son (pocket money into his son's account) and spoken to the CMS who have told him how much to pay. If it's true I'm all for him supporting both his sons but suspect he's just trying to drop the amount of outgoings in favour of more social and using his children to do it - surely he would have to prove he's actually paying maintence if it's not a CMS organised thing (which it isn't) and surely they should contact me of any changes? Come payment time and it's not what is on my paperwork I will report him as I should - but would be a waste of time if it was a legal change and I didn't know about it?

Our relationship ended due to Domestic Abuse and so naturally is riddled with control and manipulation which still continues where he is able and has point of acces - this unfortunately being his children.

Hello, I'm a director in a business and the business is to be sold soon as my fellow directors want to sell up so I agreed to go along with it. What I want to know is this, if when the business is sold do I need to inform the CSA and will I have to pay a share of it to my ex?

I have just started a new job and earn £16,000 I also get a £6,000 a year car allowance and have had to go out and buy a one year old car as car needs to be less than 5 years old. The car allowance I get just covers my car finance and car insurance. When the csa calculate my payments what figure will they do in on £16,000 or £22,000 if its the later then I can't afford to live have paid out a loan, rent and other expenses - are there any exceptional circumstances and will they take my other off takes into account
grant Editor 24/07/2014 at 9:38 am
@Mick, the CSA have probably already written to your wife stating that you have overpaid and that she will have to pay that money back. Just give them a call and ask them what they are going to do about the overpayment.
Mick 23/07/2014 at 10:23 pm
Just had a letter from csa to stop my csa payments immediately (jul 2014) as my daughter moved out of my ex wife's home in sep 2013 and she stopped claiming child benefit then so I have paid 10 months too many.
My question is I have paid over £2000 since last September but did not know so where did that money go and how do I get it back. Do I claim it from the CSA or from my ex wife and what are the chances of being successful
gcee29 15/07/2014 at 10:26 pm
I was under pre 2003 CSA rules which allowed them to take 33% of my wage. Under the new rules post 2003.....i should have been paying 15% net for one child. They would not allow me onto the new rules and for 10 years i was continually reassessed under pre 2003 rules even up to 2012. Hardly fair. Considering the Mother was on £43000 per year and i was on £25000 at one point they still gave her 33% of my wage. Including her husbands wage they were on a combined salary of £80000 per annum. Fair??
I never once denied payment as it is my responsibility but as i was on ' old rules ' i was actually paying more money than a work friend with 3 children on the ' new rules ' on exactly same wage as me...Fair????
The entire system is corrupt....and no matter how many times they change it...it will always be to the detriment of the Father..who in nearly all cases is the ' non-resident parent'.
Having a child is a joint venture. Responsibility should be joint. Financial responsibility should be joint.

The CSA maintenance payments go on individual wage.............SO.....
Mother 1...works 16 hrs per week...receives all entitled benefits and gets £1300. The NRP(non-resident parent) pays his percentage based on wage which equates to £500 per month. SO...Mother 1 gets £1800 per month.

Mother 2...works 16 hrs per week...receives all entitled benefits and gets £1300.(same as Mother 1) The NRP(non-resident parent) pays his percentage based on wage which equates to £200 per month. SO...Mother 2 gets £1500 per month.

FAIR?????????

Why should any child or Mother OR Father looking at it from all angles and sides.....be worse off...depending on the father's income?

It is a travesty that our Government can not only allow children to be ABUSED by the system yet also abuse Father's and Mothers.
Sort it out without the CSA...because like any other major Government funded establishment....it is there to take your hard earned money...because that is all they care about. NOT the child.
Its ok that a Mother gets plenty of money from the father but where does that leave him??? unable to personally provide when he actually WANTS TO.
Equal financial parental rights......You equally made that child...you equally pay for it. If new daddy " Oh i so want to be involved, i love your kids"....then sorry pal....fork out. You knew she was a mother whe you got with her. Stop using their Father's money to help pay your mortgage.
Man up
System is flawed.

My ex split up with me 8 years ago when she had the baby, ive giving her money but she refuses to take any, what happens if she takes me to child support, will they backpay 8 years and how much would i have to pay back, i take home about £300 - 500?
ellie 09/07/2014 at 9:52 am
Do not go through the CSA/CMS to arrange child maintenance. They are completely useless. You might as well just piss in the wind. They have no powers at all. When I recently asked to do a reassessment, they asked me to provide evidence of my ex husband's income. They said if I did not have hard evidence, they will not check. If they ask my ex, and he says his circumstances have not changed they will not reassess. What is the whole point of the CSA/CMS. Waste of taxpayers money. Be heartened that any parent though is legally obliged and has the legal responsibility to give financial support to their children. Go through the solicitors, it may cost you but they are better at it. The trouble is this stupid government has changed the system but has not changed the legal system that supports it. So if you go to court, the court will ask you to refer maintenance to CSA/CMS but CMS will do bugger all for you and prefer you to do it yourself.

Cob if one of your children stays with you for the majority of the week and you have joint custody then surely you should be in receipt of that child's child benefit! Maintenance is only payable to the parent in receipt of child benefit. You are then in a position to claim maintenance from your ex for that child (a counter claim). You are mugging yourself by not claiming the Child Benefit for that one child.
Patrick Editor 19/06/2014 at 9:12 am
@cob if your child stays with you regularly for as many nights as you say then you should ask the CSA take this into account as a shared care arrangement. They should reduce your payment accordingly.
Cob 11/06/2014 at 6:38 pm
I earn 50,000 per year before tax and insurance. I pay 500.00 per month for my 14 and 16 year old children. My money after tax and insurance is 2400.00. I have one of my son's living with me 4/5/6 nights a week and the other when he wants to be between homes. My ex wife has her money and benefits and has 2400.00 per month and only has to pay 300.00 towards her rent while mine is 1000.00 she has more disposable income than me. When the children are with me I pay for everything and even when they are with her I pay for clothes, activities and food. I think we should be paying for the time they are with us and not contribute? What does the law state? We both have joint custody and they live with both of us?

@Kelly 22x - I have included the 'how we work out child maintenance payments' leaflet here which explains further how child maintenance is distributed between separated families. I hope this helps.

I have been divorced from my ex husband since 2010 and he has only ever paid 350-375 per calendar month in maintenance for my two children.

He signed as part of our divorce proceedings to state he would be paying 20% of his monthly net earnings he doesn't provide me with a p60 so how do I know what he is paying is 20%?

Hello. I am currently expecting a baby with my partner. He has a 4 year old son from his previous marriage. He pays his ex wife money each week. His son was born premature so he has many difficulties. I believe his ex wife claims on his behalf and as his carer. My partner is self employed altough his business is new so there is no accurate earnings to date he estimates to make about £2000 a month. Now that we are expecting our own child how will that affect the money that he payes his ex wife for his son. He will not confide in me at this time how much he is alraedy paying as i believe it is considerably more than would be advised. Although i do not wish to deprive his son from anything at all i am concerned that after our living expenses our child will not be left with adequte funds for us to support him the way i would wish. I know it's a sensitive subject but i just want to make sure things are worked out equaly before the baby is born. We are already struggling to make ends meet. I would appreciate a response as i am clueless about these things and i would like to have the revelvent information to address this with my partner. I am currently not work due to long term illness which has been exsasbated by my pregnancy.
Kind regards

Hi, I've been battling with my ex for years! CSA were giving me £7pw for our son until I took it to court and then I got £15pw. My ex is self employed tradesman and works full time. He has our son 2 days out of 7 and no other kids. His income is high (over £200pw) but if I am meant to get 25% I'm not sure how £15 is worked out!!?
Is it only worked out from profit when self employed or total income?
An up to date tax return was sent in and I have now been told he over paid and I owe him money :'( How is this even feasible?
Please help.. I'm no good with figures but want the best for my son.

I can only assume they have a good accountant. I see no hope!

I struggle to understand how this is fair and is there anything we can do as we struggle to make end meet

I had a short relationship outside my marriage with a married woman, a child was conceived and born and love greatly by both. My child’s mother has custody but I have access when every I can. My child’s mother is still married to her husband and I am still married to my wife we both have children in our own marriages, 2 each. My child’s mothers husband, has taken the roll of father whist my child is with him and he calls him Daddy, they look after my child well and I have no complaints. I provide for my child when with my family and also provide all school clothing asked for. But my wife is the main earner in our family, my income is in proportion insufficient to pay equally the cost of the home we live in and the costs of my other children. As my child’s mother and husband have taken the role of parents to my child and effectively adopted him into his family. Am I responsible to financially support them, my wife is very fond of my Child but has never taken the role of Mother to him and he does not call her mum or think of her as mum, but if we were to pay money to them it would be from my wife’s earnings as mine are already Inefficient to pay my share of the house hold bills. We love our child and try our best not to argue and squabble but when my child’s mothers income changes due to her husband’s job changing, they then come to me demanding I should pay money to them.I know the amount of CSA support would be 15% of my income net so I have always made sure my child gets that support directly in the things I buy when my child is with us, it would equate to around £25 a week, if I pay my child’s mother payments I will not have the income to provide the things I now provide for my child whilst my child is in my care. As my child gets older and has a choice he can spend more time with me and my family and this we look forward to. When this time comes I would not be asking for any support from my child’s mother or her husband. Please advise on what my legal status is and what my child’s mother can make me do, is it possible she can take money from my wife’s income? I would want to be fair and do the right thing but not if it’s going to cause my own family to suffer, they have done nothing to deserve being financially disadvantaged.

I’ve been married for 15 years wife and my told me that she wasn’t happy with the marriage, to be honest I wasn’t to, we agreed at the time that I would move out into rented accommodation and she could stay in the house with the kids, we both had been paying a mortgage for 18 years, I pay maintenance every month for my two children, 5 & 6. A year on and I’ve moved into another house with my new partner, with debts up to my eyes, because when you start over again you have to buy everything. My wife has a new partner with three children and he wants to move in with her when he sells his house in the New Year 2014. What I need to know is, what percentage of the profit of the house would I be entitled to?, after everything has been paid off we would be left with £110,000, I would like to point out that my wife works and earns £13,000 a year receiving benefits up to £600 a month plus the money I pay, £250 a month, I earn £24,000 a year.

I have 2 children with my ex Wife who I already pay maintenance to and another child with my new partner.Unfortunately my new partner has decided that as she wants more children and I dont that she wants to move out and start again. In these circumstances am I correct in thinking that I would be liable for 25% of my nett income split between the 3 children ? Also is the amount I pay variable and dependent on what income my ex Wife and partner have as a result of their own employment and financial standing ?

We moved to Spain 8 years a go and my husband now works in China. We bought a large house which I have made into a home for us all. I found out my husband had an affair 5 years a go and I believe he is seeing someone now. We have been married for 12 years. I am 52 and don't work, I gave up a good career to be a stay at home mum, not though choice, at my husbands request who now wants me to go and find a job. He continues to pay house keeping and has a very well paid job, he also received 1.2 million last year and bought a house without me knowing at it..... We have lots of ups and downs mainly because I still love him and he doesn't want to try and make our marriage work...... The problem is he spoils our child rotten with the best holidays the best of everything, money is not a problem for him. I am unable to match this as I don't work. My husband said he wanted our child to spent Xmas with him in China which leaves me on my own, my first reaction was No way. It's breaking my heart and I don't know what to do basically because my husband is buying our child's love. I do feel bitter at how our marriage has ended. This is my husbands 2nd marriage, he walked out on his last marriage leaving a child of 8 at the time. I want whats best for my child and am hurt that my husband feels he can come and go as he pleases and have the best of everything. Leaving me to bring up our child without any responsiblities in a country I'd rather not be. We are both come from the UK. Am I within my rights to say No to him but allow him to see our child for some of the Xmas holiday. I know our child would like to go and visit his father, but as this has only happened in the past 5 months I am not ready to let go just yet. This is making me feel so ill, please can you advise..

My partner pays his ex partner money each week for his son, she is now asking for more. He works full time on minimum wage. His son stays with us every other weekend with his other daughter who he also pays for, (daughter has a different mother to his son) would just like to know how much he should pay each week taking into account the above factors.

My husband pays child support for him daughter from another marriage. We have always paid CSA and out of pocket. He is British but I am American. We now want to move back to America with our two children. His daughter lives with her mother and will not be coming. Can CSA still make him pay if we are living in America? This is a long term move with plans to gain him his citizenship. I have been trying to find out but I am unable to fid out if America is one of the countries that CSA can reach. Can you please help? We want to do everything properly and legally. Thank you.

I live in spain.I had 2 children one in 1986 and one in 1988...we never married.we split in 1990,due to spanish law i never returned to uk as i was told by british consul my ex could charge me with kidnapping. I finally got to court in 2003 after countless delays here in majorca and was awarded 1200 per month,i have never received a penny.I have suffere illness and stress through working so hard without help to bring up my two children.I have found out my ex is now living in manchester uk.can i present papers for backpayment and where do i apply. he cant be allowed to get off scot free after what we have suffered.
Tara Editor 14/06/2012 at 12:57 pm
@Boris I think you do need proof that you are paying maintenance for your child, if you are handing over cash each week directly to her why don't you ask her to sign a dated piece of paper each week declaring that she has received your maintenance payment for that week? Also if you are amicable with each other ask her to sign to declare that she has received maintenance from you for the past four years, keep these as your records of payments.
dad Editor 14/06/2012 at 12:40 pm
@boris, there's no reason why she would not want the money paid into the bank as child maintenance payments don't impact the amount of benefit you receive anymore, maybe she doesn't realise this. The best thing to do, which I'm sure you know, is to pay it directly into her bank so that the payment can be proven. Alternatively you could contact the csa yourself and pay it through them, that way you will not be paying for something twice if she decides to call them in the future. You can check how much the csa would take form you by using the calculator on the child maintenance options website.

I am in full time employment and have been paying my ex £30 cash per werk for my son for nearly 4 years but cannot prove this. She is on benefits and refuses to get payments into the bank. I also look after him every weekend and holidays. I want my son to get the best, but I don't want to give her money and then end up paying it all back to the csa as well. What should i do

My situation is very scary I have 5 kids that I signed bc for. 3 with one girl 2 with another. I have a cs order on one of the 3 I have with the first girl. However I am in prison now and jus found out I have 4 other kids wit 3 other girls. My question is how will they determine cs payments and also would the mother of the the 3 kids get more than the others because I already have a cs order for one of our kids. Also one of the 4 kids I jus found out Bout already has a fathers name on her bc and he pays for the child will I have to make payment on this child also? All of the 4 kids I just found out about are 2-4 yrs old I do not know these kids and vice versa I was one of many men tested for these kids and think it would be in their best interest as well as mine if I signed my parental rights over. Any advice will do I am going insane over this matter. Thanks for your time

My daughter is getting child support for her only son who is three, he has his fathers last name. She is thinking of moving in with her new boyfriend, but doesn't think its fair that he should then start taking on paying for her child. 1./ would child support stop if she did move in with him? 2./ how many nights a week could she stay away from home but still have it classed as her address for legal reasons? Many thanks.

Hello ChildSupportLaws,
I have a son with an ex in the UK and now I live and work in Saudi Arabia. I have always sent a large amount of money home each month but after a recent dispute with the mother I have withheld 2 months money and decided to pay for needed goods and services as they arise after being shown a receipt.
The mother has now said she has sought legal advice and will be putting a court order on me and also possibly calculating both my wife's and mine income plus looking at our joint assets in the UK.
In short, is she able to apply a court order for child support on me whilst I am working overseas?
Many thanks

Hi - you would have to check with the CSA as they take other things into consideration.
ChildSupportLaws 17/04/2012 at 9:49 am
Hi John. Child maintenance is not based on whether your see your children or not I'm afraid. You are asked to pay it to help support your children. Why have you not had contact? Ask a solicitor to write a letter to her to agree contact times...the first appointment is often free.
John 16/04/2012 at 8:01 pm

My son looks after his son every Tuesday evening through to Wed morning and every second weekend- although for the last month he has had him every weekend. I have been split up with my ex for 9 years, we were not married she left me.
I have worked hard and climbed the ladder
I pay her 380 per month and now increased it to 450 per month
I have new daughter and partner who live with me
I pay the mortgage in my partners house.
Her previous husband has finished payments as her oldest son is now over 18
I have a lot of out goings and am overdrawn and paying off credit card bills
Will the csa take this into consideration?? I do not have a problem paying for my son but any more would cripple me financially then I would have to sell car and now on the form it wants to know what my new partner has?? Can the csa take money from her ?? My past relationship should not be affecting her pocket surely???
And if I continue to do well professionally what's the point if csa remove it from my wage packet?

What's the use in trying to succeed when all I will be doing is giving my ex a better lifestyle ???

I am looking for advice please. I have 2 boys and have recently relocated to the Isle of Man to help look after my mother in law. I still own a property in the UK but because we are resident here I now claim the child benefit in the Isle of Man. My ex (he does not have parental responsibility) contacted the CSA in order to stop his payments for the children, because we moved over here. I realise the CSA do not have jurisdiction over here, is there anyting I can do? He also owes me nearly £1000 in missed payments, but I never pursued it in fear of "upsetting the apple cart" as since 2008 he had paid relatively regularly. Thank you.

dondon - 26 January 2012 @ 2:30 PM

Dondon - Do you have texts from him confirming when he will pick your child up
If you do and these texts back up your side of the statement it is good evidence to pass to the CSA. What happens with school when your child is with him for a week at a time. Do you have independent witneses (a teacher, other Mothers, bus tickets etc) that will prove the child is under your care.

How long do I have to pay child support for? Is it 16 years of age even though my daughter will be staying on at school untill 17?
Crewey - 24 February 2012 @ 6:16 PM

Crewey
If your daughter remains in full education and has no income you will be liable to pay until her 19th birthday.

for the last 6 years both my children have gone to boarding school, My parents pay all oth fees involved. This means that there mother on average has them 2 nights per month and holiday periods she has them 30% of the time. As she has no outlay whatsoever for an average of 28 days per month is she still entitled to csa payments.
Any assistance or guidance would be appreciated..

ChildSupportLaws 02/11/2011 at 10:15 am
Hi PPM. They don't specifically take a new partner's income into consideration but your household income. CSA is reduced if you have children living in your current home etc. You really have to check with the CSA on this one.
PPM 01/11/2011 at 8:06 pm
Recently received notification of a CSA case review. The CSA have requested details surrounding my wife's income. My question is should my new wife's income be used when assessing my maintenance obligation? Are there any negative impacts if we elect not to disclose this information?

My daughter has received very little help from her sons father and at the moment he pays her £85 per month and it was a lot less before this.
My Grandson is 13 years old now and his father has gained promotions and pay rises over the years[Now Regional manager I believe]
He is in a stable relation ship with his new partner of many years and no other children are involved he has just agreed to put his payment up to £130 per month,my question is should he be paying more for his son than what has been stated above.

8 yrs ago I reached a settlemement with my wife. The Child Support portion was set at £400/month which has been paid each month plus extra when required. In addition I pay for holidays etc.

My ex wife knows my earnings have considerably increased and is now asking for more. Does she have a legal right/case ? My concern is that additional cash, like the cash already paid is not reaching the children.

My partner has three children, his gross income is £10,000 per month. He has his three children for 175 days per year. The youngest (5) is severly disabled and recieves maximum disability allowance, which goes to his mother along with all other disability benefits(car allowance of £500 per month etc). Can you help us to work out what maintainance we should be paying? Many thanks

My friend is paying 300 a month which is 15% of his wages but has a loan which is for his ex's breast implants that he pays on top of £250 a month as well. Is this right or is it possible he pays less till that amount is cleared as this is over 5 yrs.
